On May 2, 2006, I had the opportunity to cross-examine Mr. John Bresnahan,
an investigator for the Division of Professional Licensure, and assigned
to the State Board of Registration of Funeral Directors and Embalmers. As
promised, the cross-examination of Mr. Bresnahan took several hours interrupted
only by a half hour break for refreshment.

It is not my intent to present the questions asked of Mr. Bresnahan and
his answers thereto at this point, for this will be presented upon receipt
of the documented testimony from the court reporter who has come to know
the Administrative Hearings process quite well and whose attendance and
participation has been at my expense and “on my dime”.

Mr. Bresnahan was polite, professional, and sincere in his responses to
all questions posed to him – quite different from the John Bresnahan
that was present at the State Board Meeting on December 9, 2003. Could it
be that he had listened to his own statements, their inflammatory tone,
his prejudiced and biased overtones in each of his statements and assertions,
and down-right lack of professionalism in his investigative role during
the December 9, 2003 State Board meeting? Could it be that Mr. Bresnahan
knew from the numerous correspondences to state officials requesting a full
scale investigation of the State Board indicating that I finally obtained
an audio recording of that infamous meeting when the conspiracy was outlined
and the corruption reared its ugly head? Could it be that he no longer had
stalwarts in his corner in the persons of the State Board’s former
Chairperson, John J. Kazlauskas (now answering to someone other than the
Good Lord for his actions and statements) or the recently departed (not
deceased) Kathy Cartmell-Siricco, who no longer serves on the State Board?
I suspect it is “all of the above and more!”

What bothers me a very great deal is complaint EM-04-126 – complaint
filed by Mrs. Katherine Mangsen against me alleging I contacted families
that I had made pre-arrangements with and encouraged them to move their
funeral arrangements to other funeral homes. First and foremost, “the
allegations are absurd”, but we have come to learn from testimony
of the prosecutions witnesses that the majority of the statements made to
the full State Board on December 9, 2003 by Mr. & Mrs. Mangsen and their
Attorney, Scott Sinrich were less than accurate and in some cases intentional
lies. More on the specifics during my defense scheduled to commence on June
14, 2006.

When I asked Mr. Bresnahan if he had contacted the two (2) families referenced
by Mrs. Mangsen in her complaint EM-04-126, he indicated “he had not.”
I asked if he had read my response to the complaint, to which he responded
“he had.” When I asked him, “Why, he had not contacted
the families to verify the accuracy of Mrs. Mangsen’s assertions?”
– he indicated he contacted the successor funeral director (in both
cases, it was Kevin Mercadante, Mercadante Funeral Home and Chapel, 370
Plantation Street, Worcester, MA) and that Mr. Mercadante verified that
I had encouraged both families to transfer their funeral arrangements to
his funeral home.

I suggest to you - we have a problem here!

Mrs. Mangsen filed a complaint which she knew to be inaccurate, but chose
to take a statement signed by two (2) families and notarized by me and distort
the substance and content of the correspondence to accomplish her personal
agenda of attacking me personally and professionally. The “willing
participant” (or at that time “co-conspirator”) in this
case Mr. Bresnahan gave no credence to my response to the complaint and
ONLY went to Mr. Mercadante as his investigation into the matter. Now both
families have been subpoenaed and will appear as witnesses for “The
Truth” and for my defense – families that have been and are
now traumatized to appear – families whose lives are being disrupted
by false statements made by Mrs. Mangsen and Mr. Mercadante – and
families who will be compelled to tell the truth and expose the corruption
I have alleged for 2 ½ years.

What disturbs me so very much, is the “reckless disregard”
which those at Nordgren Memorial Chapel and Mercadante Funeral Home and
Chapel have for families that are either doing their “end-of-life”
planning or have lost a valued and treasured member of their family. There
can be NO salvation for a person(s) that would do this to any family regardless
of what would motivate them to do so. I suggest to you that you can give
away all your wealth, you can repent till the “cows come home”,
but you can’t take back the hurt, the pain, and the anguish you have
deliberately caused others for your personal gain. I have come to expect
no less from Mrs. Mangsen, but Mr. Mercadante, “You should be ashamed
of yourself!”

I realize that many of the witnesses I have subpoenaed as defense witnesses
were at one time or another potential witnesses for the prosecution and
to call them to testify is not a so-called “good move”. Quite
frankly, I know the truth! I can prove every word I have professed and presented
on this web site for more than a year now, and I can’t wait to ask
the questions that will illicit the truth from the witnesses - or watch
them lie. If they choose not to tell the truth, the conflicting testimony
that has already been entered into the record will tell volumes that will
“ring long, loud and clear through the halls of justice”.

I feel for Mr. Bresnahan, for his time under oath was not a pleasant experience.
In a good way, I feel for Mr. Bresnahan, because the experience he has witnessed
first hand as a participant and “on the court player” is called
“lessons learned” and he will not make the same mistakes, nor
make assertions without having investigated ALL the statements and facts
before acting, and the beneficiaries will be other funeral directors that
will have the benefit of the doubt and be considered innocent until “proven
guilty” in future investigations. I did not receive this professional
courtesy (some say my civil rights were violated – and, you know -
they are correct).

But you, Mr. & Mrs. Funeral Director in the Commonwealth of Massachusetts,
will be the beneficiary of the 2 ½ year ordeal I have experienced;
of the almost $400,000 I have expended in getting to the truth behind the
conspiracy, corruption, and cover-up; and the continued harassment I have
endured at the hands of a vengeful State Board unwilling to admit the process
to the truth was maligned by a corrupt chairperson and for which every member
to include its legal staff jumped on board as they prejudged a situation
without benefit of the facts and the truth – and they didn’t
want to know the truth.

As Jack Nicholson so ably put it during the movie “A Few Good Men”
and I say to the State Board – YOU CAN’T HANDLE THE TRUTH!

On several occasions during the past year on this web site, you will recall
I have spoken to the fact that “From Darkness Comes Light.”
I have had conversations in recent times with attorneys and scholars at
Harvard University as we discussed the merits of the issues and “happenstances”
of the past 2 ½ years. The topic of “from the darkness (or
shadows) comes the light” surfaced again, and it was brought to my
attention that an attorney of prominence by the name of Michael Klein founded
the “Sunlight Project” for the specific purpose to fight corruption
in Congress.

I then came upon a statement attributed to Justice Louis Brandeis that
has had a profound impact on me. He stated when discussing corruption and
conspiracy in government that –

“SUNLIGHT IS THE BEST OF DISINFECTANTS”

On June 14, 2006 I shall commence with the presentation of my defense.
I shall shed ONLY sunlight on the issues and circumstances before us. And
the disinfection of the conspiracy and corruption within the State Board
of Registration of Funeral Directors & Embalmers will begin and conclude
only with the light shining brighter than it has since November 19, 2003.

A great many individuals (both elected and appointed) serving at the will
and pleasure of this administration have been made aware of the conspiracy
and corruption I have alluded to and which was clearly reinforced by the
recent testimony of Mr. Bresnahan. It is ONLY just and fair that their actions
or lack thereof be closely scrutinized, for a tremendous amount of State
resources (in excess of $1M) has been wasted on this “Witch Hunt”
now exposed to the light.
I believe it is time to “disinfect the system”
and include all those who have either abused their authority or failed to
exercise their responsibility to serve the Commonwealth in a fair and just
capacity.

Once again, I wish to thank you for your support and encouragement. I continue
to receive emails, have people approach me on the street and in supermarkets,
and receive numerous phone calls from those of you who regularly read the
updates and continue to share the truth with the public that wants to believe
the worst.

I pledge to you that what you read and see on this web site will not be
pure speculation or conjecture on my behalf; but the truth, the whole truth,
and only that which I can and will prove in the appropriate forum. “Character
Assassins” (and if one of them happens to be you) I suggest
when you look over your shoulder, you will see me “day and night”
until you “become clean – by coming clean”. That’s
called “a conscience” – everyone has one – many
fail to realize it until it is too late. A good long hard look in the mirror
goes a long way to becoming clean. Try it! “What makes
YOU tick?”
