<p>I had intended to present <strong>Part 4 in the 12 part series</strong>
– the results of our 2+ year investigation into the statements made,
actions taken, and subsequent disclosure of a conspiracy of character assassination
that not only originated at a local Worcester Funeral Home, but was expanded
to and by other local Worcester County Funeral Directors – one such
funeral director being the former Chairperson of the State Board of Registration
of Funeral Directors and Embalmers, Mr. John J. Kazlauskas, now deceased.</p>
<p>Recent unanticipated circumstances have occurred that necessitate that
I delay presenting Part 4 in the 12 part series which is entitled, <strong>“What
Does It Mean to be Dirty?”</strong> and present the essence of recent
developments that have occurred since the last update on February 28, 2006.</p>
<p>After more than 2 years of legal representation by Bowditch & Dewey,
LLP in Worcester for dealings before the State Board of Registration of
Funeral Directors & Embalmers, Counsel for Bowditch & Dewey, LLP
has submitted a request to me to withdraw from representation in this matter.
I have acquiesced to this request from Bowditch & Dewey, LLP, and have
notified the Division of Professional Licensure that I shall represent myself
for the duration of the Prosecution’s case and potentially for the
presentation of my defense to the vicious and malicious complaints filed
against me by person(s) named in previous updates on this web site.</p>
<p>I have been notified by the Division of Professional Licensure that the
final three (3) witnesses – Mr. Kurt Mangsen, Mr. John Bresnahan,
and Mr. Tracy Mitchell will testify for the prosecution on Friday, March
31, 2006; after which I will have the opportunity to cross-examine each
witness – a process I very much look forward to and will prepare for
with the truth and facts to support the questions I WILL ask.</p>
<p>Certainly not a lawyer and not schooled in administrative and legal proceedings,
I find myself at somewhat of a “disadvantage” from a process
standpoint; but with the distinct “advantage” of having the
facts, the truth, and the results of our investigation at hand and ready
to expose those guilty of the unjust attacks on me. My challenge (and I
have quickly learned it may be the challenge of my life to date) is to find
the vehicle and mechanism to get the truth, the facts, and the results of
our investigation into evidence and before not only the Administrative Hearings
Counsel, who will make a recommendation to the State Board of Registration
of Funeral Directors and Embalmers, but before the State Board Members themselves.
</p>
<p>But then I take a long and hard look at the membership of the State Board
– then and now. What do I mean by this? When the complaints were originally
filed more than 2 years ago, membership of the State Board was comprised
of Mr. John Kazlauskas (chairperson and a co-conspirator in this controversy),
Ms. Kathy Cartmell-Siricco (Secretary), Mr. Ralph Barile (Member), Mr. Edward
Mazur (Member), and Ms. Judith McCarthy (Public Member). Mr. Kazlauskas
is now deceased. I have recently been informed that Mr. Barile’s participation
as a member of the State Board came to a sudden conclusion for personal
reasons, and that Ms. Cartmell-Siricco’s term on the State Board had
expired; leaving Mr. Mazur and Ms. McCarthy as the only two remaining members
of the State Board dating back to December 9, 2003 – and witnesses
to the conspiracy I have alluded to in correspondence to State Officials
and presented on this web site.</p>
<p>It has been suggested to me that not a single member of the State Board
or member of the Division of Professional Licensure has listened to the
extremely damaging and quite frankly, fatal audio tape of the proceedings
of the State Board Meeting of December 9, 2003. If true, how unfortunate!</p>
<p>We now have two or more new members of the State Board of Registration
of Funeral Directors and Embalmers joining Mr. Mazur and Ms. McCarthy to
pass judgment on issues of which they have little or no knowledge, and which
they will not have had the opportunity to witness the proceedings dating
back to November 19, 2003. They will not have had the opportunity to hear
the audio tape referenced in the previous paragraph. They will not have
had the opportunity to personally question me on the proceeding leading
up to Mr. Bresnahan’s visit to Nordgren Memorial Chapel on November
19, 2003, the charade and conspiracy which took place and is recorded in
its every word with the voices of the conspirators clearly identified on
the audio tape, or my in-depth, detailed, and substantiated<br>
responses to “shot gun” complaints filed in what has become
a $1M “Witch Hunt”.</p>
<p>I suggest to you that individuals have broken faith with a system they
had sworn to protect. The system is not necessarily broken, but persons
within the system have compromised the integrity of the process. I intend
to do everything within my power to bring the truth, the facts, and the
process to the point of “Justice Being Served.” Yes, I realize
– “Justice Oftentimes Comes at a Very High Price” and
I’m sure there are instances where justice is not or cannot be served.
I am committed to the truth being heard. I am committed for the facts to
be presented and heard. And I am committed to Justice being served - and
for those who have deliberately lied for their own personal gain and to
support their personal agendas to the detriment of the system - to be held
accountable for their statements and actions.</p>
<p>At this point in the proceedings, I have financial expenditures and obligations
exceeding $300K, and I have yet to have the opportunity to present my defense.
I look forward to publicly presenting witnesses to come forward under oath
and to tell the truth; to dispel the vicious, defaming, prejudiced, and
biased statements made by parties to the conspiracy; and to bring to the
attention of all parties to these matters – individuals, state appointees,
state officials, and the general public – that character assassins
WILL NOT be tolerated – that character assassins WILL BE identified
– that character assassins WILL BE rooted out – and that character
assassins WILL BE held accountable for their actions today and for every
day of the rest of their lives. And if I had my way, character assassins
would have to register with the authorities in the same manner as “child
molesters” – for damage done by character assassins in most
instances is irreparable and lasting.</p>
<p>“I thank you for your prayers, your calls, and your words of encouragement”,
and I will not let you down as I promised you 28 months ago. <strong>GOD
BLESS YOU ALL!</strong></p>
<p>I shall continue to present on this web site the truth, the facts, and
the proceedings as they happen and unravel before us. You have my word.</p>
<p><strong>Unless there are breakthroughs unanticipated at this point, Part
4 of the 12 part series will be presented on Wednesday, March 22, 2006.
