<p>You may be thinking, “Who is going to be the subject of this update
– Desperate Acts by Desperate People?” Will it be John Bresnahan,
inspector/investigator, Division of Professional Licensure? Will it be Kevin
Mercadante, owner of Mercadante Funeral Home and Chapel in Worcester? Will
it be Leslie Alexander or James Read in their prosecutorial efforts to force
fit false facts into their efforts to get “a win”? Or will it
be Anne Colleton, Administrative Hearings Counsel, who was supposedly tasked
with the responsibility of being the fair and impartial “judge”
in this matter? If these were your thoughts for this update, you would be
wrong.</p>
<p>The principals whose “desperate acts” will permeate this update
are Katherine and Kurt Mangsen and Attorney Scott S. Sinrich, legal counsel
for the corporation, Nordgren Memorial Chapel of Worcester, (oh, by the
way of which I am an owner). <br>
As an owner of Nordgren Memorial Chapel, as such one might rationally come
to the conclusion that Attorney Sinrich would be representing me before
the State Board; but that would be impossible because he has chosen to represent
Katherine and Kurt Mangsen’s and their mistruths and wrongful allegations
and assertions in an attempt to terminate my association at the funeral
home. It is now time to present the true facts (verifiable facts) that are
reflective of <strong><em>“Desperate Actions by Desperate People”</em></strong>
– I give you Katherine and Kurt Mangsen and their attorney, Scott
S. Sinrich of Worcester.</p>
<p>The ONLY information I present on this web site is verifiable facts (and
NOT one word which has been found through discovery). I have honored a directive
made by the judge in this matter, and at no time have I violated this directive
up to this point, and at NO time will I violate this directive in the future.</p>
<p>As is commonly known, Katherine Mangsen was not directly (or for that matter
indirectly) involved in Nordgren Memorial Chapel until negotiations began
with the Carrigan’s in an attempt to buy out the Carrigan’s
interest in the funeral home. Once the buy out was approved and Katherine
and Kurt Mangsen and I purchased the funeral home (to this very day, I own
3 % of the business), Katherine Mangsen assumed the position of Treasurer
of Nordgren Memorial Chapel. It was important to Katherine Mangsen that
Kurt be given credibility (for everyone knew Kurt had little or No experience
in running a business). Katherine was in essence going to assume that role;
but she wanted me, my name, and reputation to lay credibility to the business
– thus she asked me to take the title of COO (meaning Chief Operating
Officer) – a title Kurt had never heard of before and a title Katherine
knew well as a result of her education at the College of Holy Cross –
a fact that she made clear to everyone every day.</p>
<p>As is well documented, I had that title, COO (without any responsibilities
one would expect of a Chief Operating Officer) for one year August 1, 2002
to July 31, 2003; after which Katherine and Kurt Mangsen voted me off the
Board of Directors (in favor of Ronald Johnson) and withdrew my assigned
title of COO. It was immediately apparent, Mrs. Mangsen wanted me gone;
but yet I was an owner of the funeral home.</p>
<p>Looking for any opportunity to get rid of me, Katherine Mangsen (and Kurt,
I suppose) attempted to cut my salary by as much as 40% with the assistance
of their advisors. That did not work. Desperate people taking desperate
actions Katherine and Kurt Mangsen seized the opportunity to affect their
plan of action (per testimony of John Bresnahan) by terminating me without
notice and without the benefit of responding to questions posed by Inspector
Bresnahan. </p>
<p>Now enters Attorney Scott S. Sinrich, Corporate Counsel, Nordgren Memorial
Chapel. One would think Attorney Sinrich had a responsibility to me as an
owner (maybe we ought to ask Atty. Sinrich this question at some point)
of the funeral home to ask for my input in the matter prior to Attorney
Sinrich preparing the letter of termination, having Kurt Mangsen sign the
letter, getting it in the hands of a constable, and having it delivered
to me – all within less than six (6) hours. Have you ever heard of
a lawyer working this fast? It has been suggested to me that the letter
had been prepared in advance and that the entire matter was pre-scripted.
Although there are numerous indications that this was the case, unfortunately
Mr. Kazlauskas died before I had the opportunity to question him on the
matter. Therefore, at this point I cannot and will not conclude with certainty
that the entire matter was a set up from the outset. I will let the audio
tape and verifiable facts speak to this point.</p>
<p>Katherine Mangsen filed three (3) complaints against me with the State
Board. <strong>Please Note:</strong> Katherine Mangsen (and NOT Kurt Mangsen,
president & CEO, Nordgren Memorial Chapel) prepared and signed the complaints.
I filed detailed responses to each complaint, which were totally ignored
by Bresnahan and the State Board. Realizing her assertions and allegations
were without merit even with the blanket support and cooperation of Bresnahan
and the State Board, Katherine Mangsen and Nordgren’s Corporate Counsel,
Scott S. Sinrich took it upon themselves to contact, speak with, and provide
the Funeral Monitor (a publication many refer to as the supermarket tabloid
of the death-care industry) with court documents and baseless accusations
against me. Here you have the Corporate Counsel for Nordgren Memorial Chapel
speaking with a national industry publication concerning a civil matter
for which he is representing the Mangsen’s making statements of fact
that were not proven, have not been proven, and are now known to be false.
For example, the Funeral Monitor stated as fact in one of its publications
that Orthodox Calendars were provided by Nordgren Memorial Chapel, paid
for by Nordgren Memorial Chapel, and did not have Nordgren Memorial Chapel’s
name, address, or phone number listed on the calendar. Yes, the calendars
were provided by Nordgren Memorial Chapel and paid for by Nordgren Memorial
Chapel (per my contract with Nordgren’s for the 9 previous years prior
to my termination). <strong>But get this </strong>– at NO time ever
was an Orthodox calendar provided to the Orthodox Community by me or Nordgren
Memorial Chapel that did not have the name Nordgren Memorial Chapel, 300
Lincoln Street, Worcester, and the phone number clearly printed on the calendar.</p>
<p>What you have are desperate people taking desperate actions that clearly
demonstrate their intent to achieve their objectives through false accusations
not ONLY to the State Board, but to the media.</p>
<p>But there is more! MUCH MORE! You need to be seated for this one.</p>
<p>On Thursday, June 28, 2007 as I was returning home to change my clothes
for a photo appointment in Worcester, I received a call on my cell. The
gentleman at the other end of the phone introduced himself, indicating he
was a detective with the Massachusetts State Police, and that he was calling
from my residence in Worcester.</p>
<p>All I could think of was that something had happened to my wife, Carolyn.
A bit panicked, I shouted, “Is Carolyn O.K.?” The detective
stated, “Yes, your wife is fine. She gave us your cell number to call.”
</p>
<p>Relieved, I stated, “Thank God! What can I do for you?” The
detectives response was, “Mr. Haddad, we need to speak with you as
soon as possible, and we will meet you wherever you prefer.” I stated,
“I’m on my way home and will be there in 15-20 minutes. I have
an appointment at 4:00PM, but will have 15 minutes or so to speak with you.”

<p>The detective indicated that he and another Massachusetts State Police
Officer were in civilian clothing and in an unmarked car and would be waiting
in their vehicle for me to arrive home. </p>
<p>I arrived to find the State Police detectives parked in front of my neighbors
home one house up the street, and when they observed me arriving they drove
to the front of my residence, got out of their vehicle, showed me their
identification; after which I invited them into our living room. At that
time I invited my wife, Carolyn, to join us. I was shown a photocopy of
me (I believe it was a copy of my driver’s license) and I verified
that the photo was of me. The detective asked me if I knew of a Scott Sinrich?
I indicated he was Nordgren Memorial Chapel’s Corporate Counsel, and
yes, I knew Attorney Scott Sinrich. The detective held up and began reading
from a <strong>criminal complaint</strong> filed against me by Attorney
Scott S. Sinrich on behalf of Katherine and Kurt Mangsen. </p>
<p>Up till now, there was little alleged or asserted by the Mangsen’s
and their attorney (Sinrich) that surprised me; but I must admit this one
took me by surprise. I asked the detective to elaborate on the nature of
the Criminal Complaint. Without presenting me with the complaint, the detective
stated that Katherine and Kurt Mangsen have alleged that I (Philip G. Haddad,
Jr.) threatened the lives of their children in the <a href="/archives/2007/03/20070331.shtml">March
31, 2007 update</a> on the web site www.justiceatwhatprice.com – the
same web site the Mangsen’s and their attorney have tried unsuccessfully
to shut down on no less than (2) separate occasions in Worcester Superior
Court.</p>
<p>Before proceeding to answer all questions posed to me by the detectives,
I requested a copy of the complaint, as I believed I had a right to a copy
of the complaint - being the person accused. I was assured by the detective
I would be provided with a copy of the complaint.</p>
<p>I willingly and without hesitation responded to each and every question
posed to me by the detectives. After approximately 20 minutes, the detective
stated “I do not believe you to be a threat to the Mangsen’s
children, and it appears what we have here is a business dispute. Mr. Haddad,
here is my card, in the event you feel it necessary or wish to speak with
me at anytime, do not hesitate to contact me; for it is our role to maintain
the peace at all times”. I thanked the detectives and escorted them
to the front door of my residence.</p>
<p>The <strong>“Criminal Complaint”</strong> filed against me
by the Mangsen’s has been found to be without merit and the case has
been closed.</p>
<p>I was not asked nor am I compelled to remove the comments made by a woman
in reference to Mrs. Mangsen in the March 31, 2007 Update on this web site.
However, as a gesture of good faith to the Mangsen’s and in light
of the professionalism displayed by the Massachusetts State Police in maintaining
the peace, I have this date deleted the paragraph which Mr. & Mrs. Mangsen
and their attorney, Scott S. Sinrich deem objectionable, from the March
31, 2007 Update on this web site.</p>
<p>I submit to you – the reader of this web site – and specifically
to Mrs. Mangsen who claims to be “emotionally distressed” by
all the attention focused on her now that so much of what she has alleged
and asserted has been disproven and found to be false, something that I
learned a long time ago and have practiced without exception since the age
of 16.</p>
<p align="center"><strong>“For Every Action, There is a an Opposite
and Equal Reaction”</strong></p>
<p>Before taking action – any action – it is prudent to weigh
all the verifiable facts and consequences of “being right” as
well as the consequences of “being wrong”. There can and often
are consequences for being wrong that were unanticipated and undesired.</p>
<p><u>Unilateral Acts</u> – DO NOT remain unilateral. As such, being
wrongful in ones statements and actions carry a heavy burden to be borne
now and in the future.<br>
Yes, it is true, “DESPERATE PEOPLE do take DESPERATE ACTIONS”
and fortunately, we have a court system to protect the honor and integrity
of justice in matters of this nature.</p>
