<p>On October 5, 2005 and again on October 12, 2005 (<em>correspondence that
was published on this web site in the Update on October 14, 2005</em>),
I wrote to Ms. Anne Colleton, Administrative Hearings Counsel, Division
of Professional Licensure reiterating the unusual and unjust hardship being
imposed on those in poor health and elderly, who will be compelled to come
to Boston (now in mid January 2006 / in the middle of the winter) to testify
to the accusations and allegations of three (3) Central Massachusetts funeral
directors at the hearing I requested in July 2004. Not only has 17+ months
passed since we requested a hearing, but to schedule the hearing in the
middle of the winter to discourage attendance by those who are in a position
to refute the findings of the State Board and its investigator is just another
travesty of justice that is typical of the corruption that permeates the
State Board of Registration of Funeral Directors and Embalmers and the Division
of Professional Licensure.</p>
<p>The State Board and Division of Professional Licensure demand answers to
their inquiries in ten (10) days, but take months (two months and counting
in this case) and years in other instances to reply if they reply at all.
</p>
<p>Another instance of colossal proportions was the request made of me to
complete an application for another license – forms and directions
sent to me by the State Board. The application and my personal check for
the license fee were forwarded to the State Board on August 6, 2004 and
“you guessed it” no response, correspondence, or contact by
the State Board for 16 months and counting. It is clear these civil servants
are serving ONLY their personal agendas at the expense of honor, integrity,
and credibility – and the public’s perception of the corrupt
civil servant continues to be reinforced by the actions and lack thereof
by those referenced above.</p>
<p>On September 29, 2005 I requested an<strong> “Advisory Opinion”</strong>
of the State Board concerning penalties for funeral directors and funeral
homes that make or have made transfers of deceased human beings using individuals
that were not licensed by the State Board and “you guessed it”,
no response 10 weeks later and counting.</p>
<p>We have listed and continue to make note of the State Agencies and individuals
therein within the Commonwealth of Massachusetts that have been contacted
and presented with the facts and documentation to substantiate our findings
– and all have been reluctant to get involved and have referred us
to others within the Commonwealth. The list reads like the “who’s
who in Massachusetts”, and is comprised of individuals who are being
paid to assure the honor and integrity of the system is upheld – individuals
that are <strong>“dismal failures”</strong> to say the least!</p>
<p>A clergyman with whom I have shared each and every aspect of the issues,
allegations, and accusations along with responses thereto over the past
two (2) years to include the transcript of the December 9, 2003 meeting
of the State Board, and who continues to shake his head in dismay at what
he sees, has made two (2) very astute observations.</p>
<p>The first observation by ‘the man of the cloth’ is that of
the investigator, Mr. Bresnahan. During his unannounced visit in November
2003 at the funeral home, he thought he heard a “quack.” “It
must be a duck,” he surmised. Mr. Bresnahan couldn’t see a duck,
but it must be here. Then in a distance he saw something walking and said
to himself – “it’s got to be a duck!” Not being
able to see that far away, he thought what he saw was a waddle of some sort.
“Aha! It is a duck” he concluded. Mr. Bresnahan then set out
to make assumptions based upon non truths to support his supposition that
it looked like a duck, walked like a duck, and the quack making the noise
sounded like a duck – so it had to be a duck – <strong>wrong!</strong>
</p>
<p>The second and most profound observation and which the Clergyman so eloquently
stated to me is:</p>
<p> <strong>“As you find yourself the victim of other people’s
bitterness, ignorance, smallness, and insecurities; Remember, things could
be worse – “You could be one of them!” </strong></p>
<p><strong> GOD FORBID !!</strong></p>
