<p>As you know, the interest in the issues presented herewith and since I created the web site www.justiceatwhatprice.com in March 2005 have expanded far and wide. </p>
<p>What has blatantly permeated a process of government (at least to this point) is the total and complete disregard by individuals within the system of government to follow the rules, the regulations, the policies and the procedures which are mandated in the laws of the Commonwealth. Laws cannot exist without <em>Order</em> - and from my experience with the Funeral Board and Division of Professional Licensure, there is no order to the law. </p>
<p>Subsequently for fear of being held accountable for their actions and unilateral decisions without veritable facts to support same, these individuals conveniently slip into their fox holes using evasive tactics as their <em>motif operandi.</em> </p>
<p>I have referenced on numerous occasions the need to <em>"become clean by coming clean".</em> I am reminded in Matthew, Chapter 15, verse 14 (we're in the Bible now for those of you who worship God with your lips, but your hearts are far from God) which states,</p>
<p><em><strong>"Leave them; they are blind guides. If a blind man leads a blind man, both will fall into a pit".</strong></em></p>
<p>It has been suggested to me that Katherine Mangsen, Kurt Mangsen, Ronald Johnson, Atty. Scott Sinrich, Funeral Board Chairman Kazlauskas, and Division of Professional Licensure Investigator Bresnahan blinded to the truth by their bias and prejudice infected (and otherwise blinded) other members of the Funeral Board and Administrative Staff at the Division of Professional Licensure into believing unsubstantiated facts, false facts, and thereby fabricated facts in order to seek sanctions against me (Haddad). So blinded by their corrupted hearts, the aforementioned individuals have taken a giant step to eternal death in hell with Satan and foregone eternal life in God's Heavenly Kingdom. How truly sad it must be, but the Good Lord gave us "free will" to choose our eternal path. It is a shame many referenced in this web site have sacrificed their souls, moved their eyes from God only to engage the devil.</p>
<p>Jesus goes on in Matthew, Chapter 15, verse 17-19, "Don't you see that whatever enters the mouth goes into the stomach and then out the body? But the things that come out of the mouth come from the heart, and these make a man unclean. For out of the heart come evil thoughts, murder, adultery, sexual immorality, theft, <em><strong>false testimony, slander".</strong></em> I would wager for the aforementioned individuals the depiction describes each of you to a "T__" - just like looking into the eternal mirror.</p>
<p>As has been accurately presented herewith on numerous occasions (all well documented and chronicled for ready reference) the Funeral Board and Division of Professional Licensure have been less than forthcoming with Public Records requested. During an "in situ" inspection of the Public Records at the offices of the Division of Professional Licensure on April 24, 2007 only four (4) of the seven (7) boxes of public records known to exist were presented for review - records that were in no semblance of order. I, and a very credible witness, reviewed each and every document in the four (4) boxes and stated with clarity and certainty to Division of Professional Licensure's Chief Counsel, Kathe Mullally, that the Public Records present were incomplete. Chief Counsel Mullally's statement to me and the witness, "You have all there is!"</p>
<p>I submitted a <em><strong>2nd Request for the Public Records</strong></em> with great specificity. An excerpt from correspondence to Division of Professional Licensure's Chief Counsel Mullally dated April 26, 2007 appears below.</p>
<p><em>"This is my 2nd Repeated Request for Release of all Public Records held by the Massachusetts Division of Professional Licensure.</em></p>
<p><em>An in situ inspection of Public Records, based on my Request Letter of March 26, 2007, took place at the Division of Professional Licensure (5th Floor), 239 Causeway St, Boston, under the supervision of Kathe Mullally, Chief Counsel, on April 24th (9:30am-1:45pm) During this inspection all the Public Records requested were not produced, and it was so communicated orally to Chief Counsel Kate Mullally at the time of the in situ inspection.</em></p>
<p><em>I have personal and visual knowledge of the general quantity of public records held, based upon appearances at Hearings before the Board of Registration of Funeral Directors & Embalmers that some seven (7) cartons of records existed. At the April 24th in situ inspection of Public Records at the Division of Professional Licensure only 4 cartons of Public Records were produced.</em></p>
<p><em>Division Chief Counsel Mullally communicated to me during the April 24th in situ inspection that NO Public Records were determined classified as "exempt" records and that otherwise would not have been held back or not made available under the Mass. Public Records Law.</em></p>
<p><em>Below is a Listing of the classes and types of Public Records I believe would been normal and necessarily created for this case, but were not made available as a part of the in situ inspection on April 24th of all Public Records of the State's Division of Professional Licensure:</em></p>
<p><strong><u>1. INSPECTOR / INVESTIGATOR(s) RECORDS:</u></strong></p>
<p><em><u>No public records were produced of the Inspector(s) and Investigator(s).</u> A "Jacket Folder" existed for each of the Complaints filed, but each was empty. No inspector(s) and nor investigator(s) records were produced, which would have necessarily included: field inspection write-ups, fact findings, interviews, analyses, summaries of inspection/investigations/findings, and conclusion, et al. <u>No public records whatsoever were produced.</u></em></p>
<p><em>Numerous emails (some ~33 pages) from Complainant Katherine Mangsen to Investigator Bresnahan were produced during the in situ inspection of Public Records. However, <u>no public records of responses, or analyses were produced by Investigator Bresnahan, or any other members of the Division of Professional Licensure</u> responding to the emails of Katherine Mangsen, or internal office disposition of the merits of the contents of the Katherine Mangsen numerous emails. No public records whatsoever were produced.</em></p>
<p><strong><u>2. ATTORNEY(s) RECORDS:</u></strong></p>
<p><em><u>No records were produced</u> during the in situ inspection which documented any attorneys' legal analyses, legal merits, legal assessments, and conclusions on how the Complaints were in violations of the Board's Regulations and from which the formal decisional legal documents were created. <u>No public records whatsoever were produced.</u></em></p>
<p><em><u>No attorney's internal work records were produced which related to the legal analyses required for the administrative process</u> which addressed and evaluated, disposed of the Respondent's (Philip G. Haddad, Jr.) many responses submitted by the Respondent answering the Division's many hearings and prosecution's various findings and procedural decisions, such as:</em></p>

<p><em>a. <u>No Division public records were provided</u> which addressed, analyzed, and evaluated, et al, by the Division which involved the merits of Respondent Haddad's detailed response submittals answering the case's Complaints.</em></p>
<p><em>b. Philip G. Haddad's Opposition to Prosecution's Motion for Partial Summary Decision, June 20, 2005 (12 pages).</em></p>
<p><em>c. Post Hearing Briefing/Memorandum to the Order to Show Cause (Issued on June 29, 2004), Oct. 18, 2006 (15 pages).</em></p>
<p><em>d. Respondent's Objection to Tentative Decision of the Board (dated Jan. 31, 2007) of Feb. 27, 2007 (23 pages).</em></p>

<p><strong><u>3. EXPERT WITNESS:</u></strong></p>
<p><em>The Division of Professional Licensure relied upon an "Expert Witness" to offer expert opinions of the standards of the funeral business to lend credibility to the Board of Registration of Funeral Directors & Embalmers' assertions and decisions that regulatory law was violated. No public records were produced during the in situ inspection which documented how the "Expert" was selected, what the "Expert's" credentials were, who and how in the Division of Professional Licensure validated and credentialed the individual to serve as "Expert" for the Division. <u>No records whatsoever were produced.</u></em></p>
<p><strong><em>4. STANDARDS & GUIDES FOR JUDGING REGULATORY NON-COMPLIANCE</em></strong></p>
<p><em><u>No records were produced</u> by the Division of Professional Licensure which would be classified as "Standards" or "Guides" that would be relied upon by the Division to establish, measure, analyze, verify, and conclude if a license holder had violated regulatory law for funeral directors and/or embalmers. <u>No records whatsoever were produced.</u></em></p>
<p><strong><u>5. ELECTRONIC / DIGITAL COMPUTER RECORDS</u></strong></p>
<p><em>No access to any electronic / digital public records were provided and when upon were requested of Chief Counsel Mullally were denied and no legal basis for denial was offered during the April 24th in situ inspection of requested public records. <u>No records whatsoever were made electronically available for inspection.</u></em></p>
<p><em>Records still sought a 2nd time with respect to the above subjects are all those matters that are directly and indirectly related and are to include public records which are legally defined in the Public Records law. This Public Records Request kindly requests to inspect in situ all records, and not limited to, as authorized in the above References, documents, emails, correspondence, letters, memos, reports, official personal notes, meeting notes, deliberations, conversation notes, opinions, legal opinions, phone logs, to include digital recorded material on a PC hard drive(s) or any other recorded storage media, et al. Also to be included are documents, records, emails, correspondence, memos, official personal notes, deliberations, conversation notes, opinions, legal opinions of all Executive Sessions held in these matters. Because the government possesses superior knowledge of all the records it holds, therefore government is in the superior position to understand and identify the complete record files sought and make them all available."</em></p>
<p>Here we are, August 4, 2008, and the fog of <strong><em>"Obfuscation"</em></strong> and <strong><em>"Misinformation"</em></strong> continues to permeate and engulf a <em>shameful</em> and <em>shamful</em> Administrative Process orchestrated by corrupted individuals and witnessed by Almighty God (and now you).</p>
<p>When we are successful (and we will be) a full scale investigation will be undertaken by the appropriate State (Commonwealth of Massachusetts) authorities, and individuals (all persons) involved in the corruption and subsequent attempts at cover up (to include those who have fled the Funeral Board and Division of Professional Licensure) will be held accountable for their false statements and actions. The taxpayers of the Commonwealth of Massachusetts must be apprised of corruption within state government and must hold those corrupted civil servants personally responsible for the "fraud" and waste of precious tax dollars by despicable individuals motivated by evil means. To this end, I remain committed.</p>
