<span class="text1597Font1"  >The Federal Drug-Free Workplace Program has two 
authorities: Executive Order 12564, titled ‘Drug-Free Federal 
Workplace,’ was signed in September 1986. &nbsp;It established 
drug-free status as a new condition of federal employment. &nbsp;It 
required that federal agencies establish drug-free workplace 
programs, including employee assistance programs (EAPs), 
supervisor training, employee education, and drug testing 
under carefully controlled circumstances. The Executive 
Order required drug testing for employees whose work could 
affect public safety, public health, or national security – and 
for those who volunteered. &nbsp;It authorized drug testing for 
applicants, when there was reasonable suspicion, as part of 
an accident investigation, and following treatment or 
rehabilitation. And Public Law 100-71 (sec. 503). &nbsp;
Subsequent legislation required that the Department of 
Health and Human Services certify all federal agency plans 
and establish Mandatory Guidelines for Federal Workplace 
Drug Testing Programs. &nbsp;These Guidelines, which govern 
specimen collection and chain of custody, as well as testing 
and reporting procedures, require that laboratories be 
specially certified before they can analyze federal employee 
specimens. &nbsp;The Guidelines also require that independent 
Medical Review Officers receive and consider test results 
before they are reported to the agency. The program and its 
random testing provisions received extensive judicial review – 
including by the Supreme Court – in cases that established 
the primacy of Government’s interest in the protection of 
public health and safety and national security over federal 
employee’s Fourth Amendment protections. The program is 
overseen by the White House Office of National Drug Control 
Policy, the Department of Health and Human Services, the 
Department of Justice, and the Office of Personnel 
Management. &nbsp;Its employee protections, provisions for 
rehabilitation, training and education requirements, and 
scientific rigor have given the Federal Drug-Free Workplace 
Program its reputation as the ‘gold standard’ for workplace 
policies and testing.</span ><span class="text1597Font3" style="background-color:transparent" >
