<p>There is so much additional information concerning the conspiracy and corruption that has encompassed individuals and state government appointed officials to be shared with you that I have decided to provide more frequent updates in order to present your comments and questions and those questions that have surfaced in recent times. I invite those referenced herein and whose statements and actions have been presented in this Web site in verifiable detail and from the Public Record to forward any statements they wish to make in an attempt to justify their statements and actions. I ask that they be forwarded to me in pdf format, so that no claim can be made now or ever that their statements (on the record) are anything other than that which they state them to be.</p>
<p>This <u>e-mail</u> was received following the last Update on November 9, 2009. <em>"Mr. Haddad, I was recently told that during the Administrative Hearing the prosecution attorney for the Division of Professional Licensure (James Read) presented you with two affidavits - one from Kurt Mangsen (principal owner of Nordgren Memorial Chapel) and the other from Ronald E. Johnson (a funeral director at Nordgren�s) stating that you interfered at the burial of a Mrs. Jeas, is this correct?�</em> <u>My response</u> � "That is correct; but there is a great deal more to it. First off, Atty. Read time and time again made statements based upon incorrect, inaccurate, and distorted information provided to him by the Mangsen�s and their attorney (Sinrich) � some of which I have presented herein and much yet to be presented in open court, when I am given my day in court before a jury. Attorney Read handed me two affidavits (from Mangsen and Johnson) � both of which I had not seen or heard of up to this point. Each of the affidavits was clearly identified as exhibits in the wrongful termination civil proceedings I initiated in Worcester Superior Court � each affidavit having nothing to do with the Administrative Proceedings on-going in the Administrative Process. When I pointed this fact out to Atty. Read (and his assistant, Atty. Leslie Alexander) that they were presenting affidavits I had not seen and that they were outside the Administrative Proceedings that they were aggressively prosecuting, panic came over their faces (true panic of incompetence). I demanded copies of the affidavits which had been faxed to Investigator Bresnahan (DPL) and delivered to Atty. Read � affidavits that were of a very poor quality. Reluctantly, Atty. Read had to produce copies of the affidavits for me, which I immediately forwarded to the executor of the Estate of Mrs. Jeas for his information. When given my day in court, William Jeas, executor of the estate of Mrs. Jeas, will be called to testify to the inaccurate, distorted, and outright lies clearly stated and signed by the hands of both Mr. Mangsen and Mr. Johnson. In addition, the Very Rev. Dean Paleologos, pastor of St. Spyridon Greek Orthodox Cathedral in Worcester will also be called to testify to the facts as they are in this matter.� </p>
<p>I also received a phone call from a gentleman, who asked not to be identified, but relayed the following statements (information) to me. <em>"Mr. Haddad, I see that you appeared before Judge Peter Agnes at the Worcester Court. He is a good man and I have known him for many years. His father, Peter, was a great influence on his son, Peter, as was his mom, Rita. Peter (senior) was a proud State trooper (L. Colonel, I believe I was told) and was a founder of the Massachusetts Special Investigation Unit serving as its first director. Peter (senior) hated corruption and fraud in government, and committed his whole life to exposing fraud and corruption as an honorable Massachusetts State Trooper. Peter (senior) was an example to his son, Peter, Jr. as he became an attorney and Judge for the Commonwealth of Massachusetts. Mr. Haddad, if Judge Agnes rendered a bad decision, I�m confident it was because he had improper information upon which to act. Rest assured, Judge Agnes will make sure if he was misled that "heads will roll.� I will keep looking for your updates, and don�t ever let lies, corruption, or false statements contrary to the truth wear you down.�</em> <u>My response to this gentleman,</u> "Sir, I am deeply appreciative of the call and information. Judge Agnes asked me to allow him to hear my appeal of the fraudulent and misguided decision of the State Funeral Board as well as the case I had against Nordgren Memorial Chapel for their unjust termination of my employment agreement. I believed Judge Agnes, after hearing and seeing the veritable facts to include the audio tape of the conspiracy and corruption within the Mass. Funeral Board, would clearly see that I was denied "due process� in the Administrative Proceedings as well as being denied access to "witnesses for my defense� during the process. For you see, witnesses from outside the Commonwealth of Massachusetts apparently are not required to honor an Administrative subpoena; and Peter Klamkin and Columbian Life Insurance Company refused to appear and testify as witnesses to the proceedings. The prosecution attorneys, knowing the testimony of Klamkin and Columbian Life Insurance Company, would directly implicate the Funeral Board Chairman (Kazlauskas) and it�s Investigator (Bresnahan) along with the Mangsen�s and their attorney (Sinrich) in the conspiracy and corruption did everything in their power to keep these entities from being questioned. Now with Judge Agnes also denying me my guaranteed "due process;� he denies the court access to the truth and facts absent from the Administrative Proceedings and wrongful termination proceedings.�</p>
<p>At the conclusion of this update, I will relay another e-mail I received, which did not necessarily shock me, but which indicates a person�s true colors ultimately will shine through darkness.</p>
<p>In the last update, I was asked to share with a small group the Summary Civil Docket Case, as everyone did not have a copy to review. Copies were made and distributed.</p>
<p><em>"Mr. Haddad, you stated previously that on April 9, 2009 you filed an appeal of the State Funeral Board�s decision with the Worcester Superior and paid $275.00 in order to file the appeal, is this correct?�</em> <u>My response</u> � "Yes, that is correct!�</p>
<p><em>"And Mr. Haddad, did you also state that Assistant Attorney General, Maryann Reynolds-Martin, contacted you and stated you filed the appeal in the wrong court, and that she would be filing a dismissal of your appeal if you did not immediately file the complaint in the Massachusetts Supreme Judicial Court?�</em> <u>My response</u> � "Yes, that is correct!�</p>
<p><em>"Mr. Haddad, when you filed the appeal with the Worcester Superior Court, did it include the final decision of the Massachusetts State Funeral Board along with the response you submitted to the Administrative Hearing Counsel (Anne Colleton) clearly outlining the inconsistencies in the final decision which were in direct conflict with the testimony heard during the Administrative Proceedings?�</em> <u>My response</u> � "Yes, I did!�</p>
<p><em>"Mr. Haddad, when Assistant Attorney General Reynolds-Martin submitted the Administrative Proceedings Record to the Justice at the Worcester Superior Court, was the record complete?�</em> <u>My response</u> � "No, there were many documents, statements, and records not included and deliberately missing in the transmission provided by Assistant Attorney General Reynolds-Martin.�</p>
<p><em>"What did you do at this point?�</em> <u>My response</u> � "On December 17, 2007 I submitted two (2) separate motions to the Justice at the Worcester Superior Court. The first was for production of documents that were missing from the Administrative Proceedings Record that I knew existed (and which would have had to exist) in order for the decisions to have been made by the State Funeral Board. My second motion was to enter into the record documents missing from the Administrative Proceedings Record that I had in my possession � to include the audio tape of the conspiracy between the then Chairman of the Massachusetts State Funeral Board (Kazlauskas), the State Board investigator (Bresnahan) and the Mangsen�s and their attorney (Sinrich). I was denied the opportunity to enter the audio tape of the conspiracy into the record by the Administrative Hearings Counsel (Colleton), for to do so would have destroyed any semblance of a legitimate case against me, and would have proven the conspiracy clearly outlined on the audio tape of the December 9, 2003 meeting of the Massachusetts Funeral Board.�</p>
<p><em>"So Mr. Haddad, what was the result?�</em> <u>My response</u> � The Judge, (James R. Lemire) denied both of the motions with no explanation other than "denied essentially for the reasons stated in the Assistant Attorney General�s Opposition to the motions�.</p>
<p><em>"That�s it! No further explanation?�</em> <u>My response</u> � "That was it!�</p>
<p><em>"Mr. Haddad, did you appeal Justice Lemire�s decisions to deny you access to the full Administrative Proceedings Record and to input missing documents, statements, and records in your possession and deliberately missing from the Administrative Proceedings Record?�</em> <u>My response</u> � "Absolutely!�</p>
<p><em>"I hesitate to ask, but what happened with your appeal of Judge Lemire�s decisions?�</em> <u>My response</u> � "On April 11, 2008, I submitted two motions to the Worcester Superior Court for reconsideration of the denial of the aforementioned decisions of Justice Lemire. Justice Lemire once again denied both motions for reconsideration of his original decisions, with the statement � "The Plaintiff (Haddad) has presented no new evidence showing that the Administrative Record is incomplete!�</p>
<p><em>"Mr. Haddad, I have read your original motions (as has others here today). You clearly demonstrated the Administrative Proceedings Record was incomplete. You site records, (for example, records of any investigation by Investigator Bresnahan) that would have had to exist, but were deliberately missing. You further had documents, statements, and copies of records in your possession that were deliberately missing from the Administrative Proceedings Record. What more documentation would an impartial judge need to decide that the record was deficient and documents requested and offered be included in the full and complete Administrative Proceedings Record?�</em> <u>My response</u> � "I didn�t expect much of a fair shake from the Massachusetts Funeral Board and the Division of Professional Licensure, as they had to protect and cover up for the conspiracy that permeated the entire Massachusetts Funeral Board, especially its Board chairperson (Kazlauskas) and its investigator (Bresnahan). The audio tape speaks volumes to this. The corruption at this level is beyond belief, and I will soon share this for all to see for themselves � but not until I have exhausted all options available to me.�</p>
<p>"As for the judiciary (and my experiences with Judge Lemire up to this point), I was and am deeply disappointed. I am a champion of one�s civil and constitutional rights and my civil and constitutional rights were truly being violated by a Justice of the Worcester Superior Court.�</p>
<p><em>"Mr. Haddad, do I understand that Judge Lemire was hearing the appeal of the Massachusetts Funeral Board Decision and another Judge (Agnes) was hearing the Civil (wrongful termination) case?�</em> <u>My response</u> - "Yes, that is correct!�</p>
<p><em>"And is it my understanding that Justice Agnes asked you if you would agree to allow him to hear both cases, as he was familiar to some degree with both issues (and cases)?�</em> <u>My response</u> � "Yes, that is correct. Justice Agnes heard appeals over the years by the Mangsen�s and their attorney (Sinrich) as they attempted to close down this web site � www.justiceatwhatprice.com on several occasions. In each instance, Justice Agnes denied their motion to do so, for it would conflict with my First Amendment Rights to free speech. Judge Agnes cautioned me that the information presented on the web site needed to be public information and no information from discovery and not legitimately made public should appear. I have continued to heed this advice and directive. As such and with a belief that an impartial and a fair system of justice would prevail with Justice Agnes in charge, I willing agreed to allow both cases to be heard by Justice Agnes.�</p>
<p>In the next update, I will present questions posed to me concerning the process followed in the Worcester Superior Court under the direction of Justice Peter Agnes up to the present time. As stated above, begin to look for more frequent updates beginning soon after the 1st of the New Year.</p>
<p>As promised earlier in this update, the following is a call I received a few weeks ago. At first I did not know whom the gentleman was referring to, but it became clear after several moments passed. </p>
<p><em><strong>"Haddad, you don�t know me, but I know you. Now that Rainey is gone and Lou has gone now for sometime, I want you to know that what happened to you was not by mistake. Kevin has wanted your business since the day you joined Caswell-King. He has made that clear to all of us. He felt your business was rightfully his and that when you got in the business and began taking what he knew was originally his business, he never got over it. When you said in this publication that Kevin, in front of the Priest at your church that he wanted to buy the business you had at Nordgren�s � that�s Kevin all the way. I�ve known him from a tike. He�s arrogant. He can be vicious. And he doesn�t care who is in his way. If he wants you out, one way or another, he�ll get you out. I don�t know if he paid anyone off in your case, but it wouldn�t be the first time. Good Luck to you and Happy Thanksgiving.�</strong></em></p>
<p>As I stated above, I had no idea who Rainey and Lou were. I did not know Mrs. Mercadante�s first name, and I never heard Louie Mercadante called Lou. The gentleman appears to know a lot about the history at Mercadante�s, and as a courtesy, I let him speak. I put no credence one way or another in what was said by this man and do not hold Mr. Mercadante personally accountable for his numerous indiscretions. I know and so too does Mr. Mercadante what actually transpired and that he was less than honest when he testified as a witness <u>subpoenaed by me</u> to testify at the Administrative Hearing (that�s right - subpoenaed by me, because the Division of Professional Licensure; although they based much of their complaints against me based upon the word of Mr. Mercadante, words with no basis in fact).</p>
<p>We have now entered the season of Advent when we prepare for the birth of Christ � the same Christ that has given up His Life so that you and I <em>might</em> someday reside in eternity in His Heavenly Kingdom. What Christ gave us was <strong>Hope</strong> � Hope that did not exist until he took upon Himself the sins of the world and gave His Life accordingly.</p>
<p>Your Hope and mine is in <strong>"Truth�</strong> � for <em>"What we don�t confess, we do possess!�</em> If "Truth� doesn�t live in you; you are weak, sick, and condemned to eternal death.</p>
<p>What better time as we celebrate the Birth of our Savior, to come clean with the Good Lord, to right your wrongs, and to take on "Truth� as you commit to Christ. Do this for yourself, and then and only then will "Hope Spring Eternal.�</p>
