<p>It was just 1096 days ago today (November 19, 2003) that John Bresnahan,
investigator for the State Board of Registration of Funeral Directors and
Embalmers, sold his soul and disgraced the honor and integrity of the oath
of office he swore to uphold when he was appointed as an investigator for
the Division of Professional Licensure. The disgrace he has brought upon
the Commonwealth of Massachusetts does not stop here. The disgrace has permanently
impacted funeral service in Massachusetts as Mr. Bresnahan bought into lies,
deceit, and corruption initiated initially by Katherine Mangsen, treasurer
and Ronald Johnson, funeral director and member of Nordgren Memorial Chapel’s
Board of Directors.</p>
<p>If the aforementioned wasn’t bad enough, enter the Chairperson of
the State Governance Board, John J. Kazlauskas, (who just so happened to
be a funeral director in Worcester, where I too practiced as a funeral director)
and his vicious personal and professional attack on my character and integrity
in my absence to the entire Governance Board addressing me as a “Snake”
and a “Carpetbagger” on December 9, 2003, and you have the makings
of an attempted “character assassination” funded at the expense
of the taxpayers of Massachusetts. Finally realizing the proceedings were
being recorded, Mr. Kazlauskas attempted to have Ms. Scully, Assistant Executive
Director of the State Governance Board delete his remarks from the record;
but thanks to a consumer advocate recording the proceedings, it was too
late.</p>
<p>Every member of the Governance Board including good old Mr. Bresnahan hopped
on the “band wagon” being prejudiced by Mr. Kazlauskas’s
remarks. Mr. Bresnahan even took the opportunity to address me as a “scavenger”,
and yet moments later when he was asked to invite me into the meeting on
December 9, 2003, his comment was “I’ve never laid eyes on the
man”!</p>
<p>Let us now go directly to the facts!</p>
<p><strong>FACT</strong> - From 1967 when I first became licensed as a funeral
director to November 19, 2003 when Kurt Mangsen, without notice and without
affording me the opportunity to respond to concerns raised by Mr. Bresnahan,
terminated my employment at Nordgren Memorial Chapel and to this very day
(November 19, 2006); there has NEVER been a complaint filed against me by
any family I have served – be it at-need or pre-need!</p>
<p><strong>FACT</strong> - From 1967 when I first became licensed as a funeral
director to November 19, 2003 when Kurt Mangsen, without notice and without
the opportunity to respond to concerns raised by Mr. Bresnahan, terminated
my employment at Nordgren Memorial Chapel and to this very day (November
19, 2006); there has NEVER been one (1) dollar ever misappropriated or alleged
or proven to be misappropriated by me or anyone at Nordgren Memorial Chapel..</p>
<p><strong>SO WHAT IS THE ISSUE(S) THAT HAS CONSUMED IN EXCESS OF $1.5 M OF
PRECIOUS TAXPAYER DOLLARS IN THE PAST 3 YEARS – NOT TO MENTION MY
OUT OF POCKET COSTS AND LOST INCOME EXCEEDING $500K?</strong><br>
<br>
<strong>FACT</strong> - Kurt and Katherine Mangsen, owners of Nordgren Memorial
Chapel and their attorney, Scott Sinrich, (Phillips Silver, Talman, Aframe,
& Sinrich, P.C. in Worcester) lied to the State Governance Board on
December 9, 2003 stating that I took original documents from pre-need funeral
arrangement files. At this point there was no complaint before the State
Governance Board. Their distorted statements and lies were accepted as factual
by the Governance Board. Three (3) years later and seven (7) full days of
hearings have yielded not a single bit of proof nor a single person to verify
the veracity of the statements made by the Mangsens, Ronald Johnson, or
Nordgren’s attorney that the files that were housed at Nordgren Memorial
Chapel, unlocked and under the watchful eye of Nordgren Memorial Chapel
that I took documents from pre-need files. Vicious and malicious lies presented
to the State Governance Board, accepted as fact without verification, and
conclusions made by a biased, prejudiced, and corrupt investigator.</p>
<p>In Massachusetts we have a system of “checks and balances”
and as such there are layers of review of the facts in order for justice
to prevail. Mr. Bresnahan had a series of at least three (3) different supervisors
over a 5 month period whose administrative functionary role was to verify
the veracity of the facts and conclusions drawn by the investigation prior
to a recommendation being made to the Governance Board. What we have is
a <strong>TOTAL SYSTEM FAILURE! </strong></p>
<p><strong>FACT </strong>– I am accused of sending a misleading and
deceptive letter to families in the spring of 1999 - families that had expressed
concern after receiving a 1099 tax form for interest generated on funds
that were put into trust for prearrangements. A draft of the subject letter
was presented to me by Columbian Life Insurance Company’s district
sales representative, Peter Klamkin. The letter was reviewed by John F.
Carrigan, treasurer, Nordgren Memorial Chapel, with grammatical adjustments
made. The letter was then reviewed and approved by a Vice President and
Senior Trust Officer at Family Bank in Fitchburg, MA where the funds were
deposited in trust. With adjustments and modifications made as a result
of input from the aforementioned parties, the letter then went back to Columbian
Life Insurance Company Office of Legal Counsel for a final review. </p>
<p>The supposedly misleading and deceptive letter was mailed to 30 + families
that had at one time or another questioned the 1099 tax form they received
each January as a result of interest earned on their pre-arrangements for
the previous year. Roughly, 20+ (I can’t state exactly how many, because
Nordgren Memorial Chapel and the Mangsen’s have locked me out of the
funeral home and since November 19, 2003 I have not had access to any of
the records referenced or mishandled by Nordgren Memorial Chapel or the
Mangsens) families agreed to a conversion from trust to insurance with Columbian
Life Insurance Company by signing an authorization to do so. Approximately
25-30% of the families receiving the subject correspondence chose NOT to
convert from trust to insurance. </p>
<p><strong>FACT</strong>- On December 9, 2003, (exactly 20 days after the
inspection by John Bresnahan and 4 ½ years since the aforementioned
letter was mailed out from Nordgren Memorial Chapel and signed by me), John
Kazlauskas, Chairperson of the State Governance Board read the aforementioned
letter from a pre-need funeral arrangement file NOT reviewed by Mr. Bresnahan
during his inspection on November 19, 2003, and NOT reviewed by Mr. Bresnahan
prior to his presentation to the State Governance Board on December 9, 2003.
The government functionary, Mr. Bresnahan, and the State Governance Board
chairperson, Mr. Kazlauskas, who conveniently passed 15 months later and
without my being able to confront him for his vicious, malicious, and defaming
remarks as well as to determine whether it was Mrs. Mangsen or Mr. Kazlauskas’s
dear friend, Mr. Johnson, who gave Mr. Kazlauskas the letter from a file
never before seen by Mr. Bresnahan, conspired in an attempt to discredit
me, my name, and 37 year exemplary reputation as a funeral director in the
Commonwealth of Massachusetts.</p>
<p><strong>FACT</strong> – The inspector, Mr. Bresnahan, and the State
Governance Board have taken issue with the process and procedure established
and created by Columbian Life Insurance Company and its representative –
a process and procedure that had been in place since the summer of 1999
(4 ½ years prior). My comments to the State Governance Board was
and is to this day, “if there is a problem with the process, let’s
have Columbian Life Insurance Company and its former Regional Sales Representative,
who became Vice President and National Director of Pre-Need for Columbian
Life Insurance Company in the fall of 1999 and held the position for several
years, to come forward and clarify the process and answer any questions
the State Governance Board had”.</p>
<p>The State Division of Professional Licensure, through its prosecution attorney,
agreed to me subpoenaing Columbian Life Insurance Company and Mr. Klamkin,
knowing full well what I did not know at that time, that Columbian Life
Insurance Company and Mr. Klamkin did not have to honor a subpoena because
they resided outside the Commonwealth of Massachusetts.</p>
<p>Needless to say, Columbian Life Insurance Company got <strong><em>“cold
feet”</em></strong> and declined to honor the subpoena to appear at
a scheduled hearing in Boston or to send a representative. Columbian Life
Insurance did agree to a deposition in Binghamton, NY; but the Division
of Professional Licensure’s prosecution attorney, James Read, along
with the strong backing (as always) of Ms. Colleton, the Administrative
Hearings Counsel, refused to allow the testimony (via deposition) by Columbian
Life Insurance Company – apparently aware that any testimony to the
process followed would clearly show the incompetence of Mr. Bresnahan and
his flawed investigation.</p>
<p><strong>TO ALL FUNERAL DIRECTORS WHO UTILIZE – </strong></p>
<p> <strong>“COLUMBIAN LIFE INSURANCE COMPANY” </strong></p>
<p><strong> FOR THE FUNDING OF YOUR PRE-NEED ARRANGEMENTS </strong></p>
<p>This should serve as a <strong>“Wake Up Call”</strong> to you.
If the process that was created and established at Nordgren Memorial Chapel
in Worcester in 1999 by Columbian Life Insurance Company’s Regional
Sales Director, Mr. Klamkin, which included a draft letter for your signature
along with the conversion process to be followed is similar to or the same
that was followed at Nordgren Memorial Chapel; please be advised that there
may or may not have been irregularities (I honestly do not know if in fact
there were any at this point). If there are in fact irregularities, I shall
be requesting a full scale investigation into Columbian Life Insurance Company
and the process followed at Nordgren Memorial Chapel in 1999.</p>
<p><strong>An interesting note</strong> - Mr. Bresnahan, the investigator
himself and an owner of his own funeral home in Pittsfield, Massachusetts
some years back, converted trust funds to insurance with both Forethought
Life Insurance Company and Columbian Life Insurance Company – both
with Mr. Klamkin as the Regional Representative. <strong>Hummmmmmm!</strong>
At some point, I shall present Mr. Bresnahan’s testimony regarding
his investigation into the proceedings with Columbian Life Insurance Company
and his discussions with Mr. Klamkin. Needless to say, Mr. Klamkin did not
respond to two (2) subpoenas forwarded to him in these proceedings.</p>
<p>Mrs. Mangsen originally filed three (3) complaints against me – they
being the subject of an Order to Show Cause issued to me by Ms. Kathy Cartmell-Sirrico,
acting Chairperson of the State Governance Board on June 29, 2004. The complaints
were supposedly investigated by Mr. Bresnahan. I was provided with a copy
of each complaint and given 10 days to respond to each. My response to each
complaint was submitted to Mr. Bresnahan in a timely manner. (Quite frankly,
I should not have wasted my time). Mr. Bresnahan and his less than competent
supervisors chose either not to review my responses or afforded them NO
consideration and the complaints filed by Mrs. Mangsen were accepted as
factual.</p>
<p>Three (3) years later (1096 days having passed) and seven (7) days of Administrative
Hearings later (the official transcripts readily available for all to review),
we find that the content of the complaints filed by Mrs. Mangsen as well
as the statements made by Mrs. Mangsen, Mr. Johnson, and Atty. Sinrich (Nordgren’s
attorney) on December 9, 2003 were baseless lies and distortions of fact.
The travesty of the situation is that families that had lost loved ones
were forced to come forward under subpoena (in several cases numerous subpoenas
had to be issued to the same family members, because of procedural inconsistencies
by the prosecution attorneys and the Administrative Hearings Counsel –
and to be 100% honest and accurate, in one instance it was my lack of legal
expertise that I issued subpoenas without knowing that they had to be notarized
a second time), and relive in detail the planning process and subsequent
loss of a loved one. The pain and trauma, (not to mention the difficulty
in getting to Boston, hassling the traffic, and finding a place to park),
these families experienced as a result are an example of an investigator
consumed by prejudice, bias, corruption, and yes, incompetence in not honoring
the oath of office he took when he became a Massachusetts Civil Servant
and the disgrace he has brought upon himself and the institution we call
Massachusetts State Government.</p>
<p>Yes, it has been three (3) tumultuous years for me and my family. Clergy,
friends, associates and colleagues all wonder in amazement how I have been
able to withstand the vicious and malicious attacks by Mrs. Mangsen, Nordgren
Memorial Chapel, their attorney, and the State Governance Board and still
say when asked how I am doing – “I’m Excellent!”
Why, because I am standing firmly upon the foundation of truth and the facts,
and I have the support of the Good Lord in my daily life now and in the
future as it has been there for me in the past.</p>
<p>In remaining completely honest to each of you as I have been to myself,
I must admit my faith in people (certain people) has been shaken –
severely shaken, as I look to everyone I meet as being honorable until they
prove themselves otherwise. I will not let those consumed by malice and
evil compromise the faith, belief, and trust I place in people. Through
these past 1096 days, I have come to realize that some people are worshippers
of evil and disciples of a devil – a devil I did not want to believe
existed – but now I realize a devil that has consumed many I have
come to know for who they truly are.</p>
<p>I shall leave you on this the 3rd anniversary of a very dark day in funeral
service with that which I leave with every person I meet every single day
and have for many years, and I quote – </p>
<p><strong>“May You Live Every Day of Your Life – Be It 20 Years
or 120 Years”</strong></p>
<p> <strong>“God Gave You Today, Tomorrow Is a Gift!”</strong></p>
<p> <strong>“Live Life Wisely, for You Will Be Held Accountable!”</strong></p>
<p>Lest you forget, you WILL NOT escape this life “alive”. “Living
a Life of Lies” does nothing positive for you, your family, and those
who will bear the burden of your lies for generations to come – I
speak to your children, grandchildren, loved ones, and those who once called
you a friend.</p>
<p>(This update will be forwarded by email and 1st Class Mail to those whose
statements and actions have either made them a party to the issues referenced
on this web site since March 2005 or who have requested that they be provided
with input as the issues are addressed in a public forum. I believe the
issues to be so very important that every funeral home owner and every funeral
director in the country need be apprised of the facts and the truth; that
every lawyer in the country be apprised of the fact that they too must be
held accountable for any misguided and intentional distorted statements
and blatant lies; and that every civil servant serving at the will and pleasure
of the plebiscite government we have in these glorious United States of
America know that they too are to be held accountable to the public for
whom they serve for their actions – now and in the future.)</p>
