As I continue to review the findings of our investigation, I am torn between
presenting all the findings on this web site, (which, by the way, the Funeral
Monitor refers to as a “blog”) or to withhold the findings until
a hearing is held, the witnesses for the prosecution are cross-examined,
and we present our witnesses which will prove the accusations and allegations
made by the Mangsen’s, Mr. Mercadante, & others are blatant lies.

I recently took time to once again review the transcript of the December
9, 2003 meeting of the State Board of Registration of Funeral Directors
& Embalmers and each time I review the transcript, I see, hear, and
learn more of the details of the conspiracy now that we have conducted our
own investigation. It is abundantly clear to us now why the State Board
did not want us to receive the recorded proceedings of the meeting. The
process was corrupted from the outset. The members of the State Board, led
and “infected” by its Chairperson, John J. Kazlauskas, violated
every ethical, moral, and professional standard of conduct leading up to,
during, and after the meeting by their actions.

When we produce witnesses to demonstrate that certain funeral directors
(I refer to them as co-conspirators) lied to the State Board and that the
State Board took gross liberties in their conclusions drawn as a result
of statements made by their own Chairperson as well as those with “an
axe to grind” and to personally benefit from their lies, what action
will be taken by the State Board, the Ethics Commission, and potentially
the courts will be an interesting take. Suffice it to say, you can read
      it all right here.

I learned early on from a very wise man that one should “think
twice before speaking once” - and if you do so you will not
be forced spend time explaining why you made such stupid, untrue, and damaging
statements during an emotional lapse in judgment.

On December 9, 2003, John J. Kazlauskas, Chairperson of the State Board
made repeated derogatory and defaming statements about me in the presence
of all Board Members, two state attorneys, John Bresnahan (the Board’s
investigator), and others in attendance. Caught up in the emotion of the
moment and without benefit of input from me, Mr. Kazlauskas went on a tirade
with rumors and innuendo’s as the basis for his comments and verbally
viciously attacked me in front of all parties. Referring to me, Mr. Kazlauskas
made the following statements, which we have on tape and which have been
      transcribed into written record:

Mr. Kazlauskas, “He’s a real scavenger. He’s
a carpetbagger. He offered me – I’ll put
it out there. He came to me before he went to Nordgren’s
and he offered me the following: ‘If I come to you I will bring
        you my business.”

“What do you mean, Phil, your business? You don’t have a
business. I have a following, and if you will give me 90% of the casket
mark up, you’ll get 10% plus the cost of the product and overhead,
and you can even keep the vault sale.”

“And I said, Phil, absolutely not. I want no part of you. That’s
an illegal arrangement.” And that’s what these guys said (referring
to the Mangsen’s and Ronald Johnson). So that these people, Nordgren,
will stand up to the fact that that’s what was happening in the
past. I think you’ve got a clear case of sending this thing to prosecution.”

At this point, Attorney Christopher Carroll interrupted, “First
off, it isn’t even a complaint yet, correct?”

Mr. Kazlauskas, “Well it has to be docketed, yeah.”

Atty. Carroll, “Docketed, and they have to respond.”

Mr. Kazlauskas, “Yep!”

Atty. Carroll, “They have to get a response.”

Mr. Kazlauskas, “Okay. All Right. He’s going to threaten
        to sue everybody. He’s already… He’s a snake.
Excuse me, are we on the record?”

Ms. Cartmell-Sirrico, “Yes!”

Mr. Kazlauskas, “I didn’t say that. Can you delete
        that part, Kim?” (Laughter)

Mr. Kazlauskas, “I apologize. I shouldn’t have said
        that. Okay?”

Mr. Kazlauskas, “So what’s your feeling, do you want me
        to stay in?”

And the conspiracy begins to unravel even more.

Not only did I never approach Mr. Kazlauskas about a business
association, his violent outburst came only after he was caught in his words
and the emotion of the moment, and like a cage animal wounded as he was,
Mr. Kazlauskas attacked me in a fit of desperation.

A question to be asked, were Mr. Kazlauskas with us today, is “Mr.
Kazlauskas, as a long time member of the state Board and its current chairperson,
why would you wait until now (10 years after the supposed conversation with
Mr. Haddad) to make this allegation and accuse Mr. Haddad of coming to you
      with an illegal business arrangement?

Add to this the actions of the State Board to delay the hearing I requested
for more than 470+ days, denying me the opportunity to confront Mr. Kazlauskas
while he slowly died of cancer, and you have the makings of a “colossal
conspiracy” that is sure to “rattle the foundation” upon
which the State Board of Registration of Funeral Directors & Embalmers
      was created.

In the next update, I shall share with you comments and statements made
by John Bresnahan, Board investigator, not only of a biased nature, but
partial and prejudicial based solely upon conversations and statements made
to him by Mr. Kazlauskas, Kurt & Katherine Mangsen, and Ronald Johnson
and without input from me. I shall also share with you assumptions drawn
and statements made to all members of the State Board and others in attendance
at the December 9, 2003 State Board meeting by Mr. Bresnahan prior to me
      being invited into the meeting.

Please note: none of the information presented herewith
was known to me until 10 months later. The State Board was hoping that I
would not access the recorded proceedings, and did everything in their power
      to prevent it.

If you believe in a “supreme being” – (GOD to
those of us that are true believers), you must know that each of
us must atone and will be held accountable for our actions. Are you concerned?
      You should be!

Believe it or not, I pray each day that the GOOD LORD will have mercy on
the soul of Mr. Kazlauskas. I also pray for truth and justice to permeate
those misguided persons within the funeral profession and within the State
Board of Registration of Funeral Directors & Embalmers, and Division
of Professional Licensure that they stand for who they are personally, professionally,
and spiritually. You can stand for truth & justice now or live every
day of the rest of your lives knowing “You will stand for your actions
      at the day of judgment.”

I find it interesting, “Everyone wants a place in heaven, but many
are not prepared to make a commitment to truth and justice until they confront
their mortality – and then they will say and do anything to get there.”

As I have been told on numerous occasions, “God’s no fool.
You can sugarcoat and in your mind cover up anything, but the GOOD LORD
      sees, hears, and knows all.

And in this case, I know he’s listening. Are you?
