Reports That Are Affecting You</b></span></font></h3>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">For
the 4<sup>th</sup> consecutive year, Health and Welfare (H&W) costs are
employers top benefit concerns. 86% of all employer respondents to a new
survey by the International Society of Certified Employee Benefit Specialists
(ISCEBS), said that their top priority for 2003 is to control the exploding
costs of H&W. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">Employee
benefits now account for 40% of payroll costs. (Up from 37.5% in 2002) Those
benefits include H&W insurance, vacation, paid time off and retirement/savings
plans. Medical benefits were no. 1, paid time off benefits were no.2 and retirement/savings
plans were no.3.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">Time
off and disability programs now account for 15% of payroll costs. This
includes holidays, vacation, personal days, and the Family and Medical Leave
Act (FMLA). For employees earning $40,000 annually, that means that $6,000
of their pay was for time off. That�s equal to 39 days a year. (27 scheduled
days and 12 unscheduled days)</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">A
recent survey from the Society for Human Resource Management (SHRM) reported
that the FMLA is so complicated and paper/procedure oriented, and that employers
are so concerned about the serious penalties for violations, that up to 63%
of them avoiding using any controls at all. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">This
means that they are allowing more than the 12 weeks required by law (16 weeks
in California), providing employer-paid pay and benefits even though that is
not required (except in California), allowing non-eligible employees to use
FMLA and in some cases employers who are not required to provide FMLA (if they
have under 50 employees) are providing it anyway. This is primarily because
employers find the FMLA so complicated and threatening that they simply allow
employees to use it as they wish and absorb the cost.</font></p>
<p class="MsoBodyTextIndent"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">Senator
Judd Gregg, Senate Chairman of the Health education labor and Pensions Committee,
has introduced a bill to make FMLA easier to understand and to limit the broad
definition of what constitutes an eligibility to FMLA time off. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">However
Senator Christopher Dodd has also introduced a bill to <i>expand</i> the definitions
of reasons an employee can use to claim FMLA leave. The bill also lowers the
number of employees required before you must provide FMLA down to 25 instead
of 50. The bill also requires that employees be paid for the time off
on FMLA. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">As
an employer, which bill would you rather see enacted? Time to get a lot
more interested in benefit legislation?</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">In
an interesting side note, many past surveys have shown that employees say that
they would accept pay cuts to gain better benefits. However, a more recent
study by AON showed that employees of small companies want pay more so than
benefits.</font></p>

<h3><u><b>Immigrants In The U.S. Workforce</b></u></h3>
<p class="MsoNormal">A study by the Center For Labor Market Studies at Northwestern
University showed that immigrants counted for half of all the new workers
in the United States over the past decade. And that they will
continue drive economic growth and compensation programs for years to
come.</p>
<p class="MsoNormal">The report stated that 16 million new workers entered
the labor force between 1990 and 2001. 8 million of them were immigrants.</p>
<p class="MsoNormal">Some interesting points to ponder:</p>
<p class="MsoNormal" style="text-indent: -.5in; margin-left: .75in">1.<span style="font:7.0pt "Times New Roman"">
</span>About half of those workers (4million) are in the country illegally</p>
<p class="MsoNormal" style="text-indent: -.5in; margin-left: .75in">2.<span style="font:7.0pt "Times New Roman"">
</span>Nearly 25% of them are in Management, Professional and Technical
jobs.</p>
<p class="MsoNormal" style="text-indent: -.5in; margin-left: .75in">3.<span style="font:7.0pt "Times New Roman"">
</span>Without that influx of 8 million workers, the U.S. economy would
almost certainly have degraded seriously as almost all of those immigrants
went into jobs that U.S. employers could not fill.</p>

I�m Going To Run Down To 7/11 To Get Some Car Insurance!</u></b></font></span></h3>
<span style="text-decoration: none"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">
<p class="MsoNormal">7/11 convenience stores are expected to begin offering
instant auto insurance through electronic kiosks in late 2003. The
kiosks are owned by VCOM and can be used to pay bills and cash checks
in addition to offering auto insurance quotes, instant auto insurance
and the ability to make all the premiums payments at any of the kiosks.
</p>
<p class="MsoNormal">If successful, the plan is to expand the service to
include on-line banking and pre-approved lines of credit. It is
expected that 1,000 of them will be activated in 2003 and expanding to
2500 next year.</p>

<h3><u><b>Sleeping on The Job Protected by FMLA</b></u></h3>
<p class="MsoNormal">An engineer working for AVON products on the night
shift was caught sleeping on the job. Security videos showed that
he was doing this quite often. When the Supervisor decided that
he needed to address the issue with him he discovered that the employee
had left early for the day. </p>
<p class="MsoNormal">The Supervisor tried to contact him to no avail.
His sister, however, said that he was �very sick�. When finally
contacting him he agreed to a meeting to discuss the issue. He failed
to show for the meeting and was then terminated. </p>
<p class="MsoNormal">2 months later the employee contacted the company and
said that he had been under treatment and wanted to be re-hired. The company
refused and the employee then filed suit under the Family and Medical
leave Act (FMLA) and the Americans with Disabilities Act (ADA).
</p>
<p class="MsoNormal">Although he had not filed the required FMLA leave request
form, or even requested leave, the 7<sup>th</sup> Circuit Court
of Appeals in Chicago ruled that the sister�s statement that he was �very
sick� was sufficient notice for FMLA leave. </p>
<p class="MsoNormal">The court also ruled that since he had been a good
employee prior to that time, his sudden change of behavior would also
be accepted as advance notice for FMLA leave.</p>
