<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">At a meeting with a group of corporate executives, our Associate,
Loretta, was present to review the company�s �90-Day Probation Policy.�</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">She started the meeting by asking each executive why he or she had the
policy.<span style="mso-spacerun:
yes"> </span>What was their idea for the use and purpose of this policy?</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">One executive said, �For me it�s basically a way to head off any
potential long term problems by addressing them now.�<span
style="mso-spacerun: yes"> </span>Said another, �It keeps employees
directed and focused during that critical first three months.�<span
style="mso-spacerun: yes"> </span>�They know this is coming up.�<span
style="mso-spacerun: yes"> </span>Yet another said, �It�s a great
communication tool, it forces us to talk about progress and problems,
expectations and disappointments and if necessary to correct the direction the
employee is going.�</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">�All excellent answers,� she thought.<span
style="mso-spacerun: yes"> </span>Then the company President stated that
to him, �This was my opportunity to get rid of deadwood before I find myself
married to it.�</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">�Ouch,� she thought.�<span style="mso-spacerun: yes"> </span>�Boy,
I sure don�t like it when it�s the President that I have to use as a bad
example.�</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">Many companies use the �90 Day Probation� policy (aka 90 day
review or the 90 day performance appraisal) to get rid of those employees who
they feel just aren�t going to make it.<span style="mso-spacerun: yes"> </span>But
in fact there are few cases where the President�s purpose should be used.<span
style="mso-spacerun: yes"> </span>Most employers feel that this is an
opportunity to do something that you can only do during this 90-day opportunity.<span
style="mso-spacerun: yes"> </span>Some �freedom to act� that is only
available during this temporary period.<span style="mso-spacerun: yes"> </span>That
is not the case!</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">Although back throughout the 1930s and 1940s this was the common
acceptable policy for most companies, it was actually the growth and influence
of the union movement that embedded this concept in our minds.<span
style="mso-spacerun: yes"> </span>In most unionized companies, the union
contract stated that the employee had to join the union and pay dues after 90
days of employment.<span style="mso-spacerun: yes"> </span>This was to
allow the employee (and secondarily the company) the time to decide if this
relationship was going to work and if the union wanted this person in before
they joined the union.<span style="mso-spacerun: yes"> </span>At that
point the union became the representative of the employees� interests in all
employment related things.<span style="mso-spacerun: yes"> </span>The
company and the employee would no longer have the right to enter into
agreements.<span style="mso-spacerun: yes"> </span>The company would no
longer be allowed to work with the employee independent of the union.<span
style="mso-spacerun: yes"> </span>Later on this 90 day concept would
overlap into common practice.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">Let�s correct the main mistake and then get to the heart and purpose
of the �90 day probation.�</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">First, an employee has no more, no fewer, nor any different rights
after 90 days than before.<span style="mso-spacerun: yes"> </span>Nothing
changes.<span style="mso-spacerun:
yes"> </span>Even though the employee may have signed an understanding or
agreement to a 90-day probation he or she has no legal authority to sign away
any constitutional or legal employment right.<span style="mso-spacerun: yes">
</span>If your termination was unfair or illegal on the 95<sup>th</sup> day, it
is also unfair on the 85<sup>th</sup> day.<span style="mso-spacerun: yes">
</span>There is no gaining of rights to the employee on the 91<sup>st</sup> day,
nor loss of power to the company on the 89<sup>th</sup> day.<span
style="mso-spacerun: yes"> </span>In the eyes of the government
regulators, you made a decision to hire back when you did so!<span
style="mso-spacerun:
yes"> </span>It is assumed that you made your hiring decision after
following a legal and purposeful review of the qualifications of this
individual.<span style="mso-spacerun: yes"> </span>There are no second
shots, no �King�s X�, no, �this one doesn�t count� hiring decisions.<span
style="mso-spacerun: yes"> </span>This is the person you have chosen to
work with you.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">Is there then any value to the 90-day probation?<span
style="mso-spacerun: yes"> </span>Absolutely!<span
style="mso-spacerun: yes"> </span>All, the other reasons stated by the
executives are good answers.<span style="mso-spacerun: yes"> </span>But
the 90-day evaluation is more like a formal opportunity, an appointment, to do
what companies should do regularly anyway.<span style="mso-spacerun: yes">
</span>It�s like a second orientation session, a chance to do a course
correction on the path the employee is heading. This is a chance to address
concerns, commend positives, answer questions, ask questions, talk about company
plans and head off any potential problems.</font></p>
<p class="MsoNormal"><font face="Verdana, Arial, Helvetica, sans-serif"
size="-1">An interesting, internal study by General Electric showed why they
were losing so many employees in there first 90 days of employment.<span
style="mso-spacerun: yes"> </span>Include in your 90-day review a search
for these problems.</font></p>

there are problems, you can use the three-step �Performance Improvement
Program (PIP)� to proceed.<span style="mso-spacerun:
yes"> </span>A verbal, a written, and a probation process can lead to a
productive successful employee or a termination whether before or after the 90
days.</font></p>

between employers and Uncle Sam seems to be improving.<span style="mso-spacerun: yes">
</span>For some time the relationship was in many ways a government
view that employers were an evil element attempting to cheat and harm
employees and that employees were na�ve victims with very little intelligence.<span
style="mso-spacerun: yes"> </span>The new relationship seems to be
more a matter of employers trying to understand and comply with difficult
and complicated regulations and to have some input or hearing on the
issues.<span style="mso-spacerun: yes"> </span>While the Government
is not trying to be punitive but wants compliance and will listen to
input and rebuttal.<span style="mso-spacerun: yes"> </span>Some
bureaucratic processes are being streamlined. Some regs are being held
back for further revue or set aside all together.<span
style="mso-spacerun: yes"> </span>No �shoot first, ask questions later�
approach. The Feds are seeking<span style="mso-spacerun:
yes"> </span>voluntary compliance first and offering guidance in the process.<span style="mso-spacerun: yes">
</span>But on issues of safety, environmental and national security,
particularly with repeat offenders they are much more pressing.</font></li>
<li><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">The generation
of �Nexters� is about to enter the national workforce, just as the generation
of �Baby boomers� are beginning to take early retirement.<span style="mso-spacerun: yes">

<li><font face="Verdana, Arial, Helvetica, sans-serif" size="-1">A new
law providing federal funds for the redevelopment of old industrial
sites is in the works.<span

for lower cost facilities for new and growing companies and cities.</font></li>
