<p>As you know by now if you are one of the very many interested parties throughout
the Commonwealth of Massachusetts and throughout the country that monitor
this web site on a very regular basis; every word, every statement, and
every comment made herein is backed up by the truth and even more importantly
– “can be proven”!</p>
<p><strong>“Character Assassins”</strong>, regardless of how successful
they are or may appear to be, will NOT escape their personal and professional
responsibility to be held accountable for their statements and actions.
This statement is made as a result of testimony that has been taken in recent
Administrative Hearings before the Division of Professional Licensure that
substantiates the findings of the 2+ year investigation I initiated into
statements made and actions taken by the principals at Nordgren Memorial
Chapel and members of the State Board of Registration of Funeral Directors
& Embalmers and its staff.</p>
<p>I keep promising to present <strong>Part 5 in the 12 Part Series</strong>
of our investigation, but elements of the investigation keep surfacing on
a daily basis that are more deserving of my attention and yours, which force
me to alter my plans. In order to get more on track and to keep you truly
informed, I shall present updates on a weekly basis commencing with this
update and continuing until every aspect of our investigation is adequately
presented, every bit of the testimony from the Administrative Hearings is
presented verbatim, and you are aware of the name and role played by each
of those involved either directly or indirectly in the proceedings of the
past 2 ½ years.</p>
<p>So anxious, or “threatened” if you will, to coin the terminology
of Attorney Jessica Godfrey, Counsel to Nordgren Memorial Chapel and an
attorney with the Law Firm – “Phillips, Silver, Talman, Aframe,
& Sinrich, P.C. of Worcester, to learn every aspect of our investigation
into the origins of the many complaints filed by her client, Nordgren Memorial
Chapel in the person of Mrs. Katherine Mangsen; that Attorney Godfrey forwarded
the following letter to Atty. Daniel P. Flynn, Esq., of the Law Firm, Bowditch
& Dewey, LLP – a Worcester Law Firm that formerly represented
me in my defense of the complaints before the State Board of Registration
of Funeral Directors & Embalmers. </p>

<p> What I find most interesting (and I’m sure you will as well) is
Attorney Godfrey has been present for each of the four (4) days of the Administrative
Hearings during which the prosecution has called its witnesses – which
have included Gail Wiles, Ronald Johnson, Katherine Mangsen, and Kurt Mangsen
– all from the funeral home Ms. Godfrey represents. Atty. Godfrey
has identified herself at each of the four (4) hearings as representing
Nordgren Memorial Chapel and her presence is to gather information for the
on-going civil litigation. <strong>(I can only say to Atty. Godfrey, “don’t
miss my testimony on 14 June 2006”)</strong>.</p>
<p>I have referenced in previous updates the fact that many have become <strong>“dirty”</strong>
in the process of the past 2 ½ years – some intentionally and
others unintentionally. Some have become dirty of their own volition –
others by “happenstance”. Until this past week, I would have
said to characterize David Pickering, owner & Funeral Director, Rand
Harper Pickering Westborough Funeral Home as being even the least bit dirty
would be an unfair, unjust, and a grossly inaccurate description of a gentleman
I have considered the <strong>“consummate professional funeral director”</strong>
– a gentleman, I even hold in very high regard to this very day. The
actions and lack thereof by Mr. Pickering leave me a bit perplexed, and
as I present the facts herein – do know that I have discussed them
in detail with Mr. Pickering several days ago. </p>
<p>In May 2004, I was contacted by the Bayrouty Family of Westborough asking
if I would assist them at the time of the anticipated passing of Louise
Bayrouty. Since I was not associated with any funeral home at that time,
I indicated I would be there for them regardless of what funeral home they
selected. The family selected Rand Harper Pickering Westborough Funeral
Home, and David Pickering and I worked with George Bayrouty to address his
every wish for the arrangements for his wife, Louise.</p>
<p>After Mrs. Bayrouty died and before her funeral was conducted, Mr. Pickering
received a phone call from a woman who inquired if I (Haddad) was assisting
with the funeral. When Mr. Pickering inquired as to who was calling, the
caller hung up.</p>
<p>Bothered by the call and unbeknownst to me, Mr. Pickering contacted the
State Board investigator inquiring as to “was he doing anything wrong
in directing the funeral and working with me?” The very next morning
the State Board inspector, John Bresnahan, showed up at Rand Harper Pickering
Westborough Funeral Home, and Mr. Pickering provided Mr. Bresnahan with
an update of what discussions Mr. Pickering and I had leading up to the
moment. To my surprise, 18 months later, I am informed Mr. Pickering is
being called as a prosecution witness against me. It was not until Mr. Pickering
testified on Thursday, January 19, 2006 at the Administrative Hearing in
the company of his attorney in Boston that I learned Mr. Pickering had initiated
the conversation more than 18 months earlier with the State Board investigator.</p>
<p>Mr. Pickering was honest and forthright to the best of his recollection
in his statements at the Administrative Hearing, and when my legal counsel
cross-examined Mr. Pickering again Mr. Pickering was honest and forthright
in his responses. My legal counsel failed to ask two (2) very simple questions
at that time. Soon thereafter, I requested of the Division of Professional
Licensure prosecuting counsel to have David Pickering called as a witness
for the defense – so that I might ask Mr. Pickering the two (2) questions.
<strong>My request was denied.</strong></p>
<p>I then contacted Mr. Pickering by <strong>email</strong>* and fax with
the following request and affidavit stating his responses to the two (2)
questions. Please note I stressed that he should contact his legal counsel
before submitting a response and to feel free to contact me.

<p><strong>Affidavit of David Pickering</strong></p>
<p>I, David Pickering, owner of Rand Harper Pickering Westborough Funeral
Home, 62 West Main Street, Westborough, Massachusetts 01581 answer the following
questions posed to me by Philip G. Haddad, Jr. and attest that my answers
are true, correct, and complete to the best of my knowledge.</p>
<p><strong>Question: </strong>"Mr. Pickering, did you as the owner of
Rand Harper Pickering Westborough Funeral Home earn the monies charged George
L. Bayrouty, husband of Louise Bayrouty, for the services you provided on
the occasion of the death of Mrs. Louise Bayrouty?"</p>
<p><strong>Answer: </strong></p>
<p><strong>Question:</strong> "Mr. Pickering, did Mr. Haddad earn the
monies you paid him for his time, efforts, participation, and professional
service in the days leading up to the viewing, funeral, and burial of Mrs.
Louise Bayrouty?"</p>
<p><strong>Answer:</strong></p>
<p> I suspect the answer to the 1st question is – <strong>"Yes,
I did!"</strong></p>
<p>I suspect the answer to the 2nd question is – <strong>"Yes,
he did!"</strong></p>
<p>SUBSCRIBED and sworn to under the pains and penalties of perjury this ___
day of April, 2006.</p>

<p> I contacted Mr. Pickering on two (2) occasions in the past week, and he
indicated he would not respond to the request upon advice of his legal counsel
and all he wants is for this thing to be over. <strong>"Me too –
David!"</strong></p>
<p>The point to be made here is David Pickering, in an attempt to be up front
and to assure he was acting appropriately (covering his back side –
according to David) became used and abused by a corrupt system of government
that had issued an Order to Show Cause prior to being contacted by David
and then using him to get to me, in an attempt to validate the actions taken
by the State Board & its investigator. How sad!</p>
<p> I don’t know why David Pickering is afraid to stand up to the truth.
He did earn every dollar he charged the Bayrouty Family. And I don’t
know why he is afraid to stand up to the truth – “I did earn
every dollar I was paid in working with him in support of and in participating
in all aspects of the funeral arrangements for Louise Bayrouty”. You
do not have to take my word for it; just ask the Bayrouty Family! </p>
<p><strong>For the record: </strong>No one should be intimidated now or ever
by anyone when they know what they are doing or have done was and is correct
and in the best interest of the consumer they have committed to serve. Once
again, I believe David Pickering to be the consummate professional funeral
director – a funeral director of honor and integrity – and a
funeral director that has been a victim along with others of corrupted persons
and a corrupt system that is in desperate need of an overhaul for the good
of the future of funeral service.</p>
