<p>Do you recall what you were doing three (3) years and ten (10) months ago?
I DO! </p>
<p>For the past 46 months, I have sat back watching, waiting, and expecting
the hypocrisy of individuals and their actions to be readily identified
and dismissed as having NO basis in fact. Why would I expect this to happen?
</p>
<p>As you know, I am a 32 year career federal civil servant; a defender of
justice within the “system” at the federal level; and a true
believer that our democratic system of government was “fair and just”
and that ONLY individuals within the system were or could be corrupted.
Little did I know or conceive that so many in positions of power and influence
could be so prejudiced, so biased, and so influenced as to blatantly compromise
our democratic system of government.</p>
<p>At an absolute minimum, the State Board was sold a false “bill of
goods” by Katherine and Kurt Mangsen (and yes, Ronald E. Johnson)
and their corporate counsel, Scott S. Sinrich. Supported, reinforced, and
an advocate for the Mangsen’s and a close friend of Ronald Johnson,
the then Chairperson of the State Board of Registration of Funeral Directors
and Embalmers, John J. Kazlauskas, took up the cause of the Mangsen’s
at its meeting on December 9, 2003 without benefit of veritable facts. Accepting
the Mangsen’s statements of fact as being accurate without a complaint
being filed or investigated, the State Board, the Division of Professional
Licensure’s investigator, Bresnahan, and Kazlauskas rushed to judgment
fitting the so-called facts as presented by the Mangsen’s, their attorney,
and Johnson into the record - never expecting for a moment that I would
learn of (let alone obtain) an audio tape of the conspiracy. One need only
listen to the laughter of the parties on the audio tape to understand the
extent of the conspiracy and those involved.</p>
<p>With Mrs. Mangsen filing three (3) complaints against me (one even written
and signed on Christmas Eve 2003 – can you believe it? – the
mother of 5 children); not one word of the three (3) complaints was verified
as factual by the Division of Professional Licensure’s investigator,
but just accepted as so. One need only listen to Investigator Bresnahan’s
comments and statements on the audio tape of the December 9, 2003 meeting
of the State Board to understand why he did not deem it necessary to conduct
much of an investigation – let alone a thorough investigation of Mrs.
Mangsen’s assertions and allegations.</p>
<p>It took a little more than a year to obtain the audio tape of the December
9, 2003 meeting with non-responses from Christopher Carroll, Counsel to
the Board to requests from my then attorney, Daniel Flynn, for the tape;
then denying the State Board had the tape – although Bresnahan under
oath said the State Board did have a copy of the tape. Finally, we did obtain
a copy of the audio tape from Byron Blanchard, who was at the meeting on
December 9, 2003 and actually taped each and every word spoken.</p>
<p>Clear as to the corruption and now cover-up, I contacted the Office of
the Inspector General (Mr. Sullivan) and requested an investigation of the
matter – this process well documented. Mr. Sullivan and the Office
of the Inspector General declined to get involved. His staff suggested we
contact the Ethic’s Commission.</p>
<p>Prior to doing so, I contacted Governor Mitt Romney’s Office (as
well as the Office of the Lt. Governor, Kerry Healey) requesting an investigation
into the matter. Governor Romney responded with a form letter indicating
my request was submitted to the Office of Consumer Affairs and Business
Regulations, and that I could expect to hear from them soon. It’s
a good thing I didn’t hold my breath, because as you could guess;
I never heard from that office. </p>
<p>Folks at the Ethic’s Commission initially were very receptive and
helpful. Receiving assurances the matter would be addressed based upon the
content of my complaint, I felt reassured that there were honorable people
employed within state government of the Commonwealth. It took only weeks
before I was suddenly informed the State Ethic’s Commission reversed
itself and decided not to take action on my complaint. It was obvious someone
got to someone, and the decision was not supported by those initially involved
in the process at the State Ethic’s Commission. (One need only review
recent actions taken by Governor Patrick with respect to the Ethic’s
Commission to see why the sudden reversal to move forward with my complaint).
I was advised by folks in The Ethic’s Commission Office to contact
the Attorney General’s Office of Civil Rights, as it was apparent
my civil rights had been violated.</p>
<p>I, then, contacted Attorney General Thomas Reilly’s Office of Civil
Rights and was informed that although there appeared to be merit to my case,
the Office of the Attorney General could not take up the issue as they would
be the ones to defend the Commonwealth of Massachusetts were I to file a
“Civil Rights” violation against the Commonwealth for unjust
actions taken against me.</p>
<p>It was now back to Governor Romney’s Office, but that too was a sham
and waste of time. I was informed time and time again by Governor Romney’s
press person (I was referred to him, for fear the press would hear of the
sham and start asking questions) that the Governor was out of the state
and unavailable to be informed of the matter, but that he (press person)
would address the issue. Again, no response or follow up.</p>
<p>It was apparent while Governor Romney was out of the state campaigning
for national office, little or nothing was being accomplished at the State
level – and Governor Romney apparently could care less. And all the
while, taxpayer’s hard earned dollars were being wasted at an alarming
rate in an attempt to cover up the conspiracy and subsequent corruption.</p>
<p>After more than 18 months having past from the issuance of the Order to
Show Cause (June 29, 2004) and the commencement of the Administrative Hearing
(January 18, 2006), the process followed was a travesty of justice at best;
and shall soon face the scrutiny we requested dozens of times of state officials
whose roles call for checks and balances to prevent the injustices I have
chronicled on this web site for the past 2 1⁄2 years.</p>
<p>Having the patience of “Job”, and a believer in our democratic
system of justice, I have witnessed an Administrative process compromised
from its inception with persons within the Administrative system making
up the rules as they go along to suit their purposes. Not only have they
ignored the “real” facts, but they have attempted to “force
fit” wrong facts, distorted facts, and yes, “false facts (they
know to be false) into their decision making process to cover up the conspiracy
and the blatant corruption which is indicative of their actions.</p>
<p>Reluctantly (but truly, time expired long ago), it is now time to <strong><em>“take
off the gloves”</em></strong> expose publicly and without reservation
a corrupt system of government in the Commonwealth of Massachusetts that
Must be eradicated publicly and without reservation in order to establish
(<strong>please note</strong>: I did not say “re-establish) a sense
of credibility, honor, and integrity in the administrative system of justice
in the Commonwealth. </p>
<p>I have filed an appeal of the denial of “due process” supposedly
afforded me in this matter in a civil action in Worcester Superior Court.
I am told the decisions made are those of the State Board of Funeral Directors
and Embalmers and NOT the decision of the Administrative Hearings Counsel,
Colleton. It is a fact that the only member of the State Board that was
present for any of the Administrative proceedings was Edward Mazur along
with the Administrative Hearings Counsel. I voluntarily appeared before
the Board on December 9, 2003 without a complaint having been filed against
me at that time. Since then (46 months have past and I have yet to appear
before the State Board in any capacity, and yet the Board consisting of
Mr. Mazur, Mr. Brezniak, Mr. McWilliams, Ms. Pineau, and Ms. McCarthy have
decided on my fate without benefit of verifiable facts or having me personally
appear before the Board. When they finally learn the folly of their decision,
I can just hear them saying in unison “our decision was based upon
what we were told by Mr. Mazur and Ms. Colleton – and if their recommendations
were based upon biases and prejudices and distorted facts as presented by
Bresnahan, that’s not our fault”. Stay tuned!</p>
<p>In the meantime, an Assistant Attorney General, (MaryAnne Reynolds-Martin)
representing Martha Coakley, Attorney General of the Commonwealth of Massachusetts
and the State Board has responded to Worcester Superior Court with all documents
supposedly in the possession of the State Board and Division of Professional
Licensure. The records submitted are deficient and incomplete. I am in the
process of identifying those records I know to exist and are missing from
Assistant Attorney General Martin’s submission, as well all electronic
records and essential investigative records – all of which are intentionally
missing from the record files.</p>
<p>Not only have the allegations and assertions made by Mrs. Mangsen been
found to be false, her husband, Kurt has been admonished by Administrative
Hearings Counsel for being less than truthful in his testimony asserting
he had NO knowledge that Nordgren Memorial Chapel had an account with Columbian
Life Insurance Company – even though Nordgren Memorial Chapel had
been paid $114,000 directly from Columbian over the period of time Kurt
Mangsen was president and CEO at the funeral home and denied any knowledge
of Columbian Life Insurance Company. Lies. distortions, and less than truthful
statements to the State Board, and the Administrative Hearings Counsel by
both Kurt and Katherine Mangsen (and Ronald Johnson). I believe it’s
time to release the documents, the testimony, and the statements of witnesses
to set the record straight and to demonstrate the deficiencies and lack
of “due process” afforded me in this matter.</p>
<p>There is enough blatant disregard for the truth and the facts in this case
by the Mangsen’s; their attorney, and state employees and appointees
– that the extent of the corruption is almost beyond belief. You will
note I said “Almost” because you will have No Choice but to
believe what I will be sharing with you and others in subsequent updates
and in various forums. I will demonstrate the corruption within the Commonwealth
is not limited to the underlings in state government, but thrives at the
highest levels of state government to include the legal strata with individuals
that have No right to be in the positions they are in and are only in these
positions through political influence and not as a result of competence
and the exercise of common sense and good judgment. </p>
<p>It is time to eradicate the cancer that has permeated the State Board,
the Division of Professional Licensure, and others masquerading as dedicated
civil servants within the Commonwealth. The honor; the integrity, and the
credibility of state government within the Commonwealth, at an absolute
minimum, demand this course of action.</p>
<p>As Mark Twain once said, “<em>A Lie can Travel half-way around the
World, while the Truth is putting on its Shoes”. To Mr. & Mrs.
Mangsen and their fellow co-conspirators I state; <strong>“I am committed
that the Truth (regardless of how long it takes) travels the same path for
all to see, hear, and know.</strong></em><strong>”</strong></p>
