<p>I have learned so much in the past 5 + years about people consumed by evil, and I have struggled at times to understand the motivation for their actions and false statements. What is truly amazing is that the answers were clearly before my eyes all the time and plainly visible for all to see and read for themselves in the Book of Life entitled - "The Bible"!</p>
<p><u><strong>The subject</strong></u> to be addressed in this update are questions that were asked of me pertaining to David Pickering, witness for the prosecution and Division of Professional Licensure (also owner of Rand Harper Pickering Funeral Home and Britton Funeral Home, both in Westborough, MA).</p>
<p><em>"Mr. Haddad, do you mind if I call you Phil?" </em></p>
<p><u><strong>My Response</strong></u>- "Absolutely not, please do!"</p>
<p><em>"I have many questions concerning the gentleman, David Pickering; how you came to know him; your relationship with him concerning Mr. Bayrouty; and how Mr. Pickering became embroiled in the matters concerning you, the principals at Nordgren Funeral Home, and the Funeral Board. First things first- When did you first meet or come to know Mr. Pickering?" </em></p>
<p><u><strong>My Response</strong></u>- "A gentleman named Ken Young was the Resident Coordinator for an assisted residence facility called the Willows in Westborough, MA. Numerous residents at the Willows asked Mr. Young for assistance in having landscaping services provided at their departed loved one's cemetery plot, and since Ken Young knew me (he was my Commanding Officer in the U.S. Army Medical Corp) he was aware of the services Westland provided and recommended families speak with me personally concerning their wishes. During a lunch meeting I had with a client at the Willows and her family (the family having just days earlier made funeral arrangements with Mr. Pickering), it was suggested to me by the family and reaffirmed by Mr. Young as well that Mr. Pickering should be aware of the services provided by Westland. As a result of their suggestions, I contacted Mr. Pickering (whom I had not met or known prior to this time) and requested an appointment. Mr. Pickering and I met at his funeral home i
Westborough in the late 1990's at which time I left brochures with him that explained the landscaping services provided by Westland."</p>
<p><em>"When was your next encounter with Mr. Pickering?" </em></p>
<p><u><strong>My Response</strong></u>- "the Spring of 2004!"</p>
<p><em>"Is it safe to say that you did not have any contact with Mr. Pickering for 5-7 years after you visited him in the late 1990's?"</em></p>
<p><u><strong>My Response</strong></u>- "Yes, that is correct!"</p>
<p><em>So during this 5-7 year period, Mr. Pickering did not refer a single family to you for landscaping services for any cemetery plot, is this correct?" </em></p>
<p><u><strong>My Response</strong></u>- "Yes, that is correct!"</p>
<p><em>"Who is the Bayrouty Family, how did you come to know them, and how did they come to utilize the services of Mr. Pickering and the Rand Harper Pickering Funeral Home in Westborough?"</em></p>
<p><u><strong>My Response</strong></u>- "I had known the Bayrouty family for most of my life, but comfortably for more than 50 years. I grew up living near the family. We attended the same church, and served on numerous committees, and the Bayrouty family was family to me. So close were we that I asked the Bayrouty Family to be the benefactor and to donate funds for the entryway of the non-profit Holy Trinity Eastern Orthodox Nursing & Rehabilitation Center of which I was the president at the time in memory of the wife and mother that had passed a few years earlier. Suffice it to say, the Bayrouty Family donated the funds for the entryway. Additionally, I was the funeral director for funerals of their mother, father, and brother - funerals that I conducted while at Caswell-King Funeral Home and the family followed me to Nordgren Memorial Chapel when I joined Nordgren's in 1994."</p>
<p><em>"Phil, but how did David Pickering come into the picture?"</em></p>
<p><u><strong>My Response</strong></u>- "I'm getting to this! George Bayrouty, the eldest son and executor for the entire family and who lived in Westborough, contacted me in the spring of 2004 indicating his wife was terminally ill; and since I was no longer associated with a funeral home, what did I know about the two (2) funeral homes in his home town of Westborough. I had only met David Pickering several years earlier and had no experience with him as a funeral director. I did not know the director of the other funeral home in Westborough (Britton-Summers Funeral Home). So I turned to Ken Young who I knew was a trusted authority and one whose reputation for doing only that which was best for the families he served for so many years at the Willows in Westborough for advice and his experience in these matters. Ken Young strongly endorsed Mr. Pickering as a gentleman and an excellent funeral director. I relayed this information to Mr. Bayrouty".</p>
<p><em>"What was Mr. Bayrouty's reaction to this information?"</em></p>
<p><u><strong>My Response</strong></u>- "Mr. Bayrouty indicated he would use Mr. Pickering and his funeral home for services when his wife was to pass. I suggested he speak with Mr. Pickering in advance, but he was too emotional to consider this. Mr. Bayrouty called me every day, crying most of the time, and providing me with updates on his wife's condition. Mr. Bayrouty kept telling me, "Phil, you're the only one that knows what I am going through." Finally, as the time grew near for his wife to pass, Mr. Bayrouty asked that I contact Mr. Pickering and alert him that when his wife, Louise was to pass he would be using Mr. Pickering's Funeral home for the process to be followed. At Mr. Bayrouty's direction, I alerted Mr. Pickering of Mr. Bayrouty's decision and circumstances."</p>
<p><em>"Did Mr. Bayrouty pre-plan and/or pre-pay for his wife's funeral arrangements with Mr. Pickering (Rand Harper Pickering Funeral Home)?"</em></p>
<p><u><strong>My Response</strong></u>- "No, he did not!"</p>
<p><em>"Did Mr. Bayrouty pre-plan and/or pre-pay for his wife's funeral arrangements with Nordgren Memorial Chapel during your tenure at Nordgren Memorial Chapel or anytime thereafter?"</em></p>
<p><u><strong>My Response</strong></u>- "No, he did not!"</p>
<p><em>"Did Mr. Bayrouty pre-plan and/or pre-pay for his wife's funeral arrangements with any funeral director prior to his wife's death in June 2004?"</em></p>
<p><u><strong>My Response</strong></u>- "No, he did not!"</p>
<p><em>"Phil, did I not read in the opening statement of the prosecution attorney, Leslie Alexander, (Division of Professional Licensure), that the State Board accused you of taking the pre-need funeral arrangements of Louise Bayrouty from Nordgren Memorial Chapel in Worcester to Rand Harper Pickering Funeral Home in Westborough?"</em></p>
<p><u><strong>My Response</strong></u>- "Yes, you did. Attorney Alexander and senior prosecuting attorney, James Read, time and time again made statements that were not supported by the facts, were disproved in testimony, but fell on deaf ears when it came to the Administrative Hearings Counsel Colleton, who could not be bothered by getting the facts straight. Not only did I point out the fact that the funeral arrangements for Mrs. Bayrouty were not pre-need, but At-Need; but Mr. Pickering also stated that Mrs. Bayrouty's funeral arrangements were not pre-need during his testimony during the Administrative Proceedings. The prosecution was assisted in their preparation by Nordgren Memorial Chapel's attorneys (Sinrich & Godfrey) and relied heavily on what was presented to them by Nordgren's legal counsels and apparently the investigator and prosecution chose to accept information presented without verification - which was the essence of the case throughout." (There are many more shocking instances that will be presented when I address questions presented to me concerning Nordgren Memorial Chapel's legal Counsel, Scott S. Sinrich).</p>
<p><em>"So it is clear, Atty. Alexander made a fatal error in her opening remarks concerning the arrangements for Mrs. Bayrouty. When you contacted Mr. Pickering at the bequest of Mr. Bayrouty, what was the conversation?" </em></p>
<p><u><strong>My Response</strong></u>- "David Pickering was very professional, asked numerous questions, and indicated he was not terribly familiar with procedures in the Syrian Orthodox Church. I indicated being as close as I was to the family my whole life and a member of St. George Orthodox Cathedral where the funeral was to be conducted, I would be pleased to assist him in any way possible. Mr. Pickering asked if we could meet and a date and time was set for us to meet."</p>
<p><em>"What happened as a result of your meeting with Mr. Pickering?"</em></p>
<p><u><strong>My Response</strong></u>- "David Pickering asked a whole host of questions concerning traditions and traditional services in the Orthodox Community, and confirmed that I would assist him throughout the process.</p>
<p><em>"Did Mr. Pickering and you discuss compensation for the time and effort you would put in concerning your participation the process of the removal, preparation, visiting hours, and funeral?"</em></p>
<p><u><strong>My Response</strong></u>- "Yes. Mr. Pickering indicated he had spoken with his accountant and that I would be compensated for my time and effort and the professional services I provided to him and in the process of the funeral for Mrs. Bayrouty."</p>
<p>"At the conclusion of Mrs. Bayrouty's funeral, did Mr. Pickering compensate you accordingly?"</p>
<p><u><strong>My Response</strong></u>- "Yes he did. As it was my intent to donate any compensation I was to be paid to the charitable sources identified by the Bayrouty Family, I asked David Pickering to remit monies he was to pay me directly to the charitable sources identified by the Bayrouty Family. David Pickering stated his accountant indicated I was to be compensated for the professional services I provided and that he should make payment to me; after which I could make the charitable payments I wished to make."</p>
<p><em>"So Mr. Pickering paid you for the time, effort, and services you provided to him and the Bayrouty Family, is this correct?"</em></p>
<p><u><strong>My Response</strong></u>- "Yes, David Pickering paid me in two separate checks, each listed (according to his accountant's direction) for <strong>professional services</strong> - although one check included the costs associated with purchases of fax copy paper I made at his request at Staples in Westborough."</p>
<p><em>"Did you discuss with Mr. Pickering the problems you were experiencing with the Mangsen's and Nordgren Memorial Chapel prior to any commitment concerning the Bayrouty Family or any other family?"</em></p>
<p><u><strong>My Response</strong></u>- "Yes, I explained that Mrs. Mangsen had filed three (3) complaints with the Funeral board about me, that I had responded to Investigator Bresnahan with the true and complete facts, and was waiting for a resolution."</p>
<p><em>"Was that explanation satisfactory to Mr. Pickering?"</em></p>
<p><u><strong>My Response</strong></u>- "Not only was it satisfactory to Mr. Pickering, it was O.K. with his accountant."</p>
<p><em>"Phil, clear up the time line here for me. You were issued an "Order to Show Cause" signed by this Cartmell-Siricco woman on June 29, 2004 - even after you responded to Investigator Bresnahan addressing Mrs. Mangsen's accusations, is this correct?"</em></p>
<p><u><strong>My Response</strong></u>- "Yes, that is correct!"</p>
<p><em>"Then how and at what point did Mr. Pickering become embroiled in this matter?"</em></p>
<p><u><strong>My Response</strong></u>- "Apparently, on or about June 30, 2004, at least a day after the "Order to Show Cause" was issued to me; Mr. Pickering received a phone call from a woman who refused to identify herself, asking if Mr. Pickering was handling the services of Mrs. Bayrouty. Mr. Pickering stated he was, and the woman hung up on him. Mr. Pickering called me immediately to convey the circumstances of the call. I indicated I wasn't surprised, that the caller was probably Mrs. Mangsen, and that my concern was only for the Bayrouty Family."</p>
<p><em>"So Phil, tell us how the Division of Professional Licensure and Investigator Bresnahan became involved?"</em></p>
<p><u><strong>My Response</strong></u>- "I was unaware until Mr. Pickering was called as a prosecution witness against me during the Administrative Hearings two (2) years later, that Mr. Pickering panicked after receiving the anonymous phone call from the unidentified woman asking if Rand Harper Pickering Westborough Funeral Home was handling the arrangements of Mrs. Bayrouty. In doing so, Mr. Pickering contacted Investigator Bresnahan asking if he was doing something wrong by serving the Bayrouty Family. The very next morning, Investigator Bresnahan was at Mr. Pickering's funeral home asking questions concerning the Bayrouty Family and my participation in the process. To repeat, Mr. Pickering did not share a word with me that he had contacted the Funeral Board and Mr. Bresnahan and that he had met the very next morning with Mr. Bresnahan. I worked closely with Mr. Pickering in conducting the visitation and funeral for the Bayrouty Family - and not once did Mr. Pickering indicate to me that he had a conversation with Investigator Bresnahan.</p>
<p><em>"So that it is clear, you received an "Order to Show Cause" before Mr. Pickering contacted the Funeral Board; you assisted Mr. Pickering in the conduct of the Funeral for Mrs. Bayrouty; you were compensated for your time, effort, and professional expertise; and Mr. Pickering was called as a prosecution witness against you for complaints that were filed months earlier by Mrs. Mangsen and for which Mr. Pickering had no involvement, is this correct?"</em></p>
<p><u><strong>My Response</strong></u>- "Yes, exactly!"</p>
<p><em>"I see that the Administrative Hearings Counsel (Colleton), in her final decision accused you of sponsoring a golf tournament in the name of Mr. Pickering's funeral home, is this correct?"</em></p>
<p><u><strong>My Response</strong></u>- "At the conclusion of Mrs. Bayrouty's funeral I was driving Very Rev. Fr. Michael Abdelahad back to his Church, when he asked if Mr. Pickering would consider sponsoring one of the golf holes at a cost of $200 (a far cry from sponsoring a golf tournament); since he now had had a funeral in the Cathedral. I responded that I was sure he would, and that I would speak with Mr. Pickering that very afternoon. Fr. Abdelahad indicated he needed to know today, as it was the last day for golf hole sponsorships. I stated I would get back to him (Fr. Abdelahad) that very afternoon."</p>
<p><em>"Did Mr. Pickering agree to sponsor the golf hole for $200?"</em></p>
<p><u><strong>My Response</strong></u>- "Mr. Pickering was unavailable when I called three times that very afternoon. With the Cathedral needing an immediate answer, I left a message with Mr. Pickering that I agreed to sponsoring a golf hole at the cathedral's golf tournament in the name of Rand Harper Pickering Funeral Home at a cost of $200, and that I have paid for it with my own resources.</p>
<p><em>"Did you say the hole signage stated the name of Mr. Pickering's funeral home or your personal name or both?"</em></p>
<p><u><strong>My Response</strong></u>- "The listing at the golf hole said, "Rand Harper Pickering Funeral Home of Westborough."</p>
<p><em>"Mr. Pickering just had the funeral of Mrs. Bayrouty. The family paid full service, I suspect. Mr. Pickering did not pay for the advertisement of a golf hole sponsor. You attempted to discuss this with him on numerous instances before committing to personally paying for the advertisement, and the Administrative Hearings Counsel, in her final decision, stated that you sponsored a Golf Tournament without the knowledge of Mr. Pickering - accusations that did not appear anywhere in the original complaints for which the Order to Show Cause was issued, is this correct?"</em></p>
<p><u><strong>My Response</strong></u>- "Exactly!"</p>
<p><em>"Mr. Haddad, there are some "pretty bad apples" in key positions at the Massachusetts Division of Professional Licensure! I'm reminded of what transpired in the Garden of Eden. Eve was enticed to bite into a forbidden apple, and suffered the wrath of God thereafter. I suspect there are a number of folks, who, as a result of the injustice afforded you, will if not already suffer the wrath of God's judgment."</em></p>
<p><u><strong>I offered no response to this statement!</strong></u></p>
<p><em>"Tell us about the issue with Karen Rossi?"</em></p>
<p><u><strong>My Response</strong></u>- "I had known Karen Rossi and her family for more than 30 years. I conducted funerals for the family while at Caswell-King Funeral Home, and again while at Nordgren Memorial Chapel. Karen was diagnosed with breast cancer several years earlier and battled the disease like the trooper she was. She would call me every month or so to inform me of her progress. As the disease worsened, she would call me bi-weekly and then weekly, asking that I visit her at her residence in Marlborough whenever I had the time. Each time we met, she would broach the issue of her funeral and what she wanted to have occur when she was to pass. Karen knew I was no longer at Nordgren's and was aware of the circumstances, but her husband, Matt was unaware that I no longer was employed as a funeral director at Nordgren's. I had told Karen I agreed to assist David Pickering (a Westborough Funeral director the next town over from Marlborough) with a funeral for a woman from the Syrian church. Karen asked if I would ask Mr. Pickering to take care of her when she passed. I spoke with David Pickering about this in great detail on two occasions prior to Karen's death. I indicated to David Pickering that Karen's husband was unaware that I was no longer at Nordgren's, and she wanted me to send a letter to the both of them indicating the arrangement I had with Mr. Pickering. Mr. Pickering stated to me, "Prepare the letter and let me see it before you send it out." I prepared the letter and read the letter over the phone to Mr. Pickering. Mr. Pickering had no problem with the letter, with the exception that instead of a c.c. going to him as stated in the letter, Mr. Pickering wanted a "blind c.c." of the letter forwarded to him. I found this request a bit peculiar (as I have never b.c.c.'d anyone in the past), but sent the letter to Karen & Matt Rossi with a b.c.c. to David Pickering."</p>
<p><em>"Did Mr. Pickering handle the funeral for Karen Rossi when she died?"</em></p>
<p><u><strong>My Response</strong></u>- "No! I was called by Karen's husband, Matt, the day before she passed indicating he was advised it was a matter of hours. I immediately contacted Mr. Pickering with the news, at which time he indicated he was unwilling to handle Karen's funeral. I did not understand why, especially since we had spoken of the issue on two separate occasions and correspondence had gone out. For you see, I was unaware of the conversations Mr. Pickering had previously with Investigator Bresnahan, and it became apparent to me that Mr. Pickering had developed "cold feet" for some unknown reason when it came to the final moments in Karen's life."</p>
<p><em>"I read in Mr. Pickering's testimony the statement he made under oath during the Administrative Hearing that he did not know of the letter from you to the Rossi's before it was sent out, and that his first knowledge of it was the next day when he received the B.C.C. copy in the mail. How do you explain this in light of the conversations you had with Mr. Pickering concerning Karen Rossi and the conversation wherein you read the letter over the phone to him?"</em></p>
<p><u><strong>My Response</strong></u>- "To this very day, I do not have an answer to this question, and quite frankly, I'm bothered by David Pickering's response. Did he intentionally lie under oath? I would hope not for his sake! Did he legitimately forget about our telephone conversation and the reading of the letter? I doubt it, for up to this point, I had found David Pickering to be a detail person, professional, and well organized. Then how do I explain his sudden lapse in memory? At some point I will get the answer - most probably - before the Good Lord as he answers to this "faux pas".</p>
<p><em>"Mr. Haddad, allow me to step in here for a minute (another questioner). Turning to another issue, I read correspondence from this Leslie Alexander (D.P.L. prosecution attorney) stating she would not release the names of the funeral director's that Ms. Alexander claimed you contacted in order to sell the pre-need funeral arrangements you made during your 9 year tenure at Nordgren Memorial Chapel, because the funeral directors were concerned you might retaliate against them, am I correct?"</em></p>
<p><u><strong>My Response</strong></u>- "You are correct!"</p>
<p><em>"And am I also correct that when Atty. Alexander realized she could not legitimately withhold the information requested and that after repeated requests by you and your attorney at the time, she finally released the names of Kevin Mercadante (Mercadante Funeral Home and Chapel in Worcester) and David Pickering (Rand Harper Pickering - Westborough Funeral Home in Westborough) as those who supported claims of Mrs. Mangsen against you?"</em></p>
<p><u><strong>My Response</strong></u>- "That is correct!"</p>
<p><em>"Mr. Haddad, I read in the documented testimony of Investigator Bresnahan during the Administrative Hearings that he (Bresnahan) stated under oath that David Pickering along with Mr. Mercadante, claimed you attempted to enter into a business agreement wherein you would bring your pre-need funeral arrangements to their funeral home prior to the issuance of the Order to Show Cause, am I correct?"</em></p>
<p><u><strong>My Response</strong></u>- "Yes, exactly!"</p>
<p><em>And furthermore, Division of Professional Licensure prosecution attorneys (Alexander and Read) called Mr. Pickering and not Mr. Mercadante as their witness against you; even though he (Pickering) didn't come into the picture till after the Order to Show Cause was issued, is this correct?"</em></p>
<p><u><strong>My Response</strong></u>- "Yes, absolutely!"</p>
<p><em>"Mr. Haddad, the "institutional corruption" within the Massachusetts Division of Professional Licensure from the bottom to the top is beyond belief. The system of checks and balances was compromised from the outset by the Chairman of the Funeral Board infecting the system and all Massachusetts Funeral Board Members in 2003 and again in 2007 becoming corrupt in the process. Add to that, a Funeral Board staff committed to covering up their grievous statements and actions and those of its Chairperson, and you have the makings of a "cover-up conspiracy" government cannot tolerate."</em></p>
<p><em>"When you take it to the next level (Division of Professional Licensure) and you witness the corruption from the Director of the Division (Weber) not wanting to know, to prosecution attorneys committed to a conviction contrary to the facts and testimony, and lastly to an Administrative Hearings Counsel (Colleton) who should have withdrawn from the proceedings as requested from the outset due to her obvious partiality (well documented); you have Institutional Corruption at its very worst (or very best, depending on your perspective)."</em></p>
<p><em>"Mr. Haddad, it is apparent to anyone who chooses to review the veritable facts and the process followed that a grave injustice has been afforded you."</em></p>
<p><u><strong>My Response</strong></u>- "It is somewhat comforting that others know the facts, but this is secondary to me. I learned at a very young age that -</p>
<h3><em>"It is less important to have the right words, but extremely important to have the right heart. It is not eloquence God seeks, but Honesty!"</em></h3>
<p>I wish to conclude this update with two (2) verses from Psalm 37, (vv.3-4)</p>
<p><em><strong>"Trust in the Lord and do good. Live in the land and feed on Truth. Enjoy serving the Lord, and He will give you what you want (need). Depend on the Lord; trust Him and He will take care of you."</strong></em></p>
<p>Satan will do whatever it takes to impede the presence of Jesus in our lives. Jesus does not wish to be where he is not invited. Ever the Gentleman, Jesus awaits our invitation. Our invitation must include repentance in order to come from darkness to light. I humbly ask that you pray for the souls of those referenced above and throughout this web site; that they ask forgiveness for their actions through repentance, and that they seek salvation in Christ and with Christ now and always.</p>
