<p>Before I share with you the preposterous allegations and accusations made
by Katherine Mangsen, treasurer, Nordgren Memorial Chapel to the State Board
in complaint EM-04-126 – a complaint the content of which serves as
a “prime” example of the far reaching conspiracy, corruption,
and cover-up by the State Board, its investigator, and those who now are
clearly implicated as co-conspirators in the process – corrupted because
they (the Board, the investigator, and government functionaries) were taken
in and believed a woman whose allegations and accusations were self-serving,
baseless in fact, and without merit.</p>
<p>On Friday, March 23, 2007 (after having returned from the International
Cemetery, Cremation, & Funeral Association EXPO on the red eye just
hours before), I stopped at the West Side Grill in Northborough for two
orders of the best fish & chips in New England. While waiting for my
order, a woman returning to the table where 3 of her friends were already
seated, said, “Phil, where’s Carolyn?” (in reference to
my wife). Explaining I was waiting for an order-to-go, she insisted I come
to her table and meet the others in her party. I agreed and was introduced
to 2 women I had not met before and one woman whom I had met, but knew little
about.</p>
<p>One of the women I had not met prior to that very moment stated, “Are
you the Phil Haddad from the web site – Justice at What Price?”
Before I could answer, the woman who invited me to the table declared, “Yes,
he is!” She then stated, “I have kept each of my friends up
to date on the happenings with Nordgren’s and the State – now
each of us read the updates regularly”. The other woman whom I had
not met previously stated, “that Nordgren Lady, the treasurer, (referencing
Katherine Mangsen) must be the devil in disguise”. “You know
the devil takes on whatever appearance that suits his purpose, and I’m
not kidding, she could be the devil”. My response, “Now, now
– go easy!”</p>
<p>Continuing on the woman said, “No I mean it! When the devil puts
his arms around you and you in turn do the same to others as that Nordgren
woman has done with the State Board and those people; they too become the
devil’s servants”. (All of a sudden my stomach got a bit queasy,
as the woman’s assessment did make sense).</p>
<p>Unfortunately, I couldn’t get the words spoken by these ladies out
of my mind. My appetite was gone. Was it possible Mrs. Mangsen was consumed
by the devil? Was it possible that those who were taken up with her mistruths
were now also consumed by and became co-conspirators with and for the devil?
My thoughts immediately turned to Mrs. Mangsen’s vicious and unjust
attack on Jack Carrigan, an owner and treasurer of Nordgren Memorial Chapel.
She initiated a complaint against Mr. Carrigan with the International Order
of the Golden Rule (Mr. Carrigan being a long-time member of OGR’s
Board of Directors) for supposedly stealing monies from the funeral home
– allegations that were never proven.<strong> <em>Does this scenario
sound strikingly familiar?</em></strong></p>
<p>To this day, I have the greatest respect for the International Order of
the Golden Rule (OGR), for <em><strong>unlike</strong></em> the State Board
and Division of Professional Licensure, OGR refused to get caught up in
a business dispute and discounted Mrs. Mangsen’s actions as irresponsible,
baseless, and without merit.</p>
<p>Let us now turn to complaint EM-04-126 filed by Mrs. Mangsen on December
24, 2003 (Christmas Eve) – the day before we celebrate the birth of
Jesus Christ. (Is there relevance to this date and the remarks by the woman
at the restaurant concerning the “devil-in-disguise”? It’s
an eerie thought, isn’t it?).</p>
<p>In complaint EM-04-126, reviewed by someone at the Division of Professional
Licensure, he/she/or they judged there was merit to the complaint and assigned
it a number (EM-04-126) and forwarded it to me for a response. Mrs. Mangsen’s
complaint read as follows:</p>
<ul>
<li> “I am filing this complaint against Philip G. Haddad, Jr. for
enticing people to move their pre-paid funerals to another funeral home.
Attached please see 2 examples of him contacting these people (his signature
as notary public proves this). Mr. Haddad was terminated on November 19,
2003. He had worked here since 1994. He is attempting to take what he
perceives as ‘his business’ with him. He is contacting the
people with whom he met while employed here at Nordgren and convincing
them to leave. I believe this to be unprofessional, unethical and illegal.
Please respond. Thank you.”</li>
</ul>
<p>The 2 examples to so-call “prove this” as Mrs. Mangsen so emphatically
stated were regarding the pre-arrangements for Freda Haddad (arranged by
her son, Edward) and T. Catherine Rizkalla (arranged by her daughter, Janet).
</p>
<p>I provided a detailed response to Mrs. Mangsen’s Christmas Eve complaint
to the State Board within the 10 days allotted to me to respond. Not ONLY
did the State Board and the investigator for the Division of Professional
Licensure totally disregard my “official” response to the complaint,
NO effort was made in Bresnahan’s so-called investigation to contact
either family to verify the veracity of Mrs. Mangsen’s allegations
and accusation made in the complaint now officially tagged EM-04-126. The
allegations made by Mrs. Mangsen, supposedly investigated by Bresnahan,
incorporated into an Order to Show Cause issued to me 6 months later, and
during the Administrative Hearing Mrs. Mangsen’s allegations, accusations,
and complaint in its entirety were proved to be false, baseless, without
merit, and totally a figment of Mrs. Mangsen’s uncontrolled imagination.</p>
<p><strong>How could this happen, you ask?</strong></p>
<p>Because Bresnahan, up till now, relied on support he had received from
the then Chairperson, Kazlauskas, Bresnahan did not see the need to contact
the families to determine if the content in Mrs. Mangsen’s complaint
had merit. Due to his extensive investigative training and experience, apparently
Bresnahan felt he needed ONLY to contact his friend, Kevin Mercadante (the
successor funeral director for the arrangements of the Haddad and Rizkalla
families) and NOT the families referenced in Mrs. Mangsen’s complaint.</p>
<p>Mr. Mercadante saw this as a wonderful opportunity to re-capture the Syrian/Antiochian
as well as other Orthodox funeral business, (some of which his funeral home
had served prior to my becoming a funeral director in Worcester) by stating
to Bresnahan that<em> “yes, it appeared to him that I influenced and
induced the Haddad and Rizkalla families to move their funeral arrangements
from Nordgren’s to his funeral home (Mercadante Funeral Home &
Chapel)”.</em></p>
<p>To further put the so-called “nail in my coffin” with the State
Board, Mr. Mercadante further stated to Bresnahan (according to Bresnahan),
that I attempted to enter into a financial arrangement with his funeral
home for the purpose of bringing pre-need funeral arrangements I had made
while at Nordgren’s to Mercadante Funeral Home & Chapel. Mr. Mercadante
even went a gigantic leap further and declared I attempted to do the same
with at least one other funeral home in Worcester.</p>
<p><strong>WOW! </strong></p>
<p>Would you believe that while under oath and subpoenaed as a “hostile”
witness for my defense, Mr. Mercadante <em><strong>suddenly was unable</strong></em>
to remember the name of the other funeral director with whom he alleged
I had attempted to establish a financial arrangement with for the purpose
of bringing families that I had made arrangements with to that funeral home.
Mr. Mercadante also was unable to remember who had supposedly told him or
when he supposedly heard this. Hmmmmmm!!!!!!!!!</p>
<p><strong>Read On!</strong></p>
<p>What Mr. Mercadante failed to say to Bresnahan and what Fr. Michael Abdelahad,
Pastor of St. George Orthodox Cathedral witnessed and heard on two (2) separate
occasions was<em><strong> “Mr. Mercadante declaring he wanted to buy
the prearrangements I had made with Orthodox Families”. My response
on both occasions was “they are not for sale!” </strong></em></p>
<p>(Was Mr. Mercadante’s unsolicited offer to buy pre-arrangements illegal
and in violation of the rules and regulations of the Commonwealth of Massachusetts?)
<br>
What more did Bresnahan need? Why contact anyone else, especially the family?
All they could possibly do was to disprove Mrs. Mangsen’s allegations
and assertions and that of his friend, Mercadante – and we wouldn’t
want that – so Bresnahan had all he needed in order to <u><em><strong>script
</strong></em></u>his investigation to support Mrs. Mangsen’s complaint.</p>
<p><strong>Or Did He?</strong></p>
<p>Two (2) years and $2M of taxpayer dollars later (not including $700K on
my behalf), Mr. & Mrs. Mangsen, while attending the Administrative Hearing
in Boston, witnessed and listened to the testimony of Edward Haddad and
Janet Forzley, wherein they declared under oath that the decision to transfer
the prearrangements for their loved ones was their decision and their decision
alone. I asked both Mr. Haddad and Mrs. Forzley if they had ever met, had
a conversation, or ever communicated with Mr. or Mrs. Mangsen. Their respective
responses – <strong>“NO!”</strong> I asked each to turn
around and take a look at the man and woman sitting behind them and did
they recognize either the man or woman? Their respective answers were <strong>“NO!”</strong>
I, then stated, “they are Mr. & Mrs. Mangsen.”</p>
<p>Neither Mr. nor Mrs. Mangsen looked at Mr. Haddad or Mrs. Forzley at that
moment; and my attention was focused on Attorneys Read and Alexander as
well as the Administrative Hearings Counsel, Colleton. You had to see the
look on each of their faces! At that moment, if not before, all three (3)
knew I was set up by Katherine Mangsen and any possibility for a fair, just,
and impartial investigation and hearing had been thwarted from the “get-go”
by Bresnahan, and Board Chairman, Kazlauskas’s statements and actions
and Mrs. Mangsen’s baseless allegations and assertions.</p>
<p>Mrs. Mangsen’s allegations and assertions, accepted as fact by a
biased and prejudiced State Board and its Chairperson as well as the Division
of Professional Licensure’s investigator, have been determined to
be false facts, wrongful facts, and disproved facts – for which her
husband has been publicly admonished by the Administrative Hearings Counsel.
</p>
<p>It has been suggested to me that as this situation (dating back to November
19, 2003 to the present) is officially reviewed <strong>(and it will be)</strong>,
that Mrs. Mangsen allegations, assertions, assumptions, and actions taken
as a result thereof may well be “career ending” for as many
as 12 fairly high level state employees. </p>

<p>I ask you, Mr. and Mrs. Mangsen “How does one live with this, knowing
they <em>unjustly destroyed not only their own names and reputations, but
the careers and livelihoods of several others</em>?”</p>
<p>With Holy Week about to begin, and out of my deep respect for the meaning
and celebration of the Resurrection of Jesus Christ, I have decided to wait
until <strong>Tuesday, April 10, 2007</strong> to present the next Update
– the subject – </p>
