<p class="title">The following is a complaint filed with the Division of Professional
Licensure, Commonwealth of Massachusetts, dated September 20, 2005 against
Ms. Kathy Cartmell-Sirrico, Chairperson of the State Board of Registration
of Funeral Directors & Embalmers.</p>
<p>Ms. Cartmell-Sirrico in her capacity as Vice Chairperson of the State Board
on December 9, 2003 witnessed an extraordinary outburst by then Chairperson,
John J. Kazlauskas, as he made vicious, malicious, libelous, and slanderous
statements about Philip G. Haddad, Jr. prior to Mr. Haddad being invited
into a meeting of the State Board. So biased and prejudiced were Mr. Kazlauskas’s
remarks that when he realized they were being recorded he attempted to have
them erased from the record.</p>
<p>Moments later, Mr. Kazlauskas was advised to recuse himself from the meeting,
which he did ONLY for Mr. Haddad’s participation in the meeting.</p>
<p>Ms. Cartmell-Sirrico then assumed the role of Chairperson of the meeting
on December 9, 2003.</p>

<p><strong>COMPLAINT</strong></p>
<p>This complaint is filed against Ms. Kathy Cartmell-Sirrico, Chairman, State
Board of Registration of Funeral Directors and Embalmers, Commonwealth of
Massachusetts pursuant to her role as Vice Chairman during the meeting of
the State Board on December 9, 2003 and subsequently as Chairman, State
Board of Registration of Funeral Directors and Embalmers, Commonwealth of
Massachusetts issuing Order to Show Cause to Philip G. Haddad, Jr. dated
and signed by Ms. Cartmell-Sirrico on June 29, 2004.</p>
<p>The following information has been obtained as a result of an investigation
authorized by Philip G. Haddad, Jr. into the circumstances leading up to
the issuance of the Order to Show Cause issued to Philip G. Haddad, Jr.
and signed by Ms. Cartmell-Sirrico on June 29, 2004. The investigation was
initiated by Mr. Haddad as a result of numerous instances of unprofessional,
unethical, unfair, and biased actions taken by the State Board of Registration
of Funeral Directors and Embalmers under the direction and guidance of Ms.
Cartmell-Sirrico, it’s Chairperson.</p>
<p>On November 29, 2003, Mr. Haddad was requested to appear at a meeting of
the State Board of Registration of Funeral Directors and Embalmers on December
9, 2003. Mr. Haddad rearranged travel plans and meetings in order to accommodate
the request of the State Board. Mr. Haddad was invited into the meeting
at the request of Ms. Cartmell-Sirrico, who was acting as Chairperson in
the absence of Mr. John J. Kazlauskas, Chairperson for the State Board of
Registration, Commonwealth of Massachusetts.</p>
<p>As the questioning began, Mr. Haddad became suspect that something was
different this time around. The environment was hostile. The line of questioning
was condescending. And the professionalism – prevalent in all previous
meetings attended by Mr. Haddad at the State Board - was non-existent.</p>
<p>So apparent was the hostility in the room that Mr. Haddad asked if the
meeting was being recorded. Advised that it was, Mr. Haddad immediately
and in the presence of Ms. Cartmell-Sirrico requested a taped copy of the
meeting.</p>
<p>At this point, Mr. Haddad was unaware of what preceded his appearance at
the December 9, 2003 meeting of the State Board. As a result of the investigation
authorized by Mr. Haddad, the following discussions, accusations, and allegations
were made by the then Chairperson of the State Board of Registration of
Funeral Directors and Embalmers, John J. Kazlauskas. Additionally, the information
gathered as a result of the investigation authorized by Mr. Haddad was further
verified once the audio tape was obtained 9+ months later after numerous
failed attempts to obtain the tape from the State Board. The information
obtained from the audio tape proceedings borders on criminal intent by all
members of the State Board of Registration of Funeral Directors and Embalmers,
as well as two (2) funeral directors from Central Massachusetts.</p>
<p>The following complaint is filed against Ms. Kathy Cartmell-Sirrico personally,
professionally, and as Chairperson, State Board of Registration of Funeral
Directors and Embalmers. In her capacity as a funeral director and Chairperson
of the State Board, it is expected, at a minimum, that Ms. Cartmell-Sirrico
is a professional capable of exercising impartial and unbiased objectivity
in the performance as Chairperson of a State Board of Registration of
Funeral Directors and Embalmers in serving the “public trust.”
Prior to making judgments, Ms. Cartmell-Sirrico is expected to gather
all the facts, ask all pertinent questions of the applicable parties,
and render decisions based upon all the facts and not biased, prejudicial,
unethical, and defaming statements made by members of the State Board
with an “axe to grind” and/or a “personal vendetta”
for someone.</p>
<p> Ms. Cartmell-Sirrico, then Vice Chairperson of the State Board of Registration
of Funeral Directors and Embalmers, on December 9, 2003 witnessed such
a tirade by then Chairperson, John J. Kazlauskas; wherein Mr. Kazlauskas,
prior to Mr. Haddad ever being invited into the meeting and spoken to
by any member of the State Board, made vicious, malicious, defaming, and
unproven statements impuning Mr. Haddad’s character before all members
of the State Board.</p>
<p>So vicious and malicious was the outburst on December 9, 2003 prior to
Mr. Haddad being invited into the meeting by the then Chairperson, John
J. Kazlauskas, that Mr. Kazlauskas was advised by counsel to recuse himself;
after Mr. Kazlauskas attempted to recant his statements upon learning the
proceedings were being recorded. (See, hear, and make note of the statements
and accusations made by Mr. Kazlauskas and Ms. Cartmell-Sirrico at the December
9, 2003 meeting of the State Board by listening to the audio tape, which
will soon be made public. The tape speaks volumes for the injustice perpetrated
upon Mr. Haddad).</p>
<p>Ms. Cartmell-Sirrico assumed the Chairmanship of the State Board Meeting
on December 9, 2003 for Mr. Haddad’s appearance and questioning; only
to relinquish the Chair to Mr. Kazlauskas immediately upon Mr. Haddad’s
departure so that Mr. Kazlauskas could further badger and impune Mr. Haddad’s
character in the presence of Kurt & Katherine Mangsen (Nordgren Memorial
Chapel) and their legal counsel.</p>
<p>Ms. Cartmell-Sirrico exercised poor judgment and a lack of professionalism,
honor, and integrity by allowing Mr. Kazlauskas to return as Chairperson
and to lead the meeting with the appearance of the Mangsen’s and advising
them as to what to do in the filing of complaints against Mr. Haddad.</p>
<p>Interestingly enough, none of this was known to Mr. Haddad until 10+ months
later, and then only as a result of the investigation authorized by Mr.
Haddad and finally as a result of obtaining a tape of the proceedings of
the December 9, 2003 meeting.</p>
<p>After issuing an Order to Show Cause to Mr. Haddad on June 29, 2004 and
Mr. Haddad’s request for a hearing made to Ms. Cartmell-Sirrico and
the State Board within the 21 day timeframe required, Ms. Cartmell-Sirrico
intentionally delayed the hearing knowing Mr. Kazlauskas was terminally
ill. If Ms. Cartmell-Sirrico delayed the hearing, which has yet to take
place more than 446 days later, Mr. Haddad would be unable to confront Mr.
Kazlauskas should he pass away as expected. Mr. Kazlauskas did pass and
Mr. Haddad has been deprived of his 4th and 6th Amendment rights in this
matter.</p>
<p>Ms. Cartmell-Sirrico is a co-conspirator with Mr. Kazlauskas and others
in the issues stated above, and she needs to be immediately removed from
the State Board. Further as a result of her lack of good judgment, honor,
integrity, and violation of the “public trust”, I encourage
the State Board and Division of Professional Licensure to consider an indefinite
suspension of her License to practice as a Funeral Director and Embalmer
in the Commonwealth of Massachusetts.</p>

<p>Ms. Cartmell-Siricco, and the entire State Board of Registration of Funeral
Directors and Embalmers – to include Ms. Cartmell-Sirrico, Mr. Kazlauskas,
Mr. Mazur, Mr. Barile, Ms. McCarthy, Mr. Bresnahan, investigator, and Christopher
Connally, legal counsel – all having an “extraordinary lapse
of judgment” on December 9, 2003, which has led to a conspiracy of
colossal proportions to cover up their actions. How fortunate it is that
the meeting on December 9, 2003 was recorded; that we kept extensive records
of all proceedings, and that the results of our investigation will “hold
the aforementioned individuals accountable of their actions and attempts
to cover up their injustices” as the Ethics Commission, which was
created to foster integrity in government and promote the public trust in
the Commonwealth of Massachusetts, is apprised of ALL the facts in this
case.</p>
