    <p>I had prepared a series of questions for this update that were a result 
      of our 23 month investigation of the origin of statements and actions taken 
      by several funeral directors in Central Massachusetts as well as members 
      of the State Board of Registration of Funeral Directors and Embalmers, Commonwealth 
      of Massachusetts. At the very last minute, I was asked to withhold the content 
      of the scheduled update; since there finally &#8220;appeared&#8221; to be 
      positive movement on the issues, which I have been presenting on this web 
      site for more than 7 months. I cautiously agreed to hold off till next week 
      with the initial series of questions.</p>
    <p>The following correspondence was forwarded to Ms. Anne E. Colleton, Administrative 
      Hearings Counsel, Division of Professional Licensure through Leslie Alexander, 
      Prosecuting Counsel, Division of Professional Licensure on Wednesday, October 
      5, 2005 listing those individuals who have made vicious and malicious statements 
      or comments about me that the State Board investigator and the State Board 
      have accepted as fact. Additionally, in the same correspondence we have 
      listed those witnesses we shall call to testify to the truth at the hearing 
      yet to be scheduled. (471 days later and several witnesses have passed away, 
      and yet NO hearing).<br>

      <p><strong>&#8220;How many more members of the State Board must pass away, 
        before you conduct the hearing I requested fifteen (15) months ago?&#8221;

      <p><strong>&#8220;How many more witnesses for my defense must pass away, 
        before you conduct the hearing I requested fifteen (15) months ago?&#8221;</strong></p>
      <p>It is patently obvious the State Board of Registration of Funeral Directors 
        and Embalmers did everything in their power to prevent me from obtaining 
        a copy of the taped remarks of its Chairperson, John J. Kazlauskas made 
        during the meeting of the State Board on December 9, 2003. Prior to my 
        being invited into the meeting, Mr. Kazlauskas called me a <strong>&#8220;Carpetbagger&#8221;</strong> 
        and a <strong>&#8220;Snake&#8221;</strong> in addition to other biased, 
        prejudiced, and defaming remarks to the entire group of State Board Members, 
        administrative staff, two attorneys for the State Board, and others in 
        attendance. When he realized the proceedings were being recorded, he attempted 
        to retract his comments and even asked for them to be erased. Informed 
        this could not be done and now backed into a corner, Mr. Kazlauskas, like 
        a wounded animal, attacked me further accusing me of attempting to create 
        a business association with his funeral firm 10+ years earlier. All of 
        Mr. Kazlauskas&#8217;s statements are blatant lies and a vicious attempt 
        to eliminate my participation in the funeral business in Central Massachusetts.</p>
      <p>Mr. Kazlauskas was advised by counsel to recuse himself as Chairperson 
        and participant in the meeting and did so prior to my being invited into 
        the meeting. Immediately upon my departure from the meeting, Mr. Kazlauskas 
        assumed the Chairmanship of the meeting, invited the Mangsen&#8217;s and 
        their attorney into the meeting and commenced another verbal attack on 
        me and my character. Not only is/was this a conflict of interest and a 
        violation of my rights, but &#8220;an extraordinary lapse of judgment&#8221; 
        by the two (2) attorneys for the State Board as well as all members of 
        the State Board as they participated in and allowed this charade to happen.</p>
      <p>The State Board issued the Order to Show Cause to me on June 29, 2004. 
        I immediately requested a hearing as the Order prescribes and within the 
        twenty-one (21) day period. The State Board and Division of Professional 
        Licensure denied me the opportunity to confront Mr. Kazlauskas, knowing 
        if they delayed the proceedings long enough, Mr. Kazlauskas, who had just 
        recently been diagnosed with pancreatic cancer, would pass away soon. 
        (Mr. Kazlauskas died fourteen months after making the vicious, malicious, 
        and defaming statements &#8211; and eight months after the Order to Show 
        Cause was issued to me).</p>
      <p>Obviously, I was denied the opportunity to confront Mr. Kazlauskas, my 
        accuser!</p>
      <p><strong>&#8220;ONCE AGAIN WE REQUEST THAT THE SHOW CAUSE HEARING BE SCHEDULED 
        AND HELD IN WORCESTER FOR THE CONVENIENCE OF THE MANY WITNESSES TO BE 
        CROSS-EXAMINED AND/OR EXAMINED. THE MAJORITY OF THE WITNESSES ARE ELDERLY, 
        SEVERAL ARE WHEEL CHAIR BOUND, ONE HAS MULTIPLE SCLEROSIS, AND MOST HAVE 
        EXTREME DIFFICULTY TRAVELING. ALL, WITH FEW EXCEPTIONS, ARE RESIDENTS 
        OF CENTRAL MASSACHUSETTS AND TO COMPEL THEM TO TRAVEL TO BOSTON, HASSLE 
        THE TRAFFIC, AND FIND PARKING WOULD BE CRUEL AND UNUSUAL PUNISHMENT FOR 
        THOSE PREPARED TO TELL THE WHOLE TRUTH&#8221;.</strong></p>
      <p>The following is a list of those individuals with knowledge or information 
        that is pertinent to issues raised in complaints EM-04-124, EM-04-126, 
        and EM-04-184 by Mrs. Katherine Mangsen, Nordgren Memorial Chapel in her 
        <strong>&#8220;witch hunt&#8221;</strong> attempt to impugn my character, 
        and to which I am prepared to prove the State Board of Registration has 
        willingly become co-conspirators in the process.</p>

        <li>Catherine Rizkalla, re: upon hearing of Mr. Haddad&#8217;s termination 
          from and by Nordgren Memorial Chapel, Mrs. Rizkalla contacted Mr. Haddad 
          and asked that I meet with her and her daughter and son-in-law the next 
          Saturday morning to discuss transferring her pre-need arrangements to 
          another funeral home. Since Mercadante Funeral Home had recently conducted 
          the funeral for the Ghiz Family and were generally pleased, Catherine 
          Rizkalla and family decided to transfer the arrangements to Mercadante 
          Funeral Home. Nordgren Memorial Chapel and subsequently the Board have 
          accused me on encouraging this action</li>
        <li>Edward Haddad, re: transfer of his mother, Freda Haddad&#8217;s funeral 
          arrangements from Nordgren Memorial Chapel to Mercadante Funeral Home</li>

      <p> Not all witnesses we intend to call to testify to the facts are willing 
        participants. There are several witnesses we believe to be reluctant and 
        potentially hostile witnesses, but they possess knowledge of facts pertinent 
        to the issues alluded to in the Order to Show Cause. For the good and 
        welfare of those whom we shall examine in presenting the facts in order 
        to dispel the statements of fact as presented in the Order to Show Cause 
        signed by Ms. Kathy Cartmell-Sirrico as well as for those who shall be 
        cross-examined as a result of their statements and participation in the 
        findings of the investigator, State Board, I <strong>plead</strong> with 
        you to consider the frailty and health of those who not only have recently 
        lost loved ones, but who have been agonized by the long wait to speak 
        the truth in this matter and once again we request the hearing be conducted 
        in Worcester. </p>
      <p>Please be advised that it is out intent to invite the media to attend 
        the hearing in its entirety.</p>

    <p>The second correspondence included is another Letter to Ms. Anne E. Colleton, 
      Administrative Hearings Counsel, Division of Professional Licensure requesting 
      once again a &#8220;venue change&#8221; for the Show Cause Hearing from 
      Boston to the Worcester County area. The rationale: 7 of the 10 witnesses 
      for the State Board reside in Worcester County, 1 in Pittsfield, 1 is now 
      deceased, and the other individual&#8217;s residence is unknown to us at 
      this time. </p>
    <p>The list of witnesses we shall call to attest to the truth is 23; with 
      22 of the witnesses to be called from the Worcester County area. Additionally, 
      several of the witnesses to be called are elderly, in poor health, and in 
      several instances wheel chair restricted. Forcing them to commute to Boston 
      and hassle the traffic and parking obstacles would be harsh and unjust punishment. 
      <strong>&#8220;The convenience to the parties and witnesses, and the interests 
      of justice, would clearly and substantially be served and improved by a 
      transfer of venue from Boston to Worcester.&#8221;</strong></p>

      <p>Of the ten (10) witnesses for the prosecution and witnesses we have identified 
        we wish to cross-examine; seven (7) reside in Worcester County, one (1) 
        in Pittsfield, one (1) is deceased (reference &#8211; John J. Kazlauskas), 
        and the residence of Mr. Byron Blanchard is unknown to us at this time.
