<span class="text9524Font1" >Any time a supervisor becomes aware that an employee is
experiencing problems, a referral to the EAP for help may be
appropriate. If an employee is having personal problems, but
the problems are not affecting work performance, a
supervisor may want to make an informal referral. In this
situation, the supervisor reminds the employee that the EAP
is available and encourages the employee to use the EAP's
services. If an employee's personal problems are affecting
job performance, then a supervisor may make a formal
referral for assistance. In such cases, the supervisor first
contacts the EAP and discusses the situation. If the EAP
says that a referral is appropriate, the supervisor will inform
the employee of the formal referral and document it during a
meeting with the employee. In both of these cases,
conversations between the employee and the EAP are
strictly confidential. It is no different than going to a private
counselor. However, if there is a finding of drug use, the
situation is different. Under your organization's drug-free
workplace plan, an EAP referral after a finding of drug use is
a mandatory action and management now has a direct
interest. Under a mandatory referral after a finding of drug
use, employees are required to sign a limited release of
information to allow the EAP to inform the appropriate
management official of the employee's progress, including
whether or not he or she is attending sessions as expected.
Even under a mandatory referral, no information is ever
provided to a supervisor or management official about the
content of counseling sessions between the employee and
EAP, counseling, or treatment professionals. Unless
required to comply with a mandatory referral, the employee
is under no obligation to go for help. However, employees
who are referred to the EAP following a finding of drug use,
and can expect that the EAP will report their non-
participation to the management official who made the
mandatory referral – and that they will be removed from
service. Your organization's drug-free workplace plan directs
that the action to remove an employee is to be rehabilitation
through an EAP after having been found to use illegal drugs,

terminated or removed from Federal service as a result of
