VACATION DOWNTIME</font></b></h2>
<p class="MsoNormal"><font size="-1" face="Verdana, Arial, Helvetica, sans-serif">Vacations
are no longer the simple benefits of past years. That�s true in the way
we schedule them as well as the way we use them. Seniority is not always
the priority in scheduling and employees now use vacation increments of a few
hours or days for FMLA purposes.</font></p>
<p class="MsoNormal"><font size="-1" face="Verdana, Arial, Helvetica, sans-serif">Many
employers in seasonal industries require employees to schedule vacations during
the off-season, and in some states vacation accrual is now considered wages
and must be paid if the employee leaves the company.</font></p>
<p class="MsoNormal"><font size="-1" face="Verdana, Arial, Helvetica, sans-serif">But
one issue remains the same; the crunch and the downtime we experience when employees
take that vacation. Here are 7 ways to minimize that problem.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1"><b><u>1.Develop
A Production Guide</u></b> This is a document that explains what tasks
need to be accomplished by this position. It should describe the who,
what, when, why and where of this job. It should include time schedules,
location of the necessary forms, tools or supplies and the names and phone numbers
of necessary contacts.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1"><b><u>2.
Centralize Procedures</u></b> When the Office Manager is out, whom do
you call for supplies, repairs and medical emergencies? Where are the
keys to everything, who has the passwords and combinations if we need them?
All this information should be available to those who are filling in. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1"><b><u>3.
Use This As A Cross Training Opportunity</u></b> Train people to do each
other�s jobs. (Just don�t schedule their vacations at the same time) This
is an excellent opportunity to start developing future leaders and to broaden
the skills of as many people as possible. It might be an advantage to
a future General Manager to have worked in all the key departments. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1"><b><u>4.
Take Advantage Of The Absence</u></b> This may be the best time to schedules
maintenance, upgrades and inventories. How can you use this time to prevent
losses in production during normal operations. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1"><b><u>5.
Update Message Machines And E-Mail</u></b> Ensure that vacationers update
their message machines, voice mail, telephone messages and e-mail to inform
other employees, vendors and customers of their schedule. Include alternate
contacts and important information to assist callers. Be sure to inform
those who will be getting those re-directed messages. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1"><b><u>6.
Assign Ownership</u></b> Identify <i>who owns</i> which tasks. They
need to know that they have the responsibility <i>and</i> the authority to do
what needs to be done. The buck stops at them! If they need to be
oriented or trained to the task, do it early. Assure that everyone who
is affected by the absence is in on the process. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1"><b><u>7.
Reward The Performers</u></b> When the vacationer returns, a small gift
would be a great idea. It could come from the vacationer, or the company
might pop for a dinner, pizza or movie tickets. They�ll be a lot more
willing to do it again. What you reward, you get more of.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1"><b><u>8.
Outsource</u></b> Sometimes none of these options are possible.
If the work or the project must still be done, you may find it best to bring
in a temp, an independent contractor or a consultant to keep it on track.
In many cases you can get a professional job and save money in the long run.</font></p>
<p class="MsoNormal"><font size="-1" face="Verdana, Arial, Helvetica, sans-serif">Encourage
employees to take their vacation. Its important to their health and mental
well being. Vacation means to �vacate� You will see the difference.</font></p>

<h3><font face="Verdana"><b><u><font face="Verdana, Arial, Helvetica, sans-serif">Another
Reminder, The New Overtime Regulations Begin August 23<sup>rd</sup></font></u></b></font></h3>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">The
Department of Labor (DOL) has issued their final version of the new overtime
regulations. Current political wrangling may result in more changes
over the next few months but enforcement will still begin on August 23<sup>rd</sup>,
2004. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">Last
revised in he 1960s the regulations are outdated and vague. In the
1960s, there were far fewer white collar or exempt workers. It was
much easier to identify who was Exempt and who was Non-Exempt. And
of course the salary line between the two was set at $250 per week.
Today that�s not much more than minimum wage. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">The
new rules state that:</font></p>
<ol style="margin-top: 0in; margin-bottom: 0in" start="1" type="1">
<li class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">Anyone
earning less than $23,660 per year ($455 per week or $11.375 per hour)
is automatically Non-Exempt and must be paid overtime. </font></li>
<li class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">Anyone
who earns $100,000 per year or more AND qualifies under one of the Exempt
categories is Exempt.</font></li>
<li class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">All
those in between will be classified as Exempt or Non-Exempt based on
the content of their work.</font></li>
</ol>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">All
the following categories are Exempt:</font></p>

<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">All
of these job types are Non-Exempt regardless of how much they earn.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">One
significant change is in the 80/20 rule. Under the existing regulation,
any Exempt Supervisor, Foreman or Manager who spends more than 20% of
their time doing the same work as their subordinates (doing Non-Exempt
work) loses heir exemption and must be paid overtime. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">Under
the new regulations, there is no limit to the amount of Non-Exempt work
they do as long as the purpose and focus of the job remains supervisory
or managerial.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">DOL
states that just one complaint from a current or former employee will
be sufficient to initiate a full investigation. They expect that
there will be hundreds of DOL charges and thousands of lawsuits.
Law firms are gearing up for the expected bonanza.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">It
is important that you prepare now as the fines, penalties and back wages
can be destructive.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">The
July Personnel Notebook will review the new regulations in greater detail.</font></p>

<h3><font face="Verdana"><b><u><font face="Verdana, Arial, Helvetica, sans-serif">Do
Your Employees Use Your Company Computers?</font></u></b></font></h3>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">Most
companies know that they can be held liable for the actions of their employees
who illegally use the company�s E-mail or Internet. If an employee
accesses pornographic sites, harasses another employee or operates a personal
business on the company�s computer the legal charges and lawsuits will
likely be aimed at the company. </font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">With
this in mind, it was surprising to see the results of a current survey
by M Lee Smith Publishers that reflected the large percentage of companies
that do such use. </font></p>
