As you know, I am committed to "respectfully remembering" those who have passed before us - those through whose personal sacrifices we enjoy the freedoms we do to this day. As such I have chosen to honor these departed loved ones on this Memorial Day 2009 and have waited to present this update till now.

The subjects to be addressed in this update were supposed to be "more revealing questions that were asked of me pertaining to Attorney Scott Sinrich, Nordgren Memorial Chapel's corporate attorney; Tracy Mitchell, expert witness for the Mass. Funeral Board and Division of Professional Licensure & Secretary for the Massachusetts Funeral Director's Association -MFDA (also owner of funeral homes in Medfield & Millis, MA); and David Pickering, witness for the prosecution and Division of Professional Licensure (also owner of Rand Harper Pickering Funeral Home and Britton Funeral Home, both in Westborough, MA)."

In reviewing my notes of conversations referenced in previous updates, I realized that in order to present the questions posed to me concerning Atty. Scott S. Sinrich, (principal in the law firm of Phillips, Silver, Talman, Aframe & Sinrich, P.C.) and my responses to the questions supported only by veritable facts and the public record, that it would take at least two (2) updates to address the specifics as they pertain to Atty. Sinrich. I therefore have decided to hold off on addressing questions concerning the actions of Atty. Sinrich, until I have addressed questions concerning Mr. Mitchell & Mr. Pickering.

For the purposes of this update, I will address questions posed concerning the Division of Professional Licensure's "expert funeral director witness" - Mr. Tracy Mitchell, then Secretary for the Massachusetts Funeral Director's Association -MFDA and also owner of funeral homes in Medfield & Millis, MA.

Conversations continued - Part 6

"Mr. Haddad, would you mind if I asked you a few questions concerning the Funeral Board's expert witness, Mr. Mitchell?

My Response- "No, I'd be please to."

"Had you met Mr. Mitchell or did you know Mr. Mitchell prior to his appearance as an expert witness for the prosecution during the Administrative Proceedings?"

My Response- "As stated clearly in the public record of Mr. Mitchell's testimony during the Administrative Proceedings, Mr. Mitchell stated that we had not met and that he did not know me. Yet, when I indicated that not only did we meet, but that he, his wife and I had a conversation in Reno, NV at a meeting of the International Order of the Golden Rule and that we spoke for at least 10 minutes concerning the landscaping services provided by Westland. At this time in Reno, Mr. Mitchell reminded me that he did have Westland's brochures that I had left for him several years earlier when I visited his funeral home in Medfield for a scheduled appointment that he neglected to remember - the brochures left with a woman at that time."

"Was Mr. Mitchell representing the Massachusetts Funeral Director's Association (MFDA) in the proceedings as the prosecution's expert witness?"

My Response- "I honestly do not know. I do know that Mr. Mitchell stated as his qualifications to be an expert witness was that he was Secretary of the Massachusetts Funeral Director's Association (MFDA), and that he had been a funeral director since the late 1960's - at least a year less than the time I had been licensed as a funeral director in Massachusetts."

"Mr. Haddad, to be clear, at this point in the Administrative Proceedings your attorneys (Angelini and Flynn) had withdrawn from the case and you were representing yourself, is this correct?"

My Response- "Yes that is correct, Attorneys Angelini and Flynn withdrew from the case after the first two days of the seven days of Administrative Proceedings."

"From what I have read in the public record of Mr. Mitchell's testimony, he was asked many hypothetical questions by the prosecution - his responses thereto appear to have had little or no relevance to the subject matter at hand. Did you object to this line of questioning?"

My Response- "I did not object to any line of questioning throughout the Administrative Process, because I believed only veritable facts and not baseless suppositions would be considered and judged by Administrative Hearings Counsel, Colleton. Boy, was that a grave mistake. The inconsistencies in testimony by all of the prosecution's witnesses as compared to veritable facts and testimony by defense witnesses (all subpoenaed as hostile witnesses), was far and away enough for any impartial mind to say - Haddad was set up from the get-go!"

"Mr. Haddad, were funds paid to Nordgren Memorial Chapel for funerals to be conducted in the future upon the death of a person ever made out to you, and further did the Funeral Board and its investigator (Bresnahan) find that any of these funds were deposited anywhere other than what was stated and appeared in the pre-need files (if my terminology is correct)?"

My Response- "No funds or checks or any source of revenues for pre-need or otherwise were ever made out to me, and in every instance deposits were made by Nordgren Memorial Chapel principals into appropriate accounts with Nordgren Memorial Chapel as the source to be compensated upon completion of the funeral and submittal of the appropriate paperwork to the Trust or Insurance Company."

"Did the prosecution present any cancelled checks or any other documentation from any source such as Bank North or Columbian Life Insurance Company to the expert witness, Mr. Mitchell, that demonstrated any misappropriation of pre-need funeral funds?"

My Response- "Absolutely none!"

Mr. Haddad, Mr. Mitchell appeared as the prosecution's expert witness and was asked to testify in matters that involved procedures concerning funding arrangements for pre-need funerals with Columbian Life Insurance Company, is this correct?'

My Response- "Yes, that is correct!"

"What was Mr. Mitchell's experience with pre-arranged funeral funding with insurance during his 35+ years in funeral service?"

My Response- "Mr. Mitchell testified he had no experience with insurance as a means of funding pre-need funeral arrangements. At his funeral homes (Medfield & Millis) he only deposited pre-need funds into trust."

"So, if I hear you clearly, Mr. Mitchell was the prosecution's expert witness answering questions on a process and procedures of which he had no experience. Is this correct?"

My Response- "Yes, exactly!"

"Mr. Haddad, Did I read correctly from the public record that Mr. Mitchell, the prosecution's expert witness, had not had his pre-need funeral arrangements and funding documents from either of his funeral homes in Medfield and Millis ever inspected for accuracy and completeness and yet somehow agreed to and became the expert witness for the prosecution?"

My Response- "Yes, exactly. Investigator Bresnahan confirmed this during his testimony."

"Mr. Mitchell was very critical of the landscaping services performed by the Westland Companies during his direct testimony by the prosecution, but backed off on his position during cross-examination, stating that - the services Westland performs now appears to him to be a gray area. Was Mr. Mitchell aware that the State Board had unjustly (and wrongfully) ruled just months earlier that Westland's landscaping services were in direct conflict with funeral service regulations - even after you had presented the federal North American Standard Industrial Classification Codes, which demonstrated the decision of the Funeral Board and Division of Professional Licensures attorneys was flawed throughout?"

My Response- "I honestly do not know."

"Did Administrative Counsel, Colleton, - the judge in this matter - rule that the Prosecution attorneys failed to prove that the landscaping services provided by Westland were in conflict with funeral service regulations?"

My Response- "Yes, exactly!"

"And yet attorneys from this same Massachusetts State Agency (Division of Professional Licensure) determined in a separate decision months earlier (a decision we all have read) that the services provided by Westland were in fact in violation of existing state funeral regulations. How could this be?"

My Response- "The inconsistencies are (were) so blatant throughout the Administrative Proceedings that although I believed the truth would set me free, I did not realize the depth of the corruption and demonic activities within the Massachusetts Funeral Board and Division of Professional Licensure."

"Mr. Haddad, last question, I'm struggling to determine what Mr. Mitchell's motivation was for agreeing to be the "expert witness" for the prosecution against you. Do you know what his motivation was? Did you do something to him that would drive him to the depth that it has?"

My Response- "At the time of the Administrative Proceedings, my exposure to Tracy Mitchell was limited to leaving off brochures at his funeral home in Medfield in the mid 1990's and to a brief but comprehensive conversation with Mr. Mitchell and his wife at an OGR Meeting in Reno, referenced earlier. Other than that, I had no opinion of Mr. Mitchell. Until the evolution of this grave injustice, it was my being that everyone I met or came in contact with was an honorable person and their "stock" was as high as it could possibly be. Their "stock" would remain high in my eyes until such time as they proved otherwise - at which point it (their stock) could (would fall) in my eyes. In my 58 years (up to the point of the graves injustice we have witnessed since the fall of 2003), I had never experienced a situation that would have changed my beliefs and thought process as stated above. Obviously, as I have presented the veritable facts from the public record, my distain (actually a better word would be "pity") runs long and deep for those referenced throughout this web site - www.justiceatwhatprice.com."

"I cannot reflect on what motivated Tracy Mitchell to become a part of proceedings that undermine the integrity of public service, and I will leave judgment for same to the Good Lord above. I pray regularly for him and others directly and indirectly involved in this grave injustice - that they seek the "light from the darkness" wherein they presently reside. The Good Lord sees all and knows all."

"What does this 'unveiling' of demonic activity within the Massachusetts Funeral Board & Division of Professional Licensure (and soon to be revealed - Justice System) teach you about the world?"

Part 2. Coming soon. Stay Tuned!

Blessings.
