<p>On June 14, 2006 after more than 2 ½ years of being held hostage
by a process and a conspiracy of a magnitude beyond even what the co-conspirators
had originally intended, the truth of which I have known for some time as
a result of the investigation we initiated two years ago; facts are now
surfacing and being presented to the chagrin of the parties I have referenced
on this web site since April 2005.</p>
<p>As you know if you have been following the updates on this web site, Wednesday,
June 14, 2006 was my first opportunity to be heard; for my responses to
the complaints filed by Mrs. Mangsen, treasurer, Nordgren Memorial Chapel
and forwarded to the State Board fell on “deaf ears” and most
likely were not even read until it was too late. Why would I say this and
what basis would I have to do so? My response – “a pattern of
activity by the author of the complaints, the vicious, malicious, vindictive,
and defaming statements made by the Chairman of the State Board in 2003
(John J. Kazlauskas) – statements that are now part of the of the
“Official Record” – isn’t that correct, Mr. Bresnahan?</p>
<p>I have labored for countless hours in an attempt to be able to get the
results of our investigation into the record – information that clearly
sheds light on the conspiracy, the “witch hunt”, and how the
Mangsen’s, owners of Nordgren Memorial Chapel misrepresented and distorted
facts to “suck into the process” a corrupt State Board Chairperson,
who prejudiced other State Board Members, compromised attorneys for the
State Board in the process, and has resulted in a “waste” of
more than a $1M of taxpayer money – not to mention the hundreds of
thousands I have expended in this fiasco.</p>
<p>For the 3rd time in 6 months (the 3rd being June 16, 2006), a series of
subpoenas have been issued to families who have been either referenced specifically
or indirectly by Kurt and Katherine Mangsen, Ronald Johnson, Kevin Mercadante,
David Pickering, or John Bresnahan, investigator for the State Board. These
individuals are being inconvenienced beyond ones imagination as a result
of corruption within a process and by person(s) within the process that
have compromised their respective roles and responsibilities, because they
were either too scared to stand up for the truth or too weak to do anything
about it. Yes, Mr. Bresnahan, you are one of those to whom I reference.
I shall soon publish on this web site the full testimony of Mr. Bresnahan
– not to embarrass Mr. Bresnahan; but to demonstrate that Mr. Bresnahan
DID NOT conduct an investigation, but took the lead from the corrupt Chairperson
of the State Board, hopped on the band wagon, and allowed Mrs. Mangsen to
“cherry pick” from pre-need funeral files I had arranged - taking
working portions and withholding the completed documents and stating the
originals did not exist or were not in the files. <br>
Did Mr. Bresnahan verify for himself like any novice inspector would certainly
do (investigations 101) before jumping to conclusions? Didn’t have
to, since Mr. Kazlauskas had already set himself up as an expert witness
with institutional knowledge in the matter, even though no complaints had
even been filed and Mr. Kazlauskas was already recommending sending the
matter to prosecution. </p>
<p>What I have just presented is verified! What I have just presented is on
the record! And what I have just presented is just the “Tip”
of the iceberg in a process of corruption that has no place in State Government
today or any day. As we all know, the reputation of state and federal government
personnel is circumspect at best; and as a 32 year career member of the
federal government, I was made aware from day one that my performance and
that of every member of the team was under the watchful eye of the public
and that my commitment had to be honorable at all times never wavering to
misguided personal agendas of others. I have honored this pledge and do
so today, as I now come forth with the truth, difficult to prove with the
facts; since I was locked out of Nordgren Memorial Chapel, that Mrs. Mangsen
and Ms. Wiles ravaged the files without Mr. Bresnahan’s participation,
without my participation, and without any neutral party present during the
process on Saturday, November 22, 2003 (3 days after my abrupt termination
without notice). Hummmmmmmmmm!</p>
<p>In reviewing the array of documents I obtained from my attorneys after
they decided to withdraw without objection by me from the case, I stumbled
upon responses to correspondences generated by either me or my attorneys
at that time from the prosecution attorneys I had not seen before nor was
I aware of. I also have been able to piece together (also through correspondence
and documentation obtained during our investigation) that clearly demonstrates
a pattern of corruption leading up to and through the process of identifying
witnesses to be called for the prosecution – at least one witness
that came along after the Order to Show Cause was issued. Hummmmmmmmmmm!</p>
<p>There is so much more I wish to share with you, but I promised myself that
I would not release anything on this web site prior to doing so in one way
or another with the State Board and/or Division of Professional Licensure.
I will continue to honor this pledge.</p>
<p>It is my fervent hope to wrap up my testimony during the morning of Tuesday,
June 27, 2006 and to answer questions from the prosecution under cross-examination.
Soon thereafter, we shall begin the process of calling witnesses for my
defense with the date of July 12, 2006 also reserved for witness testimony.
I anticipate the need for potentially another day, but that is to be determined.</p>
<p>As you know, I have the audio tape of the December 9, 2003 meeting of the
State Board, wherein the conspiracy evolved into the public arena. I am
unable to enter it into the record, which is such a shame. Although, I am
able to enter into the record portions of a transcript of the content as
could best be transcribed from a court reporter that was not present at
the meeting and did not know the participants, there is so much that is
missing as you listen to the tone, the inflections, the laughter, and the
deceptive tenor by certain participants at the meeting. </p>
<p>And then I turn to the comments, advice, direction, conclusions, and assumptions
made by Mr. Kazlauskas, Chairperson of the State Board who was finally advised
to recuse himself after calling me a “snake” and a “carpetbagger”
before I was even invited into the meeting by legal counsel; and yet immediately
upon my departure, Mr. Kazlauskas re-assumed the Chairmanship of the meeting.
In doing so, Mr. Kazlauskas continued his vicious attack on me calling me
a “Carpetbagger” one additional time – this time in front
of the Mangsen’s, Mr. Johnson, and Nordgren’s attorney, Scott
Sinrich.</p>
<p>Not only had Mr. Kazlauskas known me (not well, but he knew me) since 1967,
but he knew Ronald Johnson (now at Nordgrens) for more than 40 years and
Kurt and Katherine Mangsen for some time as referenced by his own words
and comments during the meeting. Suffice it to say, Mr. Kazlauskas further
corrupted the process by participating in the meeting and the issues which
he had just recused himself from and assumed the chairmanship of the meeting
during the Mangsen’s participation. </p>
<p>Did Mr. Kazlauskas compromise the process? Did Mr. Kazlauskas prejudice
the process? Did Mr. Kazlauskas negatively influence a process by his words
and actions? Did Mr. Kazlauskas bias the process? Is it too late for fairness
and justice to prevail? All good questions. All questions posed to the State
Board and Division of Professional Licensure from the day we received the
audio tape. All questions that will soon be answered.</p>
<p>In the meantime, I shall continue to listen to the audio tape as time permits
– an audio tape of many individuals that were witness to and in some
cases participated in the series of events referenced in this and other
updates. I find the content on the audio tape quite disturbing as you can
imagine, but even more so the fact that I am listening to <em><strong>“a
dead man talking”</strong></em>.</p>
<p>I look forward to the day the audio tape can be stored once and for all
or destroyed forever, and that Mr. Kazlauskas can finally rest in peace,
if this is possible. That scenario rests with the State Board!</p>
