<p>We continue to gather additional information, facts, and circumstances surrounding
what has become a “colossal conspiracy” on behalf of several funeral
directors in and about Central Massachusetts. The malicious and vicious allegations
and accusations by members of the funeral profession in their attempt at character
assassination to their personal, professional, and financial benefit have caused
the State Board of Registration of Funeral Directors and Embalmers, Commonwealth
of Massachusetts to take action that is inappropriate, unjust, and prejudicial
without having the facts in hand and without benefit of the Show Cause Hearing
that was proposed on June 29, 2004. </p>
<p>It has become abundantly clear as to why the hearing has not been held. Conclusions
have been drawn by the investigator, State Board of Registration of Funeral
Directors and Embalmers based upon prejudicial and blatant lies perpetuated
by its former Chairman, John J. Kazlauskas and Mrs. Katherine Mangsen, wife
of Kurt Mangsen, president, Nordgren Memorial Chapel in Worcester. It is indeed
unfortunate we will be unable to question Mr. Kazlauskas as to his motives for
not only inciting the members of the State Board of Registration of Funeral
Directors and Embalmers and other attendees at the December 9, 2003 State Board
Meeting, but making outright lies the focus of his comments. Mr. Kazlauskas
died recently after several months battling pancreatic cancer. It has been suggested
to me that the State Board was unwilling to answer my many requests for information
(requests well documented) and did everything in their power to see to it that
the audio tape of the proceedings of the December 9, 2003 State Board Meeting
did not get into our hands before Mr. Kazlauskas passed away. Mr. Kazlauskas
need not answer further to us, for the record speaks volumes and I believe Mr.
Kazlauskas has and is atoning for his comments and actions to a HIGHER BEING
at this very time. </p>
<p>I have presented in previous updates correspondence forwarded to Ms. Beth Lindstrom,
with authority over the Division of Professional Licensure; correspondence to
Attorney General Thomas Reilly, with copies of all correspondence to Governor
Mitt Romney. We realize no one at the State level wishes to touch this “hot
potato” or attempt to justify their actions and inactions or “be
held accountable” for that which they are being paid to investigate with
impartiality and fairness. </p>
<p>Unfortunately, the old adage is very true, “A lie goes half way around
the world, before the truth be told.” In this case, the lies have gone
even further and continue to be repeated and embellished daily. Let me assure
you, “the truth will prevail long and far, and others will not be subject
to character assassins” – for they will soon be put on notice that
‘character assassins WILL BE identified, rooted out, and held accountable.’</p>
<p><a href="#sullivan">The following correspondence </a>was forwarded to Mr. Gregory
Sullivan, Inspector General, Commonwealth of Massachusetts, on May 20, 2005.
A follow up call to Mr. Sullivan was made on Wednesday, June 1, 2005. Within
moments, Mr. Jack McCarthy from the Inspector General’s Office returned
my call. (Our brief discussion and any further actions taken will be presented
in the next UPDATE).</p>

to its publisher, its editor, and specific instances of the inaccurate reporting

<p>Dear Mr. Sullivan:</p>
<p>I write to you not to allege but to prove the existence of a colossal conspiracy
by and between the former Chairman, State Board of Registration of Funeral Directors
and Embalmers; the investigator for the Board, Mr. John Bresnahan; and all members
of the State Board of Registration of Funeral Directors and Embalmers. The aforementioned
individuals have conspired with funeral directors in Central Massachusetts in
an attempt to assassinate my character, as these same funeral directors have
and continue to benefit personally, professionally, and financially from their
actions at my expense and to the detriment of families who have lost loved ones.</p>
<p>What I have just stated is a VERY BOLD STATEMENT, but FACTUAL in its every
word. I am prepared to not only justify, but to prove, the validity of what
I have attested hereto.</p>
<p>My name is Philip G. Haddad, Jr., and I have been a registered funeral director
since 1967. During this time there has NEVER been a complaint filed against
me by any family I have served with any Board or Regulatory Authority. During
this time, there has NEVER been a complaint filed against me by any family member
who has prearranged their funeral arrangements with me. During this time, there
has NEVER been one penny that has not been accounted for, and in addition, I
have always remitted to families funds in excess of the cost of the funeral
at the time of passing – although legally, the additional funds may be
retained by the funeral home.</p>
<p>I have NEVER filed a complaint with the State Board of Registration of Funeral
Directors and Embalmers, Commonwealth of Massachusetts – NEVER!</p>
<p>The only complaints EVER filed against me over the years have been by FUNERAL
DIRECTORS – jealous of me personally and professionally and the clientele
I serve – primarily the Eastern Orthodox Community of Central Massachusetts.</p>
<p><strong>Now to the FACTS and purpose of contacting you and the Office of the
Inspector General, Commonwealth of Massachusetts!</strong></p>

As of November 19, 2003 I was a funeral director, and an owner of 3% of Class
A voting stock and an owner of 10% of the non-voting stock, at Nordgren Memorial
Chapel, 300 Lincoln Street, Worcester, Massachusetts. On this very day (November
19, 2003) at approximately 10:00AM, Mr. John Bresnahan, investigator, State
Board of Registration of Funeral Directors and Embalmers performed a surprise
inspection at Nordgren Memorial Chapel. I was not present during the inspection.
In reviewing a file for the funeral of Mrs. Bahaviolos (funeral was pre-funded
and had been completed), Mr. Bresnahan found the form “Cost of Goods &
Services” missing from the file. Mr. Johnson, a colleague and funeral
director at Nordgren Memorial Chapel, called me and put Mr. Bresnahan on the
phone. When Mr. Bresnahan indicated the form was missing, I was shocked and
said, “The form with adjustments was there when I gave it to the secretary/bookkeeper.”
(NOTE: in more than 23 years of active participation in the funeral profession
there has never been a time when the COST of GOODS & SERVICE Form was not
in the file at the conclusion of the Funeral Service. It would be impossible
to bill families or resolve balances without it). At that time I indicated to
Mr. Bresnahan I might have a marked up copy in a file box in my car. He indicated
that if I did find it, would I please fax it to his office in Boston. I did
find a wrinkled working copy; it was faxed to Nordgren’s within 10 minutes
of my conversation with Mr. Bresnahan; and given to Mr. Bresnahan.</p>
<p>Six hours later, delivered to me by a local constable, was a termination of
employment letter from Kurt Mangsen, President & CEO, at Nordgren Memorial
Chapel. As stated earlier in this correspondence, I was an owner of the funeral
home at this time and still am.</p>
<p>A week or so later, I received correspondence to appear at a meeting of the
State Board of Registration of Funeral Directors and Embalmers on December 9,
2003 in Boston. I had plans to be in New York City with meetings and presentations
already scheduled. With some difficulty, I was able to reschedule the meetings
and presentations to accommodate the State Board’s request.</p>
<p>At the December 9, 2003 meeting of the Board I was received by what I can only
call “a hostile reception / environment.” Quite frankly, I was accustomed
to receiving a much more professional response from the Board. (Little did I
know that moments before I was invited into the conference room, the then Chairman,
John J. Kazlauskas, had made disparaging, accusatory, and defaming remarks about
me to all members of the Board and others in attendance – statements that
are all lies). Before leaving the meeting, I asked if the meeting was being
taped? The answer being, “Yes it was.” I asked for a copy of the
tape and was assured I could and would have it upon request. It took more than
a year to obtain the tape, and its content will speak volumes to the conspiracy
that was about to</p>

<p>unfold. Suffice it to state, Mr. Kazlauskas, when he realized the meeting was
being taped, asked and then demanded his remarks be erased and attempted to
take the statements back. This tape and information therein is in my possession
and <strong>“screaming to be heard.</strong>” </p>
<p>Mr. Kazlauskas was advised to recuse himself from the meeting and Ms. Kathy
Cartmell- Sirrico assumed the responsibilities of the Chairman for the meeting.
Upon my departure and prior to inviting representatives and counsel for Nordgren
Memorial Chapel into the conference room for the same meeting and subject matter,
Mr. Kazlauskas re-assumed his position as Chairman of the Board – advising
the Nordgren Memorial Chapel contingent in matters that minutes before he personally
and prejudicially influenced the proceedings that were about to take place.</p>
<p>What transpires from here on out is total cooperation between the State
Board of Registration of Funeral Directors and Embalmers, by Mr. Bresnahan
and Mr. Kazlauskas, and Mrs. Katherine Mangsen, wife of Kurt Mangsen (President,
Nordgren Memorial Chapel). Complaint EM-04-124 was filed with the State
Board by Mrs. Katherine Mangsen on December 18, 2003, and Complaint EM-04-126
was filed with the State Board by Mrs. Katherine Mangsen on December 24,
2003 (Christmas Eve, would you believe). <strong>Please note: </strong>the
two complaints (and subsequently a third complaint – EM-04-184, which
was not accepted by me) were submitted by the wife of the President of Nordgren
Memorial Chapel (Mrs. Mangsen not having ever been licensed or educated
in funeral service), and not by Kurt Mangsen, President of Nordgren Memorial
Chapel (a registered and licensed funeral director for many years).</p>
<p>At this point, I shall not get into specifics as to the restrictive timeframes
within which I had to respond to the complaints and other correspondence from
the State Board of Registration of Funeral Directors and Embalmers, and the
lack of professionalism by the State Board of Registration of Funeral Directors
and Embalmers in not responding to my requests for information and clarification.
I have EVERY document to substantiate my statements and am prepared to share
it with you during your investigation.</p>
<p>I have indicated in correspondence to the State Board of Registration of Funeral
Directors and Embalmers that it was apparent to me and should be apparent to
them that Mrs. Mangsen was on a <strong>“witch hunt”</strong> attempting
to use the so-called <strong>“shot gun”</strong> approach in an
attempt to assassinate me and my character. At that stage, I was unaware that
the State Board of Registration of Funeral Directors and Embalmers in the persons
of Mr. Kazlauskas (its Chair) and Mr. Bresnahan (its investigator) were part
and parcel to the conspiracy. Correspondence to this effect now in our possession
will clarify these points.</p>

<p>On June 29, 2004, I was served with an Order to Show Cause. I responded within
the 21 days of receipt of the Order and eleven (11) months have past and no
hearing. I have requested to have the hearing held in Worcester as the 12 witnesses
we shall cross-examine primarily reside in the Worcester area and the 20+ witnesses
we shall call to testify to the facts are either elderly, in poor health, or
incapable of driving to Boston, hassling the traffic, and finding a place to
park. The hand written response to our official request for the hearing to be
held in Worcester was denied by Ms. Anne E. Colleton, Administrative Hearings
Counsel.</p>
<p>As the case in point crumples piece by piece as the facts ONLY now begin to
be heard (they have been available from the outset as you will see when you
review my responses to the complaints), Mrs. Mangsen and counsel to Nordgren
Memorial Chapel, Mr. Scott Sinrich, chose to communicate with an industry publication,
entitled – THE FUNERAL MONITOR. With their backs to the wall and their
integrity crumbling at the same time, the information shared with and soon thereafter
published by the Funeral Monitor by Mrs. Mangsen and Mr. Sinrich is not only
libelous, slanderous, and defamatory; but the actions of desperate people whose
attempts at character assassination are coming back squarely at them. Fortunately
or unfortunately, the State Board of Registration of Funeral Directors and Embalmers
is right in the middle of this colossal conspiracy. </p>
<p>Mr. Sullivan, I have been held hostage for the past 18 months by the State
Board of Registration of Funeral Directors and Embalmers; unable to practice
in my chosen profession. The horror stories of families that have lost loved
ones and forced to find other accommodations are screaming to be heard and WILL.
<strong>In America, one is presumed innocent – until proven guilty, but
apparently – NOT IN MASSACHUSETTS!</strong></p>
<p>I contacted Governor Romney, Lt. Governor Healey, and Ms. Beth Lindstrom –
but apparently they are too busy to respond to a life-long resident and tax
payer of the Commonwealth of Massachusetts.</p>
<p>I contacted Attorney General Reilly and his staff was genuinely supportive
and indicated the Governor’s Office (and Ms. Lindstrom) was the appropriate
venue for the information presented.</p>
<p>I now come to you in your capacity as Inspector General, Commonwealth of Massachusetts,
before going to the local and national media. It is not my intent to hurt or
embarrass anyone, nor is it my desire to have been subjected to the actions
and lack thereof by the State Board of Registration of Funeral Directors and
Embalmers. Justice MUST, and let me assure you WILL be served. Your reaction
and response to this correspondence will determine the next course of action
I will choose.</p>

<p>In summary, it is not my intent to bring local and national media attention
into this matter, and to date I have refused invitations to speak and share
information with the media. I AM committed to justice being served and those
involved to be held accountable for their actions. Assuming the hearing goes
forward, I shall invite the local and national news media to be present. I consider
character assassins to be amongst the most vicious persons on the face of this
earth, and they must be identified, rooted out, and held accountable –
and Mr. Sullivan – THEY WILL BE.</p>
