<p>How timely the subject of this update? How appropriate the name –
<strong>Justice at What Price!</strong> As I’m sure you are aware
by now, the International Cemetery, Cremation, & Funeral Association
featured Westland Services Corporation in the February Edition of its ICCFA
Magazine –the feature article being 4+ pages in length and included
six (6) photographs of the work performed by Westland. The positive response
to the article has been truly overwhelming and supportive beyond our wildest
expectations. On first blush (although it is still too early to make assumptions
or draw conclusions), it appears that just maybe there is movement by funeral
homes that were “in the stands watching the game being played on the
court” now realizing that their survival depends on their active participation
in the game being played. There is one exception, though, that being <strong>“The
Funeral Monitor”</strong>! </p>
<p>The publication (Funeral Monitor) its editor and publisher are so “disjointed”
and out of touch with reality that “if it is not Ron Hast’s
idea, if it is not Ron Hast’s project, or if it is not Ron Hast’s
vision – its value is only worth an attack in his <strong>‘supermarket
tabloid’ publication”</strong>. Yet they ask, suggest, and beg
funeral directors to buy “stuff” from them because they supposedly
know what is best for you. I guess it is true, “suckers are born every
day”, and some (hopefully few) have taken up residence in funeral
service. </p>
<p>I do NOT challenge one’s right to free speech, and I do NOT challenge
the right of freedom of the press; even if it is the<em> “industry
supermarket tabloid publication” </em>referenced above. Quite frankly,
the recent article in this less than honorable publication on February 19,
2007, has elicited many readers to email me with their personal observations
and comments, which I shall share with you and the “industry”
in a few short weeks – so stay tuned.</p>
<p>More than three (3) years and $2M of taxpayer dollars later, the State
Board of Registration of Funeral Directors and Embalmers in the Commonwealth
of Massachusetts has yet to render a decision on the merits of three (3)
complaints filed with the Board by Mrs. Katherine Mangsen, wife of Kurt
Mangsen, majority owners of Nordgren Memorial Chapel in Worcester, MA. The
State Board, without benefit of a review of the accuracy of the content
of the complaints or the responses to the complaints filed by the Respondent
(Haddad) – responses that to this very day demonstrate Mrs. Mangsen
acted with malice and did in fact intentionally provide mistruths to the
State Board in the complaints, and you have a “conspiracy” and
subsequent attempt at cover-up reminiscent of blatant corruption of yesteryear.
State Employees, from the Director, Division of Professional Licensure to
prosecution attorneys, to Chief Counsel for the Division of Professional
Licensure, to supervisors of the government functionary (investigator) all
dropped the ball and missed (or intentionally turned their heads) rather
than react to clear signs of corruption in this process. <strong>Abuse and
Misuse of “Perceived” Power – YOU BET!!</strong></p>

<p><strong><u>“Allegations made! Allegations disproved! What now?”</u></strong></p>
<p>As I continue to present ONLY facts, tested and truthful; let us take a
moment and understand the definition of the word – “allegation”.
</p>
<p> “An <em>Allegation</em> is a statement of a fact by a party in a
pleading, which party claims it will prove. <em>Allegations</em> remain
assertions without proof, only claims until they are proved”.</p>
<p>Kurt and Katherine Mangsen and Ronald Johnson made frivolous allegations
to and in the presence of Members of the State Board of Registration of
Funeral Directors and Embalmers, State Board attorneys and employees, and
the public in attendance at a State Board Meeting on December 9, 2003. Further
frivolous allegations were subsequently made to the State Board in three
(3) complaints – also filed by Mrs. Mangsen between December 2003
and April 2004 - allegations that have now been disproved after more than
3 years and the expenditure of $2M of taxpayer dollars in this “witch
hunt” to support Mrs. Mangsen’s allegations. </p>
<p>Why would a governance body (State Board) and the Division of Professional
Licensure champion that which the naked eye could see was frivolous and
without merit from the outset? One need ONLY listen to the taped remarks
(or transcript ) of the State Board Chairperson at the time (John Kazlauskas)
to see that the State Board and Division of Professional Licensure had,
but two (2) choices. They could acknowledge the bias and prejudice of its
Chairperson and investigator, and acknowledge the allegations of Mrs. Mangsen
were corporate in nature related ONLY to a business dispute and having <em><strong>NO</strong></em>
basis in fact to be accepted by the State Board, OR they could initiate
a “witch hunt” in an attempt to defend Mrs. Mangsen’s
allegations and therefore dilute the disparaging, biased, prejudiced and
impartial statements of its Chairperson (Kazlauskas) and investigator (Bresnahan).
</p>
<p>The State Board and Division of Professional Licensure sadly elected the
second option to initiate a “witch hunt”; to attempt to “force
fit” false allegation now proven to be false facts into a process
created ONLY to protect Public Health, Public Welfare, and Public Safety.</p>
<p>Mrs. Mangsen must now realize (as does Mr. Johnson and Mr. Mercadante)
that there are <strong><em>consequences</em></strong> for actions taken
and statements made that are false, are disproved, and made solely for the
purpose of unjustly harming my name, my reputation, my occupation, and ability
to earn a livelihood in my chosen profession. The State Board and Division
of Professional Licensure need to take note as well; for they too, are to
be held accountable for their bias, their prejudice, and their misdeeds
absent facts and proof.</p>
<p>Kurt Mangsen, president and CEO, Nordgren Memorial Chapel from 1996 to
the present declared to the State Board on December 9, 2003, as did his
wife, Katherine (who ONLY became treasurer at the funeral home in mid 2002)
, that he (and she) had never heard of Columbian Life Insurance Company
until the fall of 2003. That he (Kurt Mangsen) was unaware of the conversion
process identified by Columbian Life Insurance Company in the summer of
1999 and implemented on behalf of Nordgren Memorial Chapel ONLY after the
process was approved by the then treasurer and owner, John Carrigan –
not to mention a conversion process that was reviewed and approved by both
Family Bank and Columbian Life Insurance Company. </p>
<p>Mrs. Mangsen, in three (3) separate complaints subsequently filed with
the State Board, restated the same position – that she, now treasurer
of Nordgren Memorial Chapel for more than 18 months, had NO knowledge of
the existence of Columbian Life Insurance Company.</p>
<p>Evidence was presented during the Administrative Hearing more than 2 years
after statements were made by Mr. & Mrs. Mangsen and complaints filed
by Mrs. Mangsen denying any knowledge of the existence of Columbian Life
Insurance Company that Nordgren Memorial Chapel had been paid directly by
Columbian Life Insurance Company the sum of $114,000+ from 1999 through
November 2003 for preneed funeral arrangements wherein the insured had passed
on. Not ONLY were the statements and allegations made by both Mr. &
Mrs. Mangsen clearly contrary to the evidence presented and facts verified,
the State Board investigator made NO effort to verify the veracity of the
assertions made by Mr. and Mrs. Mangsen during his “supposed”
investigation.</p>
<p>On March 31, 2006 during the 3rd day of hearings in the Administrative
Process, Kurt Mangsen, president and CEO of Nordgren Memorial Chapel for
more than 10 years and the 2nd generation of Mangsen’s serving in
this position, was admonished by the Administrative Hearings Counsel for
stating that he had no knowledge of Columbian Life Insurance Company and
yet his funeral home had received very significant sums from Columbian Life
Insurance Company for more than 4 years. </p>
<p>Kurt Mangsen was further admonished by the Administrative hearings Counsel
for making statements of fact, but not being able to recall when, where,
and from whom he heard these statements.</p>
<p><strong>NO</strong> proof was offered at the Administrative Hearings by
CEO, Kurt Mangsen or Treasurer, Katherine Mangsen, Nordgren Memorial Chapel,
in its complaints filed with the Board against me; complaints filed subsequent
to my firing from the business, to support the validity of their actions.
CEO Mangsen was admonished by the Administrative Hearings Counsel for the
dearth of evidence that he failed to present and attest to in his testimony
in support of Nordgren’s Complaints. Such paucity of evidence by CEO
Mangsen undercut the Inspector’s ability to investigate the validity
of the complaints with certainty and proof required for the Board’s
proceedings, and rendered it impossible for the Board to find me guilty
of anything. CEO Mangsen demonstrated he was a non- credible witness and
Nordgren’s Complaints could not be proved.</p>
<p>Kurt Mangsen and his wife, Katherine, not ONLY dishonored themselves, but
dishonored a system of government by corrupting others by stating intentionally
as fact that which they knew to be false. Their allegations were not proved.
They clearly demonstrated their assertions were baseless and without merit.
Kurt and Katherine Mangsen implicated families in this process that had
lost loved ones; thereby forcing them to come to Boston, to relive the loss
and trauma they experienced at the time their loved ones had passed, and
to testify under oath that not only were the allegations presented by the
Mangsen’s mistruths, not a single family referenced either knew the
Mangsen’s or were ever contacted by the Mangsen’s.</p>
<p>In summation for this update, I am a firm believer that – “<strong>A
Day is a Span of Time NO ONE is wealthy enough to waste!”</strong></p>
<p>Although I do not believe the entire 1,201 days that have passed since
Kurt and Katherine Mangsen abruptly and without cause terminated my employment
at Nordgren Memorial Chapel on November 19, 2003 (for I have learned great
deal about the laws of this great country and its judicial system during
this time) to be a total waste, the unjust harm to my name, to my reputation,
and to my economic well being will never be restored due to callous and
frivolous allegations and a corruptive process of adjudication.</p>
<p>It is time to present the findings and reveal the testimony of witnesses
that clearly demonstrates that not ONLY were the Mangsen’s less than
truthful in their allegations to the State Board and in their complaints
filed with the Board; but their motives in doing so discredited themselves,
discredited an Administrative Hearings Process, discredited a system of
government, and whose actions resulted in severe personal and economic harm
to Respondent.</p>
