<p>I was reminded recently as I was preparing a complaint alleging a violation
of Massachusetts Public Records Law (M.G.L. Chapter 66, Section 10) that
–<br>
<em><strong>“Public Officials are NOT exempt from being held accountable
for their actions and statements and like every American they are required
to tell the truth – even if it reflects poorly on their performance.”</strong></em></p>
<p>As you know from reading this web site, “Justice at What Price”,
(which, by the way, was created only after more than a year, the expenditure
of tens of thousands of dollars in order to obtain the audio copy of the
State Board of Registration of Funeral Directors and Embalmer’s Meeting
of December 9, 2003, wherein the conspiracy was outlined in great detail)
– the same audio tape that we were told by the State Board attorneys
and the Division of Professional Licensure that they did not have –
never willing to tell us where and how to obtain it – and not to mention
the vicious attacks on me personally by Ms. Sue Simon and the industry Trade
Publication, the Funeral Monitor as a result of distorted lies and ambiguities
provided to the Funeral Monitor by Katherine Mangsen, wife of Kurt Mangsen,
(Nordgren Memorial Chapel) and its attorney, Scott Sinrich, (Phillips, Silver,
Talman, Aframe, & Sinrch, LLP of Worcester), I maintain and always have
impeccable records and an audit trail of my activities and dealings with
everyone I come in contact with.</p>
<p>I learned many years ago at a relatively young age that there are some
individuals that lack integrity and ethics and are genuinely dishonest in
their commitment to themselves as well as others. When their integrity is
questioned, they will lie, cheat, distort, and do anything rather then admit
their mistake or faux pas; therefore forced to “come down a mountain”
after ONLY “going up a mole hill”. How Sad! As such, I was wisely
advised to keep immaculate records and truly learned the importance of doing
so when I was trained and certified by the federal government as a “Grievance
Examiner.” The advice and counsel has served me well throughout my
life and most especially during the past 2 ½ years as I have addressed
vicious and malicious acts of hatred reinforced by lies, allegations, and
accusations that were poorly investigated (if investigated at all) by publicly
appointed State Board officials and competitors in Funeral Service. The
attempt at “Character Assassination” will ultimately fail as
the truth be known (and YES, the “truth” will be known); but
in the meantime my name and reputation have suffered irreparable harm –
necessitating the need to take appropriate action in the near term.</p>
<p>The process followed in the past 2+ years is a case study unto itself.
Under the microscope is not just the workings of state government and the
corruption that is running rampant within; but equally, if not more important
is the abuse of power and perceived authority that public officials and
government appointees seem to believe they have, and the protective armor
that the Commonwealth of Massachusetts provides them insulates them from
any measure of accountability. Well, let me assure you, this so-called “comfort
level” is about to become very uncomfortable, for those whose uncontrollable
and misguided actions and statements have fueled a “runaway wild fire”
that will soon “burn the britches covering their backsides”.</p>
<p>Funeral Service and the genuine good we do for so many families in their
time of need and the compassion that we are able to bring to families at
this very traumatic time in their lives can only be overshadowed by the
corruption, conspiracy, gross incompetence, and cover-up of a few disjointed
individuals that put themselves above the good of the process and what is
right and just for an industry already under siege. I don’t know how
this situation will turn out in the short term, but I do know how it will
turn out in the long term. </p>
<p>The “ugly brutality” of a small corrupt group of funeral directors
and funeral home owners (to include the Chairperson of the State Board of
Registration of Funeral Directors and Embalmers in December 2003) in Central
Massachusetts must be exposed for who they are and what their motives were
that has driven their actions in this matter. The story needs to be told
locally, nationally, and to every funeral home owner and professional “certified
senior advisor” that has now or ever will have dealings with seniors
as they do their “end-of life” or long-term planning. What has
happened here to me and is on-going could happen to anyone of you –
and you need to know how to deal with sick and corrupt people without losing
your life savings, your home, and reputation in the process. I believe I
have an obligation to you and to the system of government that has taken
up a frivolous cause trusting individual’s statements and comments
without verifying their accuracy, and drawing conclusions as a result of
biased, prejudiced, partial, and unethical motives of a few misguided character
assassins. Consider this obligation to you - willingly accepted!</p>
<p>I received an inquiry from a funeral director in the mid west who reads
the updates with great regularity asking “what might be the scenario
had you not obtained the audio recording of the actual statements and conspiracy
outlined in the State Board Meeting of December 9, 2003?” I, too,
have asked myself that same question. The fear and intrepidation that must
have permeated the State Board and Division of Professional Licensure for
the longest time as I and my attorneys at that time did everything possible
in the process to obtain the audio portion of the meeting – and at
every juncture hitting a wall with no cooperation from the aforementioned
governmental bodies, must have been a terrible burden for the co-conspirators
to bear for a long time.</p>
<p></p>
<p>But for the record, after receiving the Order to Show Cause signed on June
29, 2004 and dated June 30, 2004 and getting past the initial shock (for
the State Board could not have read my responses to the complaints, verified
the accuracy of my responses and still issued the Order to Show Cause),
I authorized and participated in an investigation of every aspect of the
process and was able to compile data, correspondence, and evidence that
supported the conspiracy “opened to all” when we finally obtained
the audio portion of the December 9, 2003 meeting of the State Board. The
viciousness of the attack on my character by the Funeral Monitor and its
editor was unfortunate, but not a surprise as our investigation from undisclosed
sources had uncovered correspondence that pointed directly to Mrs. Mangsen
and Nordgren’s attorneys presenting information that was less than
accurate and truthful – some of the same distortions and non-truths
that were presented to the State Board by the same persons on December 9,
2003 and clearly noted in their own words on the audio tape. So to answer
the inquiry, I would have to say “the audio tape reinforced with irrefutable
evidence the existence of the conspiracy we uncovered and kind of put the
icing on the cake, so to speak.” What I did NOT expect is that as
we “lit the candles on the cake”, to see, witness, and be the
object of a “campaign of harassment” by the State Board and
its employees; violating every ethical standard of fairness and justice
by violating their own rules and regulations (the specifics to be the subject
of a future update), but suffice it to say, I have the facts in hand to
support my statements.</p>
<h3 class="title">Part 2 - "Administrative Hearing Cancelled Without Notice" (Defense
Witnesses Incensed)</h3>
<p>Today, June 27, 2006, I was to wrap up my testimony as a witness and begin
calling defense witnesses for “the truth” to be told. Seven
(7) witnesses to include 2 members of the Orthodox Clergy, 2 funeral directors,
the former secretary (Nordgren Memorial Chapel), and 2 family members that
experienced the loss of a loved one and were treated less than honorably
by Nordgren Memorial Chapel were to testify – each receiving no less
than three (3) subpoenas since January 10, 2006.</p>
<p>The first subpoenas were issued by my former attorneys at Bowditch &
Dewey LLP in Worcester as a result of the denial of our request to have
the hearing scheduled in Worcester and not in the middle of the winter (January
18-19, 2006) as most of the witnesses to be called are elderly and some
in poor health and all were from the Central Massachusetts area. No sooner
did we issue the subpoenas (just 2 days later), we were informed by the
Prosecution Attorney, James Read, that the witnesses we had just subpoenaed
would not be called until a later date - yet to be determined. There was,
has, and continues to be a total disregard for what is just and right when
it comes to the truth being heard and considered in a timely fashion. Please
note: witnesses for the prosecution were not inconvenienced and their dates
and testimony went on as scheduled.</p>
<p>We now come to today (June 27, 2006). We are all seated in the Hearings
Room at 239 Causeway Street in Boston. In attendance were the following
– Ms. Colleton, Presiding Officer; two legal interns; a court reporter
(at my expense); Attorneys James Read & Leslie D. Alexander, Prosecuting
Attorneys; Katherine Mangsen, Treasurer, Nordgren Memorial Chapel and the
author of at least four (4) vicious and malicious complaints which the biased
and prejudiced State Board has chosen to accept as fact without verifying
the accuracy of the complaints; Attorney Jessica Godfrey, Legal Counsel
for Nordgren Memorial Chapel, a public observer, and me. At 10:30 AM (the
Hearing was to commence at 10:00AM), Ms. Colleton indicated Mr. Mazur, Chairman
of the State Board, had a medical emergency and was not able to be present
and that no other member of the State Board was available for the Hearing
to proceed. The Hearing was abruptly cancelled.</p>
<p>Needless to say, I panicked. How possibly could I get in contact with each
of the witnesses, many who would be on the road traveling to Boston? I rushed
out of the Hearing Room and called St. George Orthodox Cathedral in an attempt
to contact Rev. Fr. Michael Abdelahad. I asked the Cathedral secretary to
contact Rev. Fr. Dean Paleologos, Funeral Directors - Francis O’Connor
and Anthony Athy – while I attempted to contact others scheduled to
drive to Boston, find parking, and testify at a Hearing after more than
6 months and three subpoenas being issued to them.</p>
<p>It is now 2:30PM on Tuesday, June 27, 2006 and I was able to contact the
last witness who had just traveled the Mass Pike to Route 93 North and had
entered the tunnel – just a mile or two from 239 Causeway Street.
He was to turn around and return to the Worcester area before the traffic
got any worse.</p>
<p>I asked Ms. Colleton, Administrative Hearings Counsel, if I now had to
issue a fourth (4th) subpoena to the witnesses that have been traumatized
once again; to which she responded “you need to ask an attorney.”
I stated I am representing myself at this point, and I just want to make
sure I do things correctly. Ms. Colleton’s response – “We
can not give you legal advice or direction – ask an attorney.”
Since I have incurred more than $400K in expenses in the past 2 ½
years, I shall issue another set of subpoenas and as before, forward copies
to Ms. Colleton and the prosecution attorneys.</p>
<p>The name of this web site is<strong> <em>“JUSTICE AT WHAT PRICE”</em>
</strong>and there is definite interest in this case by every funeral director
- not just in Massachusetts, but throughout the country. It seems an appropriate
time to put a chronology of events (every detail factual to the last letter)
together beginning with the path of activities and motives of a misguided,
vicious, and malicious complainant; who couldn’t even get her husband
(the owner of the funeral home and the funeral director licensee) to sign
off on her complaints. His testimony indicated he had not even read the
complaints submitted by his wife more than two years after she filed them
with the State Board. </p>
<p>I believe it is time to either have the Commonwealth of Massachusetts investigate
the process and facts as we have gathered them over the past 2 ½
years or go to the medium of choice with the conspiracy, corruption, gross
incompetence, and cover-up that has permeated the process in the issues
before us. The Taxpayers of Massachusetts are funding a “witch hunt”
of proportions few will believe until I put forth the facts as we have them.</p>
