It was my original intent to present Part 3. Attorney Scott S. Sinrich with questions, comments, and observations posed to me by folks alluded to in early discussions concerning the statements and actions of Attorney Scott S. Sinrich, Corporate Counsel for Nordgren Memorial Chapel and Kurt and Katherine Mangsen, and his assistant counsel, Jessica Godfrey (Law Firm of Phillips, Silver, Talman, Aframe, & Sinrich, P.C. in Worcester, Massachusetts), with the focus being on providing you with the full documented record of a complaint I filed against Atty. Scott S. Sinrich with the Board of Bar Overseers (BBO), Commonwealth of Massachusetts. Included in the presentation will be all exhibits, correspondences, discussions with the investigative attorney for the BBO, his responses thereto, decisions rendered, and justifications (or lack thereof) for actions taken. You will want to take note of the "injustice in action" by the BBO as they too bury their political and administrative heads in the sand. It's is representative of corruptive government you see every day in the Commonwealth of Massachusetts. The veritable facts will be presented in the next update.

As you know, I have shared and continue to share not only with you, but with the general populous statements, actions, allegations, and accusations from individuals to include appointed public civil servants that have and continue to compromise their personal and professional integrity (if in fact they had any integrity to begin with) - all information shared with you coming from the Public Record. I thank you for your comments, observations, and suggestions that include "the people you reference turn my stomach" / "the Mangsen's and their attorneys should be made to pay for their lies and false statements including all costs incurred by the Commonwealth of Massachusetts" / "the Massachusetts State Police need to investigate the State Funeral Board, and Division of Professional Licensure resulting in even more people being put on unemployment roles, and these people deserve to be fired and lose their 'pricy' pensions".

Although there are many more statements, observations, and suggestions which I will share with you in future updates, there is one other I wish to present. "Haddad, are you so naive to think you can take on the depth of corruption that is everywhere in government in Massachusetts? It's not a matter of the facts counting; it's pure numbers. These deceptive people (I'm being generous with this depiction) have to justify their positions and existence by numbers of convictions for any reason - impervious to the truth and facts. Haddad, wise up! It's a game and you're the target. You can't beat them when it's their game, their rules, and they are the judge, jury, and executioner!"

I am reminded of the statement by Erik Heels, a prominent and highly respected attorney in Massachusetts "Yes, you can fight city hall!" As you have noted if you have followed this web site, I have turned to, listened to, referenced, and have found comfort in my spiritual journey - with wisdom gained during the past 64 years in dealing with the corruption and evil individuals referenced throughout in these updates. As the title of this updates suggests, it is time to identify, expose, hold accountable, and take down the "evil giants" that have invaded your life. One need only be reminded of the epic "David & Goliath". More soon.

Since last we communicated, I revisited with folks in San Diego, spending just over 7 days in beautiful S.D.; a significant amount of time spent fielding questions and recording comments and suggestions concerning the subject matter in this web site. Suffice it to say, each and every response provided by me was supported by actual documents in my possession from the Public Record.

Continuing on with the question from the last update

"Mr. Haddad, I noticed that Attorney Jessica Godfrey (God-Free), assistant to Atty. Sinrich and a member of the Law Firm of Phillips, Silver, Talman, Aframe, & Sinrich, PC was in attendance at each of the seven (7) days of Administrative Hearings. Did this surprise you and what if any, role did she play during these proceedings?" My response - "Quite honestly, at the time I did not know the depth of involvement in the proceedings by Attorneys Sinrich & Godfrey. I therefore was surprised that Nordgren Memorial Chapel and the Mangsens would spend corporation monies to have Attorney Jessica Godfrey travel to Boston, sit quietly through seven days of testimony; wherein Attorney Godfrey could not participate in the process (or so I thought). While performing an "in situ" inspection and finding many documents withheld from the Administrative Hearings; documents that clearly showed Attorneys Sinrich and Godfrey were actively involved (if not completely involved) in the day to day proceedings with prosecuting attorneys for the Division of Professional Licensure; it became abundantly clear Attorney Godfrey was in attendance, not so much to protect the interests of the Mangsens, but to cover her (Godfreys) backside and that of her boss, Atty. Sinrich and the lies and distortions they made publicly (and I presume privately) to Investigator Bresnahan and the Prosecuting Attorneys. I use the phrase "presume", because suspiciously all of Investigator Bresnahans e-mails (correspondences) to and from the Mangsens (Katherine) were deleted and therefore unavailable to me according to Legal Counsel for the Funeral Board, Alex Borre. This was brought to the attention of the Public Records Administrator, Office of the Secretary of State, Commonwealth of Massachusetts, and well documented."

"Mr. Haddad, here in California and elsewhere throughout the country, our constitution calls for the "presumption of innocence!" Yet when I listen to the audio tape of the December 9, 2003 Meeting of the Funeral Board, without a complaint filed, without any opportunity for you to respond, the Chairperson of the Funeral Board (who just so happened to be a competitor funeral director in your town), along with an investigator (Bresnahan) who had never met you (let alone ever interviewed you) condemned and slandered you in the presence of the full Funeral Board with the Chairperson calling you a "carpetbagger" and "snake" and the investigator calling you a "scavenger". It is blatantly obvious you were targeted by the Chairperson and investigator for the Funeral Board and supported by lies and mistruths by the Mangsens and their attorney. Why didnt your attorneys (Angelini and Flynn), when they obtained the audio tape of the conspiracy and found this out confront the Funeral Board as your civil and constitutional rights were obviously being violated?" My response - " I engaged the services of Atty. Michael Angelini at the suggestion of my accountants at the time. Soon after assuring me he would not allow anyone to take my license to practice as a funeral director in the Commonwealth of Massachusetts from me and directing me to find another business association with which to conduct funerals for my clientele (business following), Atty. Angelini turned over the day-to-day dealings in this matter to Atty. Flynn, a young attorney who had recently joined the law firm of Bowditch & Dewey. Atty. Angelini assured me he would be apprised of and oversee happenings on a daily basis to assure my rights and privileges were protected. After Atty. Flynn and Angelini received the audio tape of the conspiracy, they intentionally withheld it from me for a period of time stating - "I would not be able to listen to it under normal circumstances." I was asked permission to allow the law firm to have the audio tape of the conspiracy transcribed by a court reporter. I approved this request, still not knowing or having listened to the full impact of the conversations of members of the Funeral Board at the December 9, 2003 Meeting. With this being said, to this very day I cannot fathom why Atty. Angelini (and Flynn) didnt confront "head on" the Funeral Board and Division of Professional Licensure and demand a dismissal or otherwise file suit against the Funeral Board and Division of Professional Licensure on any of a whole host of legal grounds for what was clearly a planned conspiracy leading to violations of my civil and constitutional rights."

"Mr. Haddad, I read with great interest the "tentative decision" of the State Funeral Board as prepared by the Administrative Hearings Counsel (Anne Colleton). I, then read your response to the tentative decision pointing out blatant inconsistencies in the tentative decision verse testimony from witnesses for both the prosecution and defense. Yet, the final decision of the Funeral Board as prepared by the Administrative Hearings Counsel (Colleton) did not make the corrections as noted issuing a decision that was based upon contrary statements to veritable facts as you so noted. It is apparent Administrative Hearings Counsel (Colleton) and the Funeral Board did not read or acknowledge your response to the tentative decision and issued a flawed decision. Am I missing something here?" My response - "Not at all. Administrative Hearings Counsel (Colleton) could not be bothered by the facts, was appalled when my opening statement during my testimony purported that I intended to prove a conspiracy, corruption, incompetence, and cover up by the State Funeral Board and Division of Professional Licensure. I wish only you could have seen the look on her (Colletons) face when I made the statement and proceeded to lay out the chronology of the conspiracy right up to the present moment. After a full day of my testimony, Administrative Hearings Counsel (Colleton) stated that she was not convinced that I was addressing the matters at hand and that this was my opportunity to set the record straight. Administrative Hearings Counsel (Colleton) just could not be bothered by veritable facts, and relied solely on lies, distortions, and baseless accusations made by corrupt parties within the Funeral Board and the Division of Professional Licensure."

The following questions and my response thereto were generated during the week of October 7-14, 2009 while I was in San Diego.

"Mr. Haddad, you filed an appeal in Worcester Superior Court of the Final Decision of the State Board, is this correct?" My response "Yes, I had a finite number of days with which to do this, and filed the appeal in Worcester Superior Court paying a fee to the court system in order to file the complaint."

"Mr. Haddad, what happened after that?" My response "Soon thereafter, I received a phone call late one afternoon from Assistant Attorney General Reynolds-Martin, stating that she represented the State Funeral Board in the appellate process and that I filed my appeal of the State Funeral Boards Final Decision in the wrong court. According to Assistant Attorney General Reynolds-Martin, I should have filed the appeal in the Massachusetts Supreme Judicial Court; even though according to the appellate directions included in the State Funeral Boards Final Decision, my appellate rights were in the Worcester Superior Court. Assistant Attorney General Reynolds-Martin stated that unless I filed my appeal of the State Funeral Boards Final Decision immediately in the proper court (according to her), she would move for a dismissal of the appeal within 72 hours. I stated I was about to depart on travel, and would not be able to file an appeal in the Massachusetts Supreme Judicial Court until my return. Assistant Attorney General Reynolds-Martin stated, "thats not my problem!" I immediately cancelled my travel plans and flight, and attempted to contact the Massachusetts Supreme Judicial Court, but they had departed for the day. That very evening I prepared another appeal (this time to the Massachusetts Supreme Judicial Court) and contacted the court in Boston the very next day requesting clarification and directions to drive to Boston to file the appeal with the Massachusetts Supreme Judicial Court (according to Assistant Attorney General Reynolds-Martin). I was informed by the Massachusetts Supreme Judicial Court that my original appeal was filed properly with the Worcester Superior Court. I explained in great detail my conversation with Assistant Attorney General Reynolds-Martin; to which the Massachusetts Supreme Judicial Court stated, "Assistant Attorney General Reynolds-Martin is wrong!" I was assured that in the event there was any problem in the future, the Massachusetts Supreme Judicial Court would stand behind the actions I had taken, and to feel free to reschedule my travel. This I did after notifying Assistant Attorney General Reynolds-Martin of the actions I had taken and the information I received from the Massachusetts Supreme Judicial Court. I contacted the airline and was charged an additional $150 to reschedule my airline ticket as a result of the misinformation provided to me by Assistant Attorney General Reynolds-Martin."

"So you mean to tell us that the Assistant Attorney General representing the Massachusetts Funeral Board was unaware of which court handled your appeal of the State Funeral Boards Final Decision? Only in Massachusetts!" My response "It has been my experience in dealing with the Commonwealth of Massachusetts that judgments are made and actions taken without veritable facts, without researching the accuracy of their statements and actions, with preconceived notions driving their illegitimate actions."

Discussions then centered on the Appellate Process and the chronology of events as they pertained to the appeal of the final decision of the State Funeral Board before the Worcester Superior Court, specifically Justice James Lemire, Justice Peter Agnes, Justice Richard Tucker, and finally Justice John McCann. In addition to the public record documents, I brought with me the official docket of my cases before the Worcester Superior Court. Questions and reactions thereto will be presented in subsequent updates.

After spending time over an early morning breakfast on Sunday, October 11, 2009 in San Diego discussing issues addressed above, I was asked to pray for each of those wayward souls that have taken sin and evil as their focus and Satan as their master and to pray for them. I was asked to list them by name and did so accordingly. The names stated openly were Katherine and Kurt Mangsen, Gail Wiles, Ronald Johnson, John Kazlauskas (deceased), John Bresnahan, James Read, Leslie Alexander, Tracy Mitchell, David Pickering, Helen Perveri, Kim Scully, Anne Colleton, Kathe Mullally, George Weber, Scott S. Sinrich, Jessica Godfrey, Edward Mazur, Kathy Cartmell- Siricco, Ms. Reynolds-Martin, Justices of the Worcester Superior Court (Lemire, Agnes, Tucker, & McCann) and members of the State Funeral Board in 2003 and 2007 (not herein listed). The leader of the prayer asked God not to forgive those listed above; but to open their eyes to Christ, to encourage them to take on Christ, and to repent before the judgment Christ has already bestowed upon each of them is implemented now and forever.

The prayer was very powerful and compelling. The message sincere and genuine. Together we immediately proceeded to Shadow Mountain Community Church, the home base of the Turning Point Ministries and Dr. David Jeremiah; at which time we asked for our prayer moments earlier to rise and be heard by the Lord.

Dr. Jeremiah stated that neither of us alone can withstand the strength and power of Satan in his world of sin and evil here on earth. It is only by taking on Christ, bringing Christ into your heart and daily lives in everything you do, that you can defeat Satan in your life. I prayed then and do so now for those listed above, and those not referenced, that allowed evil to invade their space and embrace their existence.

You do not find Christ! Christ finds you!

HE is knocking at your door. Are you strong enough to open the door and allow HIM into your life? Hopefully the answer is "Yes!" In the meantime, I shall continue to pray for each of you.

Blessings,
Philip G. Haddad, Jr.
