drug-free workplace plan. Many organizations have both D-
O-T-covered and non-covered employees and they run two
separate programs. There are important differences between
them: Your drug-free workplace plan covers all employees –
D-O-T regulations cover only certain employees considered
to be part of the ‘transportation industry’, Your drug-free
workplace plan addresses the use of illegal drugs only – D-
O-T regulations address both illegal drugs and alcohol, Your
drug-free workplace plan is comprehensive – D-O-T
regulations primarily address testing. There are important
similarities as well: Drug tests – whether under the Federal
Drug-Free Workplace Program or under D-O-T regulations –
are performed in exactly the same way, Only laboratories
certified under the National Laboratory Certification Program
can conduct the tests, Only trained Medical Review Officers
or M-R-O's can report results. And there is one other
important point. The vast majority of employees covered by
D-O-T regulations are employed in the private sector. As a
result, the regulations do not mandate that employers offer
an E-A-P program or make treatment available under a
health benefits plan. Instead, employees are responsible, on
their own, for locating and consulting a ‘substance abuse
professional’ and for following any treatment or other
recommendations provided. But, the Federal government –
acting as an employer – has provided an E-A-P program and,
depending upon the plan selected, coverage for benefits plan.
