& Corruption [continued]

Update – November 28, 2005

I am shocked, and quite frankly, overwhelmed by the calls, messages, and
correspondence received as a result of the November 19, 2005 Update. It
is apparent Competence & Confidence in the State Government
here in the Commonwealth is severely lacking and my experiences of the past
two (2) years are not atypical of experiences of others.

As for the issue of a “double standard and selective enforcement”
along with the corruption I have alluded to in previous updates as it pertains
to the State Board of Registration of Funeral Directors & Embalmers,
I have been besieged with additional information and instances of threats
made to funeral directors by members of the State Board and its investigator.
I have indicated to those who have contacted me that I greatly appreciate
their input, but my commitment is to present ONLY the truth and all relevant
facts to the State Board regarding the allegations made against me. As such,
I will present approximately 30 witnesses to clearly demonstrate what the
State Board already knows – “that I was set up by several Central
Massachusetts Funeral Directors including the Chairman of the State Board
at the time and that the State Board has done everything in its power to
hide behind its incompetence and flawed investigation.”

Although I find it interesting to listen to experiences of others and have
made note of the information shared with me, the Eastern Orthodox Community
of Central Massachusetts has been unfairly and unjustly deprived of the
professional services of the ONLY Eastern Orthodox Funeral Director in Central
Massachusetts by a State Board without benefit of an Administrative Hearing,
misrepresented its position when requesting action by me, and intentionally
did not respond to requests from me and my attorneys hoping that its former
Chairman would die before I had the opportunity to cross examine him. (I
refer to Mr. John Kazlauskas, recently departed).

“Guilty Until Proven Innocent” in the Commonwealth of Massachusetts.
How Sad!

We look forward to publicly cross-examining those Central Massachusetts
funeral directors and State Officials responsible for the vicious accusations
and allegations and shall present the actual families referenced in the
accusations as witnesses to testify to the truth. You will not want to miss
this. I shall share the actual testimony with you on this web site at the
appropriate time.

With more than 8,000 hits on this web site since April 2005, (I am told
many funeral directors and others go to the web site several times each
week) I am surprised, but not shocked, by the interest generated by the
100 % factual information presented. It is not my intent or the intent of
this web site to discredit the multitude of honest, caring, and extremely
professional individuals with whom we entrust our departed loved ones when
the GOOD LORD calls them home. These funeral directors of unquestionable
integrity become tainted by those few (very few) that are less than honorable
for their personal gain at the expense of those who have spent their lives
honorably serving families at the time of their very difficult loss.

I do not like the term “Lie” – for it carries a connotation
that cannot ever be reversed. Telling the truth after one has been less
than truthful – does not take the pain away or make the situation
right – all of a sudden. Just like when Mr. Kazlauskas realized his
defaming and prejudicial remarks were being recorded during the December
9, 2003 meeting of the State Board and he stated, “I take them back!
I shouldn’t have said that! Can you erase it, Kim?” At that
moment, most members of the State Board began to laugh (the laughter being
a tension release laughter, I suspect). At some point in the near future,
these and other statements made during the meeting will be made available
for you and all to hear.

The point to be made is that individuals that make statements that are
less than truthful MUST be held accountable for their actions. Individuals
that make statements to deliberately hurt others personally and professionally
MUST be identified and held accountable for their statements and actions.
Individuals that deliberately reach into their bag of tricks (to fabricate
circumstances) to attempt to justify their inappropriate actions and address
a non truth with another non truth – and you guessed it – they
get caught again and again and the attempted cover up ends up worse than
the original non truth – MUST be rooted out for the good of all.

Who loses in this scenario? I suggest to you – “Everyone
loses!” The person to whom the statements are directed –
loses. The person(s) making the statements – lose.
The State Board and State Government in the Commonwealth of Massachusetts
in this case – lose. The Funeral Industry, at least
within the Commonwealth of Massachusetts, - loses. The
Eastern Orthodox families that experienced the loss of a loved one during
the past two (2) years and were deprived of the professional services of
one of their own by funeral directors and state officials with a personal
vendetta as their motive – are the “true losers.”
Lest we forget – “A family does not get a second chance
to say good-bye to a loved one” and if any detail is left
unattended or not as the traditions and desires that the family has come
to expect are adhered to – there is no corrective action at a later
date that can make the situation right.

And lastly, the public – loses! For I suspect when the truth be heard
and aired for all to see and hear, the public’s perception of a funeral
industry out of control at its very roots will long be etched in the minds
of those making or contemplating making funeral arrangements.

Before concluding this update, I want to address Ms. Judith McCarthy, Public
Member of the State Board of Registration of Funeral Directors & Embalmers.

Ms. McCarthy, on December 9, 2003 during my appearance at the State Board
Meeting, I indicated that on one of the occasions wherein I was asked to
appear before the State Board, I was questioned about an anonymous complaint
that had been made to the State Board about me. Do you recall your comments,
Ms. McCarthy? If not, please refer to the recording of the meeting.

At that time, Ms. McCarthy, you stated to me and for the record that the
State Board does not respond or take action on anonymous complaints? Do
you recall this? Well, thanks to an excellent legal staff and several concerned
citizens that regularly read this web site in addition to findings we have
uncovered as a result of our investigation, I have obtained documents which
verify the accuracy of my recollection dating back to November 1, 1985 (20
years ago) and as presented at the December 9, 2003 meeting. The hostile
and confrontational environment created prior to and during my appearance
at the meeting did not present the proper forum to correct you nor did anyone
including the two (2) State attorneys present take a position in support
of or in opposition to your statement. It was certainly not my intent to
embarrass you then or now, but the record needs to be made quite clear.
I tell ONLY the truth!

In a subsequent update, Ms. McCarthy, I shall share with you and all interested
parties the exact content of the complaint, documents prepared by my attorneys,
and the official response requested of and provided to us by the State Board.

Next Update – December 7, 2005
