<p>Funeral Director “lies” have been proven! State Functionaries
bias, prejudice, and unethical actions have been proven! State Governance
Board’s inappropriate actions extremely well documented and proven.
State Division of Professional Licensure Prosecutors involved in a desperate
attempt to find something to convict me of while attempting to focus the
attention away from their incompetence and that of state functionaries corrupted
from the outset by statements of State Governance Board of Registration
of Funeral Director’s Chairperson – John J. Kazlauskas.</p>
<p>How will the waste of <strong>$1.7M (est.)</strong> of State resources
(taxpayer real dollars) on a fabricated <strong>“Witch Hunt”</strong>
dog the presidency bid of Mitt Romney – who was aware of the issues
from the outset (documentation in hand)?</p>
<p>How will this issue be handled by newly elected Governor Deval Patrick
and newly elected Lt. Governor Tim Murray – especially in light of
the involvement of funeral directors in Mr. Murray’s home town of
Worcester and the fact that Mr. Murray’s newly appointed Chief-of-Staff,
James Leary, is and was aware of the issues as a State Representative within
the district I reside prior to recently being appointed to his new position
by the Lt. Governor?</p>
<p>With the coming of this new year – 2007 – and with new and
refreshing leadership in the Commonwealth, I suggest to you “It’s
time to Change and We are the Change” as quoted by Governor Deval
Patrick during his recent inauguration on the steps of the State House.
As such, I present (actually suggest and propose) “New Years Resolutions”
for the following perpetrators of the insidious crimes of corruption, conspiracy,
incompetence, and cover up in state government as well as by so-called funeral
service providers who are a disgrace to their profession and a black eye
to the overwhelming majority of dedicated and caring funeral directors forced
to carry and bear the negative burden of the actions of a few of their contemporaries.</p>
<p><strong>Katherine Mangsen</strong> – (certainly not a funeral director,
but treasurer of Nordgren Memorial Chapel in Worcester). “In hoping
that I will not be held personally, professionally, and financially accountable
for my false and misleading allegations, accusations, statements and actions
that have adversely impacted State Government officials and permanently
and adversely impacted the lives of families that have lost loved ones in
recent times and referenced in my misguided complaints (not to elaborate
on what impact my statements and actions have had on Mr. Haddad), <strong>I
Resolve</strong> to change my ways and get all the facts before making accusations,
allegations, or determinations about anyone; realizing full well that I
WILL be held accountable for my statements and actions.” (<em>Although
just basic good judgment one would think and not a very difficult resolution
to make and adhere to; if past history is any indication, this resolution
may well be a difficult challenge for Mrs. Mangsen</em>).</p>
<p><strong>Ronald Johnson</strong> – “<strong>I Resolve</strong>
to learn the difference between Fact (reality) and Fiction (make believe)
before the Good Lord calls me to assume my place in the next life, and to
volunteer only that which I know to be factual – and not a figment
of my wild imagination.” (<em>I don’t know if there is, but
there ought to be a special place in hell for perpetrators who unjustly
attack others for their devious and misguided rationale – Mr. Johnson’s
statements and actions being beyond my ability to comprehend and understand
the “whys” for his actions</em>).</p>
<p><strong>Kevin Mercadante</strong> – Although I shall soon dedicate
an entire Update to Mr. Mercadante, the rationale for his statements and
actions, why the State Governance Board did not call him as a prosecution
witness (although he was referenced extensively in a complaint filed by
Mrs. Mangsen and investigated by state functionary, John Bresnahan), why
I called him as a “hostile witness” for my defense, his relationship
with Very Rev. Fr. Michael Abdelahad (Pastor, St. George Orthodox Cathedral)
and how his actions have generated significant new found funeral business
within St. George Orthodox Cathedral as a result of his personal and vindictive
statements and actions with and before the State Governance Board; I would
be remiss if I did not suggest (propose) a New (forget New Years) resolution
for Mr. Mercadante’s approach to life and business before he too assumes
his reserved place in “a” next life. “<strong>I</strong>
(Kevin Mercadante) <strong>Resolve</strong> to seek and hopefully find honor
and integrity in my business and personal life, if possible (it may be too
late), and not attack others unjustly for my personal ego and financial
gain; understanding full well that to do so will mean a major realignment
and readjustment in my life, my life style, and how I am perceived by others
in Funeral Service.”</p>
<p><strong>David Pickering</strong> – “<strong>I Resolve</strong>
to be true to myself so that I can be true to others.” (<em>David,
being honest and true to yourself doesn’t mean walking away from issues,
but confronting them head on with honor and integrity and not stopping short
through fear</em>).</p>
<p><strong>James Read </strong>– “<strong>I Resolve</strong> to
find the true meaning and purpose of being a Prosecutor and attorney in
government service – specifically attempting to understand that it
is not my role to prosecute an individual at any cost even when it is abundantly
clear that the individual is innocent of the charges brought against him/her;
and that to attempt to cover up irresponsible acts by government functionaries
who presented less than true and accurate facts for the prosecution compromises
me and the integrity of government and serves as an abuse of the Public
Trust”. “<strong>I</strong>, further <strong>Resolve</strong>
that if I am unable to find the true meaning and purpose of being a Prosecutor
and attorney in government service and adjust to this role, I shall immediately
resign from government service and attempt to find meaning and purpose in
the private sector”. (<em>Attorney Read, I wish you well in this challenge
and purposeful journey</em>).</p>
<p><strong>Leslie Alexander</strong> – “<strong>I Resolve</strong>
to search my soul to determine whether or not I wish to (or should) be a
Public Prosecutor – or a prosecutor at all. In the meantime, <strong>I</strong>,
further, <strong>Resolve</strong> to learn the accurate definition of the
word <strong>“Moot”</strong> and its appropriate use; fully
realizing that the passing of an individual in an action does not mean the
action did not occur and that responsibility for the action by a person
in an appointed position of authority just goes away”. (<em>Attorney
Alexander, it is obvious to me that you have been unjustly thrust into a
position well in excess of your experience and abilities – and certainly
not your fault. What you have witnessed through these proceedings accompanied
by the lame summation to which you affixed your name along with Attorney
Read I hope has not permanently corrupted you as it certainly has others
in the system. Best wishes for a thorough assessment of who you are and
where you wish to go</em>).</p>
<p><strong>Anne Colleton</strong> – <strong>I Resolve</strong> to distinguish
between the role of an Administrative Hearings Counsel (Judge) and a Prosecutor
and to realize that it is improper for me to act or attempt to act in both
roles and both capacities at the same time in any proceedings. (<em>After
a thorough review of the proceedings by independent entities familiar with
administrative proceedings, and what was unsettling to several of the witnesses
called to testify as well as legal experts now familiar with the case was
“Who was supposedly the Judge (Administrative Hearings Counsel) and
who was the Prosecutor and were they aware of their responsibilities in
their specific roles? I, too, had the same reaction in many instances during
the Administrative proceedings</em>).</p>
<p><strong>John Bresnahan</strong> – <strong>I Resolve</strong> to be
a man, to admit to the fact that I was biased and prejudiced by remarks
and statements of others (specifically Mr. Kazlauskas, Mrs. Mangsen, and
Mr. Mercadante) and that I conducted less than a fair, accurate, and complete
investigation compromising the integrity and honor of a process I swore
to uphold. <strong>I</strong>, further, <strong>Resolve</strong> that to
do anything less would be a curse on me personally, a curse on a system
designed to protect the integrity of funeral service, and a curse that will
haunt me every day for the rest of my life and yield me ineffective to continue
as a public servant in any capacity.</p>
<p><strong>Kathy Cartmell-Sirrico </strong>– “<strong>I Resolve
</strong>to correct a grave injustice to which I was a party (prominent
player) realizing now that the document I signed was based upon inaccurate
facts and information, and that to do less would further dishonor and discredit
funeral service and the many families that were publicly and privately traumatized
as a result of the document I signed, with families being compelled to relive
the loss of loved ones in Administrative proceedings as a result of my participation
in this process.” (<em>Ms. Cartmell-Siricco, your name and reputation
will be clearly scripted forever by your actions in support of truth and
justice and the adoption of this resolution</em>).</p>
<p><strong>George Weber </strong>– As Director of the Division of Professional
Licensure with responsibility for the actions of employees of the Division,
<strong>I Resolve</strong> to initiate “Ethics Training” by
an independent contractor specializing in “Ethics in Government”
for every employee, every appointee, and every person or persons with any
association with and for the Division of Professional Licensure –
a certificate of successful accomplishment to be issued to and signed by
each individual on an annual basis. <strong>I</strong>, further, <strong>Resolve</strong>
to hold accountable each and every employee, appointee, or individual within
the Division of Professional Licensure to the highest ethical standards
in the performance of their duties and responsibilities and the faith and
trust empowered and expected of us in support of the public trust.”
(Mr. Weber, it is never too late to correct injustices within the perimeters
of your authority, and to do less is a violation of the oath you undertook
when assuming the position of Director of the Division of Professional Licensure).</p>
<p><strong>Charles “Chuck” Borstel</strong> – As Assistant
to the Director of Professional Licensure, <strong>I Resolve</strong> to
read that which is prepared for my signature, to determine its accuracy
by reviewing in depth that which I am about to sign and to assure it makes
sense to me and will make sense to the recipient, and to respond in a timely
fashion to requests for information – be it from a taxpayer of the
Commonwealth or the Administrator of Public Records, Office of the Secretary
of State. (Mr. Borstel, one should not have to adopt this resolution, for
common sense and professional responsibility would dictate this as the minimum
requirement of this or any position in government service).</p>
<p><strong>Helen Peveri</strong> – As Executive Director,<strong> I
Resolve</strong> to reacquaint myself and to then arrange for all employees
within the Division of Professional Licensure and for whom I have responsibility
to be adequately trained in the preparation of the “Application for
Complaint” assuring that the basic tenants of the document are completed
as clearly stated on the “Application for Complaint.” <strong>I</strong>,
further, <strong>Resolve</strong> that in the event any portion of the “Application
for Complaint” is too complex for the average person to understand
and complete accurately that I will see to it that the “Application
for Complaint” is re-written and re- formatted so as to be clear and
precise to the lay person completing an “Application for Complaint”.
(<em>Ms. Peveri, I have at least 2 examples of inconsistencies for you should
you require same</em>).</p>
<p><strong>Kim Scully</strong> – “As Assistant Executive Director,
<strong>I Resolve</strong> to be honest with myself and those I supervise
and to set a positive example by acknowledging that which I do wrong as
well as the wrong doings of those I supervise.<strong> I</strong>, further,
<strong>Resolve</strong> to acknowledge receipt of documents known to me
and others, wherein I have gone on the record as stating that the documents
were never received, and wherein I have put the names, reputations, and
careers of nor only myself but others on the line as a result of my inappropriate
actions.” (<em>Ms. Scully, you know of what I reference as does Ms.
Buchanan. Give this resolution some very serious consideration</em>).</p>
<p><strong>Christopher Carroll</strong> – “As Legal Counsel to
the State Governance Board on December 9, 2003 and supervisor of Mr. Bresnahan
soon thereafter, <strong>I Resolve</strong> to acknowledge my frailties
in allowing the State Governance Board Chairperson to inappropriately verbally
attack a licensed funeral director without provocation, to allow him to
inappropriately reinstate his authority and position as Chairperson of a
session wherein he had recused himself, and for signing off on an investigation
report submitted to me without first verifying its accuracy. <strong>I</strong>,
further,<strong> Resolve</strong> to respond in a timely manner to inquiries
from respondents and respondent’s attorneys and not ignore them as
if they were never received. <strong>I</strong>, further, <strong>Resolve</strong>
to restore honor and integrity to the position I hold and that which is
expected of me, to be held accountable for my actions or lack thereof during
the past 38 months, or otherwise resign my position immediately for my irresponsible
actions dating back to December 2003.” (<em>Atty. Carroll, your actions
and lack thereof leave a great deal to be desired, but more importantly
reflect poorly on your judgment in the positions you have held since December
9, 2003. The record is clear and well documented. I sincerely hope you take
this proposed resolution very seriously. Your name and reputation are dependent
upon it</em>).</p>
<p><strong>Tracy Mitchell</strong> - “As a volunteer Government Expert
Funeral Service Witness and a licensed funeral director, <strong>I Resolve</strong>
to learn more and to be better informed of matters and issues, questions
to be asked of me in proceedings wherein I agree to serve as an “expert
witness”, and to be assured I am adequately prepared, educated, and
exposed to all the facts in a case prior to agreeing to serve in this capacity.
<strong>I</strong>, further, <strong>Resolve</strong> to be more prudent
in agreeing to be positioned as an “Expert Witness” in matters
of which I have little or no experience or expertise. <strong>I</strong>,
further, <strong>Resolve</strong> to assure that I never put myself in a
position wherein I am provided with limited information, limited facts,
and limited background documentation; thereby subjecting myself to humiliation
for being less than fully prepared to address questions posed to me.”
(<em>Mr. Mitchell, if you have not had the opportunity to read your testimony
under oath, I shall be pleased to provide it to you. You were comprised
time and time again, with statements such as “I don’t know,
but in my estimation….”. Please give this resolution serious
consideration</em>).</p>
<p><strong>Kurt Mangsen</strong> – I Resolve to become a husband to
my wife, and a father to my children by first finding honor and integrity
by becoming a man. <strong>I</strong>, further, <strong>Resolve </strong>to
free myself once and for all from the baseless lies and unsubstantiated
statements I have made as a result of misleading information provided to
me by others while at the same time I was not being truthful to those around
me. (<em>Kurt, as I see it, you have no choice, but to take this resolution
very seriously</em>).</p>
<p><strong>Kathe Mullally</strong> – As Chief Legal Counsel, Division
of Professional Licensure, <strong>I Resolve</strong> to do what is right
and just; to not allow corruption by corrupt persons within the Division
to invade or compromise the integrity of the Division, its mission, and
its purpose; while at the same time objectively reviewing and resolving
issues I know to be in conflict with fairness and impartiality blatantly
couched in bias and prejudice – clearly visible to the naked eye.”
(<em>Atty. Mullally, I am prepared to present to you 2 documents over your
signatures that are false in content and without merit in fact, which gives
great credence to the value of this resolution and which is the foundation
upon which your position was created</em>).</p>
<p><strong>Scott Sinrich</strong> – “As legal counsel for Nordgren
Memorial Chapel, <strong>I Resolve</strong> to not accept statements of
fact presented to me by Kurt and Katherine Mangsen or Ronald Johnson without
personally verifying the accuracy of the statements. <strong>I</strong>,
further, <strong>Resolve</strong> to set the record straight by retracting
statements made to the State Governance Board verbally and in writing that
I knew then and know now were not truthful, were not accurate, and were
blatant lies.” (<em>Atty. Sinrich, the Oath you took upon becoming
a lawyer necessitates the adoption of this resolution. Swallow long and
hard, do what is right and just, and you will find that honor and integrity
feels real good</em>). </p>
<p><strong>Daniel Fischer</strong> – “As Vice President and Chief
Legal Counsel, Columbian Financial Group and Columbian Life Insurance Company,
Binghamton, NY, <strong>I Resolve</strong> to acknowledge and support Columbian
Life Insurance Company employees when and where appropriate and to acknowledge
actions of employees that were/are less than appropriate. <strong>I</strong>,
further, <strong>Resolve</strong> to meet with the State Governance Board,
Commonwealth of Massachusetts in an attempt to address any and all concerns
the State Governance Board may have – especially in light of the fact
that the concerns may well impact other arrangements that have been made
with numerous other funeral homes throughout the Commonwealth.” (<em>Atty.
Fischer, you, and specifically Columbian Financial Group, cannot walk away
from this issue as if you have no vested interest in its resolution. Columbian
Financial Group’s name and reputation and future are dependent upon
the integrity brought to the resolution in this matter. Let me suggest to
you, funeral service providers throughout the country are watching with
great interest</em>).</p>
<p>I am encouraged to present on this site the Post Hearing Briefing (summation)
prepared and submitted by the Prosecution as well as the Post Hearing Briefing
I submitted as the Respondent. Quite frankly, I was hoping this would not
be necessary, for each and every word in my responses to the complaints
filed by Mrs. Mangsen have been validated by witnesses for both the Prosecution
as well as for my defense. I have personally expended approximately one-third
(1/3) of the estimated $1.7M expended by the Commonwealth of Massachusetts
for this “Witch Hunt” and attempt at a “Character Assassination”.
I am not now nor have I ever been prepared to walk away from the truth and
the facts or the misguided statements and actions of disjointed funeral
directors and corrupted government functionaries and government appointees.
To think for a moment, Columbian Financial Group wants to hide from the
facts and for being held accountable for possible inappropriate actions
on behalf of its employee(s) at my expense is reprehensible to me and a
wake up call for the public and funeral service nationwide.</p>
<p>I have shared all documents, testimony, audio tapes, and information assembled
over the past 38 months with psychology, sociology, and legal scholars and
educators to help me understand how and why the aforementioned referenced
individuals acted as they did and with what purposes were to be gained by
their actions. I shall share their comments and observations with you in
the near future. Their comments and observations are eye opening, I assure
you.</p>
