<p>I have learned and continue to learn a great deal more about the <em>lack of integrity</em> and the <em>lack of transparency</em> when it comes to public service in State Government in Massachusetts. Compound this with others that distort, falsely accuse, and outright lie; and you have a lethal combination ripe for plucking by evil and the ultimate evil one.�</p>
<p>As I now present veritable acts, actions, and statements of persons to be identified as to their positions in the state government as well as corporate America - individuals who have forfeited integrity (although I shall leave you to make the final determination); I shall make, take, and present statements and actions documented in the public record as well as in documents in my possession and relate them to you - veritable documents and statements of veritable facts soon to be released in the appropriate venue.�</p>
<p>If you had time to review the previous Update - dated August 5, 2010, you would be familiar with the statement I made concerning the role of public servants in the Commonwealth of Massachusetts -�</p>
<p>� "<em>Getting it right is not always easy. </em>But <strong><em>getting it wrong is not an option</em></strong>!"</p>
<p>The Funeral Board knows (and knew at the time of the Administrative Proceedings) as did the Division of Professional Licensure�s Anne Colleton, Administrative Hearing�s Counsel (supposedly the fair and impartial judge for the Massachusetts Funeral Board) as well as the prosecution attorneys (James Read & Leslie Alexander) that I was a federally trained "Grievance Examiner" - having adjudicated numerous cases of abuse of authority, and alleged bias and prejudice during my 32 year tenure with the federal government. As stated above, "<em>Getting it right was not always easy. </em>but <strong><em>getting it wrong was never an option</em></strong>!"</p>
<p>Administrative Hearings Counsel (Colleton) (D.P.L.) had a litany of opportunities to see and hear inconsistencies in testimony by witnesses for the prosecution - witnesses that included Kurt and Katherine Mangsen, Gail Wiles, Ronald Johnson, Tracy Mitchell (expert witness for the Commonwealth of Massachusetts), and John Bresnahan (State Board Investigator). Add to this acts, actions, and statements of Nordgren�s Corporate Counsel (Scott Sinrich - Law Firm of Phillips, Silver, Talman, Aframe, & Sinrich in Worcester) that were proven to be lies and distortions by "hostile" defense witnesses, and you have a conspiracy of proportions only limited by the extent of their testimonies.�</p>
<p>(For the record - a 'hostile witness" is one that is subpoenaed and mandated to come forth and testify in a specific action." Were one to read the testimony of all witnesses (and several folks have) documented by a court reporter recruited and paid for by me (at a cost in excess of $20,000), it would be clear to you as it has to all concerned, that Administrative Hearings Counsel (Colleton) was far from fair, was far from impartial, and struggled to stay alert and understand and comprehend the subject matter being explained by numerous witnesses and by me as I represented myself ("pro se"). Time and time again, I had to turn to Mr. Mazur and say, "Please explain the process to Ms. Colleton!"</p>
<p>During a break in the Administrative Hearing Proceedings, I attempted to speak with Lead Division of Professional Licensure Prosecution Attorney, James Read, and detail inconsistencies in his statements and those of Leslie Alexander, DPL attorney. Attorney Read�s response, <strong><em>"Mr. Haddad, it is my job to see that you never practice as a funeral director again in the Commonwealth of Massachusetts, and I�m not interested in the facts as you present them."</em></strong> As always, I have (had) a witness present; for I have learned from my experiences as a Grievance Examiner, that a reliable witness(es) is extremely important in seeking truth and meeting out justice. If I had any respect for Mr. Read prior to the aforementioned statement (well documented), it certainly evaporated instantly with his harsh and mis-guided statement; for at that very moment I realized I was to be only a "statistic" in Atty. Read�s data base justifying his position at any cost. Truth and Justice meant nothing to Atty. Read or Administrative Hearing�s Counsel (Colleton), and it came down to me vs. the Commonwealth of Massachusetts.</p>
<p>Questions now to be raised and answers thereto will be presented from the public record and together we will decide whether the questions and answers presented are <strong>FACT</strong> or <strong>FICTION.</strong></p>
<p><strong>Statement-</strong>made by Mrs. Katherine Mangsen to Inspector Bresnahan on November 19, 2003. Statements made by Mrs. Katherine Mangsen to the full Massachusetts Funeral Board on December 9, 2003. Statements made by Mrs. Katherine Mangsen during her testimony at the Administrative Hearings concerning three (3) complaints that she (and <strong><em>only</em></strong> she) signed and forwarded to the Massachusetts Funeral Board. Mrs. Katherine Mangsen�s husband, Kurt Mangsen, who was president and CEO of Nordgren Memorial Chapel at that time and to this very day) stated under oath that he had not read nor did he sign the complaints filed by his wife prior to the complaints being forwarded to the Funeral Board and years later still had not read the complaints. If this surprises you, as well it should, it did not then and does not now surprise me in the least.</p>
<p>On all three (3) occasions, Mrs. Katherine Mangsen stated to the respective parties, participants, and the public present at each of these instances that "We (meaning she and Kurt) were in the process of terminating him (referencing me) prior to the Inspection on November 19, 2003, but our attorney (Sinrich, in this case), advised us that when we terminated him (Haddad) it MUST be for cause.� <strong>This STATEMENT</strong> made on three (3) separate occasions <strong>is FACTUAL.</strong>� Mrs. Mangsen (along with her husband, Kurt) unjustly and without cause stopped my salary in July 2003 with just two (2) days notice. Mrs. Mangsen, with the assistance of Ms. Higham, Nordgren�s accountant, attempted to re-structure my nine (9) year salary and employment package in late September 2003 thereby reducing my salary by approximately 40%. I rejected this proposal, and Mrs. Mangsen immediately terminated my cell phone and dental insurance being paid for by Nordgren�s.�</p>
<p><strong>STATEMENT-</strong> "Was Mr. Haddad terminated by Kurt Mangsen with the assistance of Nordgren Memorial Chapel�s Corporate Counsel (Scott S. Sinrich) on November 19, 2003 within hours of an inspection by John Bresnahan, inspector for the Massachusetts Funeral Board? And also, was Mr. Haddad, an owner, employee, and Class A stockholder in the Nordgren Memorial Chapel Corporation at the time he was terminated without being afforded the opportunity to respond to concerns raised regarding two Nordgren Memorial Chapel Corporation funeral arrangements - one pre-need and one completed funeral file - during the inspection?� <strong>THIS STATEMENT IS FACTUAL.</strong></p>
<p>Within five (5) hours of the completed, (purported to be unannounced) inspection by Inspector Bresnahan, a letter of termination was prepared by Attorney Sinrich. The letter was then delivered to the funeral home for Kurt Mangsen�s signature.� Kurt Mangsen immediately signed the letter of termination. The letter was then presented to Constable William George, who just so happened to be a friend and Masonic brother of mine for many years; who, in turn, served me with the Letter of Termination at my residence upon my return home at approximately 4:30 PM on November 19, 2003. <strong><em>"Do you smell a set up?</em></strong><strong><em> Wait! There�s lots more!</em></strong></p>
<p>Inspector Bresnahan, during his purported unannounced inspection of Nordgren Memorial Chapel on November 19, 2003, asked to review a specific number of Nordgren Memorial Chapel Corporation�s pre-need funeral arrangement files. Although Inspector Bresnahan requested <strong><em>only</em></strong> pre-need funeral files to review, Inspector Bresnahan was given a completed funeral file along with five pre-need funeral files to review. This was not and could not have been a mistake; as completed funeral files were kept in a separate file cabinet and in a separate room from pre-need files at the Nordgren Memorial Chapel Corporation Office.</p>
<p>Inspector Bresnahan surprisingly found that the Cost of Goods and Services Form was missing from the completed funeral file of Mrs. Giannula Bahaviolos - yet all payments had been made for cash disbursements for the funeral of Mrs. Bahaviolos. How could this be? Could it be that Nordgren Memorial Chapel, in the person of Katherine Mangsen, Nordgren Memorial Chapel�s treasurer, was attempting to keep the $860+ that remained after Nordgren Memorial Chapel�s full and complete funeral costs had been paid? Could it be that this Cost of Goods and Services Form was intentionally removed from the completed funeral file and presented to Inspector Bresnahan in order to reflect poorly and focus attention away from Mrs. Mangsen�s actions and directly on me?�</p>
<p>Unaware that any of this with the Bahaviolos Family was happening until after my abrupt and wrongful termination as an employee of Nordgren Memorial Chapel on November 19, 2003, I immediately contacted Katherine Ganias, daughter and executor of Mrs. Bahaviolos�s affairs - only to find out she had received correspondence from Katherine Mangsen stating - "There would be No funds being returned to her from Nordgren Memorial Chapel as a result of an overpayment to Nordgren Memorial Chapel."�</p>
<p>Needless to say, I was shocked beyond belief at the statements and actions of Katherine Mangsen, and advised Mrs. Ganias to contact the Attorney General�s Office of Consumer Affairs in Boston, which Mrs. Ganias did. The Attorney General�s Office of Consumer Affairs suggested the best initial course of action for Mrs. Ganias to recover what was rightfully hers, and which was unjustly being withheld from her by Mrs. Mangsen and Nordgren Memorial Chapel was to file a complaint with the Central Massachusetts Better Business Bureau, which Mrs. Ganias did. After a period of time, Nordgren Memorial Chapel did finally return to Mrs. Ganias the funds due her after the full and complete statement had been paid-in-full.�</p>
<p>Yet through all of this, Inspector Bresnahan and the Massachusetts Funeral Board determined that the missing Cost of Goods and Service Form in the aforementioned circumstances was my fault, and I was to be held accountable for it being missing from the file - even though the file was a Nordgren Memorial Chapel Corporate File, the responsibility, security and safety of which was that of the Nordgren Memorial Chapel Corporation, the file housed on the premises of� Nordgren Memorial Chapel�s Funeral Home, and available to anyone and everyone who worked at the funeral home.�</p>
<p><strong>Statement-</strong>Mr. Bresnahan, inspector/investigator for the Division of Professional Licensure, after finding purported irregularities in two (2) files at Nordgren Memorial Chapel on November 19, 2003 asked for and sampled additional files to determine if there was a pattern to the irregularities he found. <strong>Fiction!</strong></p>
<p>Any trained investigator, finding irregularities when sampling files, would ask for, receive, and sample additional files to determine if there was a pattern to the irregularities found. But not Mr. Bresnahan! He judged the situation as being prevalent. He convinced the Masssachusetts Funeral Board on December 9, 2003 that this was an on-going situation with files prepared by me (Haddad) and he addressed me (Haddad) as a <strong><em>scavenger.</em></strong> Mr. Bresnahan made this comment only after I was viciously attacked by Funeral Board Chairman (John Kazlauskas) - a competitor funeral director in Worcester in my absence and before I was invited into the State Funeral Board Meeting on December 9, 2003. Also Investigator Bresnahan made this statement to all members of the Massachusetts Funeral Board, Massachusetts Funeral Board staff, and the public in attendance at the meeting - yet Investigator Bresnahan had never met me prior to this time and had never interviewed me. And yes, Investigator Bresnahan NEVER made an effort to determine whether or not other files prepared by me or anyone at Nordgren Memorial Chapel were missing pertinent documents. One can only come to the conclusion that in dealing with Investigator Bresnahan, "you are guilty until proven innocent!"� <strong><em>"Isn�t that correct, Mr. Bresnahan?"</em></strong></p>
<p><strong>Statement-</strong>"Did the Massachusetts Funeral Board conspire to take away my ability to practice as a funeral director thereby denying me my constitutional rights to life, liberty, and the pursuit of economic well-being guaranteed to me and every citizen of the United States under the 14<sup>th</sup> Amendment to the U.S. Constitution; while they intentionally delayed the process leading to an Administrative Hearing on "pumped-up charges" that could not be verified as factual and were not verified as factual?� <strong>FACT!</strong></p>
<p>Follow this chronology, if you will.</p>
<p><strong>Informational</strong>: In order for funeral homes in Massachusetts to advertise the names of funeral directors in their organizations, a funeral director must demonstrate that he/she owns a minimum of 10% of the stock in the funeral home. So what do many (if not all) of the funeral home owners do? The funeral home owners assign 10% of Class B stock in their funeral home (stock that has no value and stock for which the individual funeral director paid absolutely nothing for) to the funeral director. This is the process followed to circumvent the intent of the rules and regulations of the Commonwealth of Massachusetts for ownership in a funeral home in order to advertise the funeral director�s name as an owner and director at the funeral home.</p>
<p>During the Meeting of the Massachusetts Funeral Board on December 9, 2003 - the same meeting wherein I was personally and professionally attacked by State Board Chairman (Kazlauskas) and Investigator (Bresnahan) in the presence of many and yet in my absence - Chairman Kazlauskas and other Funeral Board Members discussed the issue of my ownership of stock in Nordgren Memorial Chapel in the presence of the Mangsen�s and their attorney (Sinrich). It was duly noted that I, as a funeral director at Nordgrens and an owner of the funeral home, owned 3% of the Class A stock in the funeral home and 10% of the Class B (no value - paperwork transaction only) stock in the funeral home.�</p>
<p><strong>Now follow what happens next and what actions were taken by the Massachusetts Funeral Board - documents to support same (Yes, that�s right) in my possession!</strong></p>
<p>On May 1,2004, I received correspondence from some unknown source at the Massachusetts Funeral Board (letter not addressed specifically to me and letter that had no signature) dated April 29, 2004, but the envelope was correctly addressed to me. The letter stated, <em>"It has come to our attention that you no longer hold ownership interest in a funeral home. Please complete the enclosed application."</em>� My immediate response to the Massachusetts Funeral Board dated May 1, 2004 was <strong><em>"I, Philip G. Haddad, Jr., do own an interest in a funeral home in the Commonwealth of Massachusetts. For the record and your information, I am an owner of Nordgren Memorial Chapel, 300 Lincoln Street, Worcester, MA. Please note same for your records, and provide me with the name and address of the source of the incorrect information for my records. I shall, in turn, contact him/her/them and clarify the issue to everyone�s satisfaction."</em></strong></p>
<p>What happens next in the chronology of corruption that permeated the Massachusetts Funeral Board, its staff, and staff at the Division of Professional Licensure will "turn your stomach"; if not confirm what you already know - that it takes only a few "bad apples" to corrupt and compromise the integrity of an otherwise just and honorable system of government. More to come in the next update!</p>
<p>As I conclude this update, I am reminded, and I share this with those referenced herein and for whom I have a genuine concern for their eternal well-being, of several verses in the Gospel of Luke, Chapter 3.�</p>
<p>�� � � <strong><em>"Produce fruit in keeping with repentance. The axe is already at the root of the trees, and every tree that does not produce good fruit will be cut down and thrown into the fire. Don�t extort money and don�t accuse people falsely."</em></strong></p>
<p>If I did not know it before, I certainly do now that Luke, in sharing the Word of God, was in fact speaking directly to those listed in this Update and throughout this web site dating back to its inception in March 2005.�</p>
