<p>As you know this web site is being routinely read by funeral director’s
throughout the country, by cemeterians throughout the country, by personnel
from several pre-need insurance companies throughout the country, as well
as by hundreds (although I suspect it is now thousands) of interested persons
who either personally know me or have been apprised of the conspiracy and
subsequent corruption and cover up that has taken place within the State
Board of Registration of Embalmers and Funeral Directors and now the Division
of Professional Licensure, Commonwealth of Massachusetts. </p>
<p>The aforementioned State Board and State Agency seem to think they are
above the law and can make up the rules and regulations as they go along.
Utilizing Al Quaida tactics (hit and run, and in this case thinking for
a moment they can hide within and behind the system) is not going to work
for the State Board and Division of Professional Licensure any longer –
even if this is Massachusetts. </p>
<p>The State Ethics Commission has recently gone through an evaluation resulting
in the dismissal of its Director, and I suspect others will follow. It is
now time for Governor Patrick to move forward and to take a hard look at
the corruption at the top as well as within the Division of Professional
Licensure. I suggest to you, the corruption has become common place and
that many good genuine people (civil servants) have become corrupted by
closing their eyes to the corruption in order not to forsake their jobs
and careers.</p>
<p>Believing “Justice would be served” in a timely fashion, based
upon verifiable facts and not baseless allegations and accusations by a
“woman with an axe to grind” and having spent 32 years in federal
service; to date I have labored through a disjointed process few can believe
has occurred in this day and age - for 3 years and eight months.</p>
<p>It was suggested to me by professional funeral directors with whom I have
worked with over the years that the time had come for an independent review
of all the facts, all the documents, and all correspondence in this matter
now that supposedly the Massachusetts State Board had rendered ITS decision.
<em> <strong>For the record</strong></em> - I have NOT been called before
the State Board since the complaints were filed against me by Katherine
Mangsen, wife of Kurt Mangsen, Nordgren Memorial Chapel in Worcester dating
back to December 2003. I have NOT been called before the State Board as
a result of at least two (2) complaints filed against me by the State Board
itself (one authored by Helen Peveri - $72,491.70 annually - and the other
authored by Kim Scully – $55,350.00 annually; neither of whom felt
it necessary to follow their own rules - Division of Professional Licensure
Rules - for completion of the complaints). </p>
<p>As such, it was not a hard decision to make to initiate the process for
creating an independent panel to come to the table, review all the documents
in my possession, review all the public records from the State Board and
its members (past and present), review all the public records from the investigator
(if they can be found), review all the public records from the Administrative
Hearing’s Counsel, review all the public records from the Prosecution,
and interview the appropriate individuals in this matter. </p>
<p>Since the Massachusetts Funeral Director’s Association (M.F.D.A.)
was quick to volunteer Mr. Tracy Mitchell, secretary for the MFDA and a
funeral home owner and director in Medfield and Millis, as its “expert
witness” to testify on behalf of the prosecution against me, I felt
it only appropriate to invite the Massachusetts Funeral Director’s
Association (MFDA) to appoint a representative to this independent panel
to review all the facts and proceedings in this matter. (You see - I look
for honesty, sincerity, integrity, and objectivity in everything I do or
have ever done, and I offer that as my “calling card”.</p>
<p>I just assumed the Massachusetts Funeral Director’s Association (MFDA),
dedicated to serving and representing Funeral Service in Massachusetts,
would want to be part and parcel to assuring justice had been served in
this matter with the same enthusiasm and zeal with which they volunteered
their Secretary, Tracy Mitchell, to be an expert witness in this case</p>
<p>As such, I forwarded the following correspondence to Ms. Anne Roan, President,
Massachusetts Funeral Director’s Association (MFDA) with a copy to
her place of employment, Conley Funeral & Cremation Service in Brockton,
MA.</p>

<p>I wasn’t surprised (but I must admit to being a little disappointed)
with the response from Ms. Roan on behalf of the Massachusetts Funeral director’s
Association (MFDA).</p>

<p>The Massachusetts Funeral Director’s Association provided its Secretary,
Tracy Mitchell (License Number 5416) a funeral director from Medfield and
Millis and licensed in Commonwealth of Massachusetts since 1968 (one year
after I was licensed in 1967 – my License Number 5300) as its “Expert
Witness” – even though Mr. Mitchell had one year less experience
than I had. Now the Massachusetts Funeral Director’s Association (MFDA)
has the opportunity to participate in an independent review of alleged inconsistencies
in a flawed process from the outset, and the MFDA’s Executive Committee
declined to participate in the review.</p>
<p>What is the Massachusetts Funeral Directors Association?</p>
<p> One need only go to the MFDA web site to read:</p>
<p>• MFDA is the funeral director’s professional community. Together
we leverage our experience, expertise, and influence to anticipate and address
our issues, to build skills, to develop practical solutions to business
problems, and to set the standard for quality service and ethical practice
that will advance our profession.<br>
One need only to read the MFDA’s vision:</p>
<p>• The Massachusetts Funeral Directors Association is the recognized
voice and resource for information, expertise and opinion on issues affecting
the funeral service profession.</p>
<p>I could go on and on, but I’ll leave the rest to you. I encourage
you, the reader, and especially the Massachusetts funeral director, to take
a few minutes to read the MFDA’s “values”, “what
we stand for”, and “how we operate”. Then and only then
will you be in a position to evaluate what you receive for benefits of membership
in the MFDA verse what you pay to be a member.</p>
<p>I suggest to you, the MFDA’s Executive Committee, like so many others
in this profession “rush to judgment” without verifying the
veracity of the facts. </p>
<p>I suggest to you, the MFDA willingly volunteered Tracy Mitchell as its
expert witness to testify as the prosecution’s expert witness against
me, but now is so fearful the “truth be known” that they are
running and hiding from that which they now know may well have been a wrongful
act on their behalf. </p>
<p>Is it possible, as has been stated to me by funeral directors, who just
so happen to be members of the MFDA, that Mr. Kazlauskas (now deceased)
was instrumental in having Mr. Mitchell and the MFDA involved in this process
from the outset? Unfortunately, I am unable (at this point) to substantiate
this fact with Mr. Kazlauskas (unavailable); but the audio tape of Mr. Kazlauskas’s
remarks, statements, and subsequent actions ring loud and clear for all
to hear. To date more than 50 copies of the audio tape of the infamous December
9, 2003 meeting have been distributed to those requesting a copy of the
tape. I wonder, “Has Mr. Mitchell and the MFDA made the effort to
get a copy of and listen to the tape? They would certainly have the opportunity
were they to participate in the independent review of all verifiable facts.</p>
<p>Obviously, I consider the decision of the MFDA not to participate in the
independent review a<em><strong> “Cowardly Act”</strong></em>
and contrary to the mission and values expounding on its web site. As such,
I also consider “Membership in the Massachusetts Funeral Directors
Association” as having NO VALUE and NO SUBSTANCE, and therefore NO
BENEFIT to the individual Massachusetts funeral director.</p>
<p>Let me be perfectly clear. I am not suggesting for a moment that all current
members of the Massachusetts Funeral Directors Association tear up or burn
their membership cards; although this certainly is an option. What I am
suggesting is that I perceive NO Value in membership in any organization
or association that could care less about the facts, care less about the
truth, and care less for assuring that actions taken for or against a licensed
representative of the industry they profess to be the voice of and for are
valid and sound.</p>
<p><strong><em>For My Money, there is No Value in Membership in the Massachusetts
Funeral Directors Association. You are encouraged to make up your own mind.
</em> </strong></p>
<p>In the meantime, stay tuned.</p>
<p><em>If you would like to be a participant in the review process expected
to commence within the next sixty (60) days; a process that is expected
to take approximately ninety (90) days to complete with a final report to
be submitted to numerous entities to include federal, state, and local agencies,
and associations, to mention but a few; please submit you resume and reasons
for wishing to participate in the process to:</em></p>

<p>It is anticipated the make-up of the independent review panel will include
at least one retired Massachusetts judge; one or more clergypersons; one
or more retired professionals from the legal and accounting professions;
at least one current tenured professor; and an equal number of individuals
who have had little or no exposure to the proceedings dating back to the
fall of 2003. </p>
<p><strong>Please Note: </strong>The final make up of the Panel will not be
my decision as noted in my request for the MFDA to participate. Verifiable
Facts will be the foundation upon which the review will proceed with NO
limits to be placed on where and to whom the review goes to verify the facts
and draw conclusions of fact and not shear speculation.</p>
<p>As for the release of Public Records requested on April 24, 2007, the Division
of Professional Licensure continues to “stonewall” the process
believing they are above the law, and as such, have yet to release the 164
pages of Public Records requested. More in the next update.</p>
